Mom convicted in son’s jaywalking death: ‘This will never end for me’

By Liz Goodwin

National Affairs Reporter

Nelson (Today Show)

A Marietta, Ga., mom who was convicted of jaywalking after her 4-year-old son was run over and killed in a hit-and-run said on the Today Show that the worst part of going to jail would be the separation from her two remaining kids.

Raquel Nelson was convicted of homicide by vehicle and reckless conduct by a jury and faces sentencing tomorrow. She can receive up to a three-year jail sentence, six times the stretch that Jerry Guy--who admitted to drinking before running over Nelson's son, A.J.--served.

"I think to come after me so much harder than they did him is a slap in the face because this will never end for me," she said. "It's three years away from the two that I have left."

Nelson also said that the jury had "never been in my shoes," because each of them answered that they had never taken public transportation before. Nelson, who doesn't have a car, was three-tenths of a mile away from the nearest crosswalk when her bus dropped her off at the stop across the street from her apartment with her three children. She decided to cross with her kids rather than remain outside any later at night, she said. (You can read more about her case here.)

"We are just hoping as a family that [the judge] is compassionate and lets my niece remain with her other children," Nelson's aunt Loretta Williams said.

Do you think she was a victim of circumstance and has suffered enough punishment or do you think she belongs in prison?

She was careless with not only her life, but the life of her child. I'd have to let the court decide and abide with its decision.

All she did was jay-walk, she's not the one who plowed into her son with a car, another driver did..prisons should be used to house violent offenders, thieve's, rapists, child molester's, etc..Not jay-walkers. Now, if this lady had pushed her son into the street, then yes, lock her up for life but that's not what happened.

As a driver in Miami, tons of people never use the crosswalk. Anytime I see someone standing in the middle of a median I automatically slow down just in case someone darts into the street. Most neighborhoods in rural areas are not planned to be pedestrian friendly. Maybe bus stops should be placed near the intersections and crosswalks. It's not a question of laziness, she made a poor decision. Besides, her son died and I'm sure she has suffered enough.

She deserves a prison sentence because

She put hers and her childrens lives in danger by not using the crosswalk. Too lazy, apparently.

She "didnt know better"? than to jaywalk? Thats what jaywalking laws are for, pedestrian safety. I know the driver had been drinking (they didnt say he was drunk) but he like most other drivers dont expect people to stroll out into the street....that woman was responsible to get her kids across safely, but was too lazy to walk 3/10ths of a mile to do it.

I do understand, but many of us do it anyway, I know she was wrong but she didn't do it just to kill her family or herself, she didn't think it will be a great deal, and she has suffer enough, she has learned her lesson like many did... but she didn't kill her son purposely but unconsciously and that is a different story, this type of story is what teach people to be more safer...

I know she didnt do it just just to get anyone killed, but she did.

I don't think she should go to Jail, you and I we have different type of views..

For you Casey Anthony is not gulty because some people stated she is innocent and for me she is gulty

For you this woman is gulty because some people stated she is and for me she is not

    We have different views...

We werent talking about Casey Anthony, and I didnt follow the case. Who knows, she may be as guilty as OJ Simpson is.

I know we are not talking about Casey Anthony but real murder or accomplice get away with a major deal and many people that didn't do anything maliciously get punished, that is what I am talking about, the law should fit everyone the same but it is not and that is the problem I have with the whole situation
