    I think it will be struck down because of the mandate that everyone buy health insurance. I don't think that's Constitutional.

    With the way the Supreme Court swings I think they will kill it. After all who wants their pesky kids on their insurance plan...And why after years of paying premiums do we expect the insurance companys to be there when we really get sick. And don't forget the famous doughnut hole, everybody wants that back now. Maybe The republicans will just let us get the same insurance plan that we pay for them to have.....

    It will most likely stand because of Martial Law in the Federal Government. But it will fail because the publics inability to comply. People don't have insurance now because it is too expensive, how can they afford it if it costs 30% more.

    If it's struck down we might as well call our selves Northern Mexico because we will be living in a corporate run pseudo democracy that is ran in secret by corporations like they have in Mexico. If it is struck down we should petition the UN to intervene diplomatically to see if we can rewrite some parts of the constitution..

    The main part that will be struck down is the part the forces us all to have healthcare. That is dirrectly against the commerce claus of the constitution.

    I expect certain parts will be upheld.

    Oddsmakers and court-watchers are saying the individual mandate will be struck down. Which, frankly, strikes me as bizarre. The right-wads on the court need to retire.

    I want it struck down so bad I can taste it, but knowing gov't and what happens after campaigning ends, they'll just fiddle with working, strike off some of it and keep the rest.
    We have got to hold our representatives responsible for following through with their promises! Just because you replaced the D with an R does NOT mean everything will be fixed!
    This is the MAJOR problem with the two party system! All the corruption and inefficiencies of a one party system with the illusion of change and progress when you switch letters!

    Earlier this week I spoke with an old friend who is an attorney. He quickly admitted he's not anything near being a Constitutional Attorney but he told me that as he understood it, the PPACA is not sever-able. He explained that meant that if any part of the law is unconstitutional then they whole thing is found unconstitutional. He believes (as do I) that there are two reasons the law is unconstitutional and thus believes it will be struck down. But again he made very clear that he only understood the basics of that type of law and didn't claim to be an expert. I guess we'll find out later this week.

    The PPACA has no severability clause, true. However, there are ample precedents for laws without such a clause being considered severable despite the absence of severability language. I think it's implausible that the entire law would be struck down just because one part is.

    I believe that the mandate will be struck down and without it,, 2099 of the 2100 pages of Obamacare won't be practical..

    The Republicans will THEN go through the entire program.. KEEP what is good and REPEAL the redistribution of wealth parts and maybe add a few of their OWN ideas to fix the problems once and for all..

    It will be transformed from a Left Wing extention of their SOCIAL Engineering agenda to a REAL healthcare program that WORKS..

    Without the mandate, the remaining parts will lead to adverse selection. Healthy people will go uninsured, the sick ones will drive up average costs, making premium unaffordable.



    The solution would then be some form of back-door mandate, by raising taxes to simply give coverage to all.

    Just adding bits on to your healthcare system won't work - it needs to be stripped down and streamlined, the main reasons it's so expensive are the web of regulations insurers have to go through, most of it is accountancy fees, and the fact hospitals have to admit everyone, which drives up prices. I looked up an annual insurance policy for myself in the UK, a pretty good one is about £500, or $750, and a luxury one with everything paid for is £1000, or $1550, both including dental care. American policies I looked at cost at least 5x that. Usually more.

    Isn't there a mandate that everyone has to buy into the Social Security insurance plan and the medicare plan. If you rule the mandate unconstitutional don't you make these unconstitutional also?

    I think the two are different. For Social Security, you're paying in to a social program meant to provide funds to all Americans when they retire. For the health care thing, you're being forced to purchase a product.

    Personally, I think the best way is tax-funded universal health care (much like Social Security in the sense that it's a payroll tax).

    Actually Social Security is an insurance program, it is not supposed to be only for retirement. Something like 30% of all SSI paid out goes to people injured and to hurt to work. I agree that a single payer plan is the best solution but Conservatives just won't go for it. At least this is a step in the right direction. And who knows... once everyone has it, maybe it can morph into a single payer plan.

    That is the only reason I hope it doesn't get overturned. I just fear that it will based on the arguments mentioned above.

    the Republican politicians,acting as Justices on the Supreme Corporations Are People Roberts Republican Court will find it unconstitutional.the Republican Court has made a mockery of the Supreme Court.the loss of confidence by the people in government is all part of the grand scheme by Republicans to minimize government influence and respect.
