In my country in the last little while there have been a few cases of the courts weighing in on what many people say are political issues that are outside their jurisdiction due to the fact that the court is largely liberal while the government is conservative. This has lead to a lot of questions about how much power the courts should have over political events, so I was wondering about what you thought. Should the Supreme Court as the guardians of the constitution have power to control the state or should the real power stay in the hands of the elected government?

They have equal power, or at least they are supposed to have equal power.

The Constitution has the Separation of Powers Clause that limits the power of any entity unfortunately the Constitution is no longer enforced and the Americans are stupid...case in point the recent Obamacare Decision by the Court...the ruling stated the Law could be Constitutional if interpreted as a TAX instead of a PENALTY as the law is written...hence the LAW would need to be amended to be valid...meaning the Congress would need to amend and it would need to pass this change...something that seems to have been lost on the many small minds in this country but used to an advantage by the political powers...

Checks and balances are a great thing to have in theory but at the end of the day someone is going to end up with more power than the other one.

Balance please. It depends. If the general public votes on something. It should be pretty hard the overthrow. I think our system in place now is best. The founding fathers rock.
