White House stands by position that health law mandate isn't a tax

The White House is standing by its position that individual mandate
in President Obama's healthcare law is a penalty despite the Supreme
Court's decision to uphold it as a tax.

White House spokesman Jay
Carney told reporters traveling with Obama on Friday that the mandate
enforces a penalty, not a tax, because people have a choice whether
to obtain health insurance.

"You can call it what you will, but if
affects 1 percent" of the population, Carney said, according to a White
House pool report.

Supreme Court Chief Justice John Roberts said in the court’s majority
opinion Thursday that the healthcare law “imposes a tax citizens may
lawfully choose to pay in lieu of buying health insurance.” In doing so,
he embraced the government's fallback legal argument, which was that
the mandate is constitutional under Congress's taxing powers.

Republicans
have seized on the ruling to argue that Obama misled the public by
arguing during the healthcare debate that the mandate is not a tax. He
and congressional Democrats strongly disputed the charge that the
mandate would raise taxes during the bitter debate before the law was
passed.

Senate Minority Leader Mitch McConnell pointed to the
court's ruling on the mandate to argue that the healthcare law was
passed "on a deception."

The mandate requires most taxpayers to either buy insurance or make a payment to the IRS starting in 2014.

Jonathan
Gruber, a healthcare economist who helped design Obama’s healthcare
overhaul, made the same point as Carney on a conference call with
reporters Friday.

“It’s not a tax on the middle class,” Gruber said. “It’s a choice they’re making.”

    There is no low that Obama and crew won't go. The SC just said it IS a tax, otherwise Obamacare would have been declared unconstitutional. The GOP are going to slam Obama hard on this one and the Tea Party are coming out again and coming out hard.

    • A 3.8% surtax on investment income from capital gains and dividends that applies to single filers earning more than $200,000 and married couples filing jointly earning more than $250,000.

    • A $50,000 excise tax on charitable hospitals that fail to meet new "community health assessment needs," "financial assistance" and other rules set by the Health and Human Services Dept.

    • A $24 billion tax on the paper industry to control a pollutant known as black liquor.

    • A $2.3 billion-a-year tax on drug companies.

    • A 10% excise tax on indoor tanning salons.

    • An $87 billion hike in Medicare payroll taxes for employees, as well as the self-employed.

    • A hike in the threshold for writing off medical expenses to 10% of adjusted gross income from 7.5%.

    • A new cap on flexible spending accounts of $2,500 a year.

    • Elimination of the tax deduction for employer-provided prescription drug coverage for Medicare recipients.

    • An income surtax of 1% of adjusted gross income, rising to 2.5% by 2016, on individuals who refuse to go along with ObamaCare by buying a policy not OK'd by the government.

    • A $2,000 tax charged to employers with 50 or more workers for every full-time worker not offered health coverage.

    • A $60 billion tax on health insurers.

    • A 40% excise tax on so-called Cadillac, or higher cost, health insurance plans.

    All told, there are 21 new or higher taxes imposed by Obama's health care law — and 21 more reasons to repeal it.

    Art Carney kept trying to say it was not a tax at a press conference, finally he said call it whatever you want. The dumb twurp. If democrats keep on saying it is not a tax, as Obama's lawyers claimed in front of the Justices, then the law is illegal. It only survived under the catagory of a tax. I love the democrats now chanting it is not a tax, and it only effects 1 to 2 percent of the population. They turned our health care upside down for all of us, for 26 to 30 million people. It would have been less expensive, and less intrusive, to just send free insurance for those 26 to 30 million, and leave the rest of us alone. Because Obamacare is driving costs up not down, doctors are leaving thier practice and fewer primary doctors are there to treat us, and regulations are dictating what doctors can do when we need treatment. Thanks a lot.

    It is a tax, but more than that, when somebody tells you, don't worry, if you already have healthcare you don't have to pay the tax...one good question to ask yourself is "who is going to pay for all the people who can't afford to buy healthcare?"

    Then, walk over to your mirror and take a good look, because if you have a job and you pay taxes, you are looking at it.

    If you think taxes and costs won't go WAY up because of this, I have some great swamp land in Florida to sell you.

    Didn't Carney say on Friday "call it whatever you want." Ok then, it's another extortion plot against working Americans. Muslims and Amish have already been exempted on religious grounds even though the Catholics couldn't claim religious beliefs when ordered to supply birth control.

    There's more to it than an unpleasant campaign reminder.

    If this was a tax, then it originated in the wrong chamber of Congress. It came out of the Senate, not the House. Boink!

    Listen people, according to the Constitution all legislative Powers shall be vested in a Congress of the United States. That means to make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.



    Part of that is taxation and the PRENTALTIES thereof. All other types of Penalties are under the Court system in the order of criminal actions. Only tax evasion can evoke a Penalty of the type that Obama wants. Judge Roberts knew that from earlier rulings, therefore, the executive power has no authority to make any law that would be called a Penalty.


    Obama may have studied Constitutional law, but he forgot to study the past cases that had come before the Supreme Court. If he did, be didn’t dig deep enough.


    I likely know more about the constitution than Obama does. I have in my Library a copy of the book;

    It's not a tax if you're trying to pass the bill.

    It is a tax if you're arguing before the court.

    It's not a tax if you are defending the bill in public.

    But it is a tax so the SCOTUS can vote it Constitutional.

    It doesn't matter what you call it, someone has to pay the bill(s).

    Democrats want to be like Europe so bad they lie and cheat to accomplish their goals. Somebody needs to make them realize socialism in Europe has failed. We should learn from others' mistakes instead of thinking we can do the impossible.
