Hmmmm. let me see. If it's Mitt Romney's health care program in Massachusetts it's a...um...er......a PENALTY if you do not get insurance. BUT....if it's "Obamacare" as some of you lovingly refer to the President's health care plan as, then it's..um.....er....Oh yeah....a TAX. A tax is authorized by the Income tax amendment. A "penalty" is not supported by the Constitution.
