The Supreme Court has finally come to a decision concerning Arizona's controversial immigration laws, put into effect in 2010. They struck down most aspects of the law, chiefly those dealing with how illegal immigrants are punished. However, the Court upheld the most controversial part of law -- the part that requires officers to check immigration status at lawful stops under reasonable suspicion.
Justice Anthony Kennedy wrote, "The national government has significant power to regulate immigration. Arizona may have understandable frustrations with the problems caused by illegal immigration while that process continues, but the state may not pursue policies that undermined federal law." Do you think the Supreme Court handled the case appropriately? Or did it use its power unfairly?

Lord Emperor of Dune 2012/06/25 21:12:01Appropriate+21It's appropriate that they check, but unjust that they aren't just dumped back out into the desert. Every dollar we spend mollycoddling illegals is a dollar that could be spent on an American in need. Why don't we treat illegals like they are illegal?

The fact remains, they broke the law not going through channels to get here, and continue to break the law being here!
WAKE UP
Oh really?

"The Obama administration said Monday it is suspending existing agreements with Arizona police over enforcement of federal immigration laws, and said it has issued a directive telling federal authorities to decline many of the calls reporting illegal immigrants that the Homeland Security Department may get from Arizona police." Yeah, try NONE of them will be answered.
So, you were saying?
Article 4, Section 4 "The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence." & Amendment 10 "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." - notice that says NOTHING about 'unless federal government disagrees' etc.
States sure as hell CAN uphold and enforce federal law when the federal Government WON'T do its job! And with CONSTITUTIONAL authority, which SUPERSEDES federal law!
You're damn right, abysmal failure and hell-bent on destroying/"fundamentally changing" America.
If ever there were a time to cede, it would be NOW.
can't do anything without determining this first.
Further, “we have to follow our Constitution”… you mean like this?:
Article 4, Section 4 {Republican Government} “The United States shall guarantee to every State in this Union a Republican Form of Government, AND SHALL PROTECT EACH OF THEM AGAINST INVASION; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.” [Emphasis mine]
Or how about this?:
Amendment 10 {Powers of the States and People}: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”
Face it, the Supreme Court has just ruled AGAINST (IN CONTEMPT ...

Face it, the Supreme Court has just ruled AGAINST (IN CONTEMPT OF) Article 4, Section 4 and Amendment 10. And the Federal Government itself as a whole has been ENTIRELY disregarding these (and many other) provisions for a very long time – far, far, far too long of a time. Not to mention 0bama’s latest stunt with backdoor Amnesty, outside of Congress, outside of the LIMITED powers granted to him through this very same Constitution.
It is, collectively, DELIBERATE TREASON!
So wonderful, Arizona police can still require the proof of legal citizenship status - but they still can't do anything about them because the FEDERAL GOVERNMENT WON'T do their jobs and enforce their own laws on the books (especially Amendment 10, because THIS IS AN INVASION)! That's the problem here.
The Governor of Arizona stopped just short of saying she would consider secession if the feds pushed her sate around too much! And she would have been well within her rights to pursue that possibility if she could make the case that the invasion of illegals was harming her state!
I could kill someone and then say, "Oh, officer, I had to shoot him because he wouldn't give me a job so that I could support my family." I would be in violation of a law for the murder. Does anyone really believe that an excuse like that would would hold up in court and allow me to go free? Just think of the lawlessness that would happen if people were allowed to break laws for ANY reason that they feel is justifiable, knowing that they would be set free.

When a law is broken, you have done something 'ILLEGAL' and should be penalized in some fashion. It should not matter that you have to be caught in the act of another violated law before you are detected as an illegal alien, since that is a violation in its self. If doing something 'ILLEGAL' is not to be punished no matter how you are found out or how the discovery of your violation is made, why even have the law in the first place? We should just open our borders and let anyone come in for any reason, including people who can't make a living in their own country, terrorists, drug dealers, and killers from all foreign lands, then deal with the thousands of extra violations that will occur from this heavy immigration as well!!!!
A crime is a crime and a violation of law is a violation of law. No matter how nice you are, or how much you care about your family, if you expect special consideration for one person (yourself or another) who is in violation, then all other violators will 'REQUIRE' that same consideration as well, and this will NEVER work.
Lastly, Justice Anthony Kennedy may have written, "The national government has significant power to regulate immigration...." and this may be true. But obviously Arizona feels that the National Government is not doing the job it needs to do to protect one of 'These United States' which it should protect, since they want the program. There is an old saying, "If you want a job done right, do it yourself". In this case, Arizona must feel that the job is being neglected by "the National Government" so they are taking measures to protect themselves. I don't blame them, I would do the same thing!!!
As far as the 'rest' of Arizona's immigration law being struck down, if it was in line with the National Law, there was really no need to strike it down. I think Arizona is just totally unhappy with Federal immigration action, and feel that they MUST do something.
1. Finish the fence complete with Razor Wire on top.
2. Claymores & Landmines first 100 meters our side of the fence. We already can't go into areas of our own country
3. Militarize the border with Combat Troops, M1A1 tanks, Bradleys, Drones, Apache Attack Helicopters and issue "S. O. S " orders.
4 Repeal the Anchor Rat Law.
5. Start a Bounty Hunter Program and issue a bounty on All Illegals.
6. Severe Fines for any and all buisnesses hiring illegals.
7. Fines for anyone renting to or harboring illegals.
8. Cities/States providing sanctuary will lose Federal Dollars in addition to fines.
9. Deport within 10 days and if they want a lawyer they must pay for them. Remember They are required to carry a Green Card.
10. No Gov. Benefits or services (i.e. school etc) for illegals. Continue to purge/deport them as we find them.
11. Any illegal serving time in an American jail/prison will serve it at hard labor on a Chain-Gang.
12. English only for all Government documents, tests etc.
As for those protesting if they're citizens throw them across the border for treason and advocating the overthrow of America.
This is the USA not Mexico and it's time they learned that
Also in keeping with the general conservative belief, I will assume that you are for reducing the national budget and cutting the federal debt. But you also want to plant claymores and landmines on this land, the land of your country (so violent and cruel, in my opinion). You also want to "militarize" the border". You want to expand the fence. All of these would cost major federal dollars and strain the budget, not exactly in keeping with the whole "cutting-the-debt" idea.
And your advocacy of throwing American citizens "across the border" for resisting the government? Tyrannical, un-democratic, and dictator-like. You want a government that can force its beliefs down the throats of its people? You want a government intolerant of differing opinions? Doesn't sound "free" and "brave" to me.
It just seems to me that you don't understand that "this is the USA".
