Top Ways 9/11 Broke Islamic Law

Posted on 09/11/2010 by Juan

On the ninth anniversary of the September 11 attacks, it is clear
that al-Qaeda was a tiny fringe terrorist movement, not a
globe-straddling threat to Western societies. The organization has been
decisively disrupted and now lacks command and control. Its leader,
Usama Bin Laden, has not been seen in a video since 2004, and is either
dead or horribly disfigured. Its number 2, Ayman al-Zawahiri, is
dangerous only in the way that any other terrorist crank is, firing off
crackpot messages to his dwindling band of followers from time to time.
With the startling rise of anti-Muslim bigotry in the United States,
fanned in large part by Republican Party fear mongering, it is
worthwhile underlining the ways in which September 11 contravened
Islamic values and Islamic law. (For a modernist, liberal
interpretation, see this pdf file, “Jihad and the Islamic Law of War.”

1. It is forbidden to attempt to impose Islam on other people. The
Qur’an says, “There is no compulsion in religion. The right way has
become distinct from error.” (-The Cow, 2:256). Note that this verse
was revealed in Medina and was never abrogated by any other verse of the
Quran. Islam’s holy book forbids coercing people into adopting any
religion. They have to willingly choose it.

2. Islamic law forbids aggressive warfare. The Quran says, “But if
the enemies incline towards peace, do you also incline towards peace.
And trust in God! For He is the one who hears and knows all things.”
(8:61) The Quran chapter “The Cow,” 2:190, says, “Fight in the way of
God against those who fight against you, but begin not hostilities. Lo!
God loveth not aggressors.”

3. In Islamic war, not just any civil engineer can declare or launch a
war. It is the prerogative of the duly constituted leader of the
Muslim community that engages in the war. Nowadays that would be the
president or prime minister of the state.

4. The killing of innocent non-combatants is forbidden. According
to Sunni tradition, ‘Abu Bakr al-Siddiq, the first Caliph, gave these
instructions to his armies: “I instruct you in ten matters: Do not kill
women, children, the old, or the infirm; do not cut down fruit-bearing
trees; do not destroy any town . . . ” (Malik’s Muwatta’, “Kitab al-Jihad.”)

5. Muslim commanders must give the enemy fair warning that war is
imminent. The Prophet Muhammad at one point gave 4 months notice.
Sneak attacks are forbidden.

The World Trade Center had a mosque in it, which Bin Laden destroyed,
and he killed dozens of innocent Muslims in the attack along with
thousands of others. All of this is an abomination in Islamic law.

By the laws of classical Islam and the instructions of the Quran,
then, the September 11 act of terrorism was illegal. It is not an
affirmation of Islam but a departure from its laws of war. That is why,
contrary to popular belief, Muslim authorities have roundly condemned al-Qaeda’s actions in no uncertain terms. See also the Amman statement, to which large numbers of prominent Sunni and Shiite leaders subscribed.

Al-Qaeda can legitimately be seen as not a Muslim group at all.
Usama Bin Laden openly said of the hijackers that ‘those young men had
no fiqh [Islamic law]‘– i.e. they were lawless secret operatives rather
than proper Muslims. Khalid Shaikh Muhammad when in the Philippines
lived like James Bond, going to nightclubs with a pure silver cigarette
lighter. Several of the hijackers frequented strip clubs. Ziad Jarrah
was from a secular family and had a Turkish live-in girlfriend. Many of
these operatives simply were not fundamentalists but rather an odd sort
of Muslim nationalist. Bin Laden did not target the US because of its
way of life, but because he said it imposed a boycott on Iraq in the
1990s that killed hundreds of thousands of Iraqi children, because it
encouraged the Saudi regime to pump more oil than it should so as to
keep the price low, because it stationed troops in the kingdom. Even if
Bin Laden hadn’t been a crackpot with conspiracy theories, these points
are not civilizational or religious issues. They are just politics.

Bin Laden wanted a big fight between the Muslim world and the United
States. He wanted the US mired in Afghanistan. He is a nobody, leading
a tiny group of cells now mostly disrupted. But the US has sunk itself
into a quagmire of wars in a vast over-reaction to a terrorist attack.
Without the US invasion and occupation of Iraq, al-Qaeda might well have
just disappeared even further into insignificance than it did. And now,
instigated by the Republican Party, US society is moving toward an
Islamophobia that could well set it at odds with 1.5 billion Muslims.

Bin Laden is not a proper Muslim, and his actions contravened Islamic
law. He is a Jim Jones-type cultist with a fringe, violent People’s
Temple. Americans need to stop blaming Islam, and to recognize that
most Muslims in the world are their friends, and that American Muslims
are patriots and contributors to our well-being.

Every time Americans tear down Islam, Bin Laden gets a little bit of what he wanted.

I don't really "not care" about this, it's just that I already knew they were going against their own religion. Great article, though.

This just proves your true ignorance of the religion. Your hatred of a people that you do not know and clearly do not understand is blinding you from the truth. Saying that all Islam is like Al Queda is like saying that all Christians are like the Westboro Baptists, to quote a friend.

Don't know exactly what you are replying to,but..........I do not "hate" muslims,I simply do not like or condone the concept, and just don't want one within five miles of me. We have not a damned thing in common except for the air we breathe. We do not share any other ideal, etc. You do what you do and I will do what I do and hopefully we will never meet on this planet. There is enough of islam that espouses evil as to not make me want to deal with a single one of them, just in case............And! They can take sharia and stick it where the sun does not shine! And! They treat women as fourth class, trivial property. There is so much about islam to dislike................If any tiny part of what I have set to print here is correct, then that is more than enough to send you back to wherever you came from.

Once again your ignorance on the subject is quite abundant. And the "hate" in your words is more than apparent. Islam and Christianity have quite a bit in common and the Quran speaks very highly of Christians. Islam also is very favorable to women, the culture of the middle east is what the problem is. If you want to discuss it on an intellectual level then feel free to ask.

"Surely those who believe, and those who are Jews, and the Christians, and the Sabians -- whoever believes in God and the Last Day and does good, they shall have their reward from their Lord. And there will be no fear for them, nor shall they grieve" (2:62, 5:69, and many other verses).

"...and nearest among them in love to the believers will you find those who say, 'We are Christians,' because amongst these are men devoted to learning and men who have renounced the world, and they are not arrogant" (5:82).

"O you who believe! Be helpers of God -- as Jesus the son of Mary said to the Disciples, 'Who will be my helpers in (the work of) God?' Said the disciples, 'We are God's helpers!' Then a portion of the Children of Israel believed, and a portion disbelieved. But We gave power to those who believed, against their enemies, and they became the ones that prevailed" (61:14).

In my ignorance, let me understand, free from the preaching: women wear a sack from head to toe because they want to ? This makes them happy ? They walk behind their men because they want to ? They love being second class citizens ? Mere property ? Muslims did not blow up the world trade towers ? Or do you subscribe to the stupid, idiotic theory that we did it ourselves ? Muslims want no harm to come to Americans ? My "apparent hate" is absolute "fed up"!!! I am not interested in waiting for another episode of violence sponsored by islam. I know some very fine muslims, unfortunately,if the crap hits the fan, there will not be time to differentiate the good ones from the bad. YOU people need to take the koran/kuran/qouran/quran by the horns and regulate your maniacs so that the rest of the world does not have to, because if you leave it up to us,there won't be a hell of alot left. We are getting weary of this constant militance. We will not wait for you to conquer the world. Islam is not the beginning and end of anything, just another gutter movement that will not succeed. I am happy to see some of these creeps going to Russia to do the deed because I believe that Putin and buddies will not be nearly as tolerant as our muslim-in-chief. These garbage cans are blowing someone up around...

It's like everything else, people interpret things to suite themselves and religions are one of the biggest example of this. Most of this I knew and I do have Muslim friends in other countries that are not radical and live quiet albeit religious lives. They do not impose themselves on others and respect them as people and individuals.

I knew most of them from my study of Islamic law a few years ago. But I'd add that an offensive jihad can only be called by the Caliph, not just the leader of a Muslim community. There is no Caliph, and there hasn't been for nearly a hundred years. And offensive jihad, IIRC, is forbidden unless officially called.

p.s. I have been a fan of Juan Cole for a few years, although I haven't read his blog for a while now.

First of all the choice of answer is totally moronic,"I DID KNOW THAT" and "I DO CARE".
The great shame of it is that the politicians that led the US at the time knew it also and helped engineer the possibility's in an effort to gain personal power and wealth. There are many third world society's that are still fighting their way out of the middle ages Some of them with despotic theocratic leaderships, so it is never hard to find reports of horrific abuse. With the aid of a press dedicated to direct rather then inform, it is little wonder the Public of the US (being an insular society in any case) was easily stirred up into a frenzy of fear leading to it being tricked out of giving up some of its most basic freedoms. I see the same sort of thing happening in Australia However because of our population mix it is harder for them to get away with it. Many people of the western world have found themselves fighting many wars on what were just false premises. The result is that the world is now almost entirely under the control of the engineers of war.

Very informative. What's also chilling is our hysterical, unreasoned, fear-based invasion of Iraq and Afghanistan. The GOP lead by Bush/Cheney/Rumsfeld saw 9/11 as an opportunity to create a Republican empire that was in constant war status, against terrorism ( which is not a country, but a tactic that is thousands of years old), that could not be challenged. If you challenged them you were a traitor, because we were at war.
    Nice catch 22 there.

They are now using the same fear tactics to dismantle all of FDR's accomplishments of the New Deal, and attempting to tear down the very same American institutions that once made America great. You have to ask why?

By making Islam the enemy, they hope to capture the Christian voting block, since Christians would see the GOP as the only party protecting civilization. This is simply a great distraction while they dismantle all the social justice programs that were created in response the the excesses of the Robber Barron era, which is where we are headed again, if Republicans are successful.
