The Police Are Not Legally Obligated To Protect You.



*Court decisions,and state laws,have held that police don't have to help
you when you are in danger.

in my first year at the University Of San Diego School Of Law,when i came
upon the case of Hartzler v. City Of San Jose.In that case,i discovered the
secret truth:the government owes no duty to protect individual citizens from
criminal attack.Not only did California courts hold to that rule,the California
Legislature had enacted a statute to make sure the courts didn't change the

*Stevens cites laws and cases from every state,including Washington DC,
Puerto Rico,The Virgin Islands,and Canada.

*Supreme Court ruling in the landmark case Deshaney v.Winnebago County Department Of Social Services was possibly cited in many cases brought
against police and related services.

"The US Supreme Court declared that the Constitution does not impose a
duty on the state and local governments to protect the citizens against
criminal harm."-Stevens

*People in many states have not been able to successfully sue over these
situations,presumably because of the Deshaney ruling.
-When 911 services were shut down for maintenance.
-When a known stalker kills.
-When police pull over,but don't arrest a drunk driver who runs over someone
later that night.
-When authorities know in advance of a plan to commit murder,but do nothing
to stop it.
-When a known violently unstable officer shoots a driver he pulled over for an
inadequate muffler.
-When parole boards free violent psychotics,including child rapists/murderers.
-When felons escape prison and kill.
-When houses burn down because the Fire Department didn't respond properly.
-When children are beaten to death in foster homes.

    BUT, they ARE legally allowed to harass, intimidate, and assault you on a daily basis, especially if you look at them funny

    the premise of the book explains
    why they are so good at showing up
    AFTER shootings,muggings,etc.

    Of course they aren't obligated to protect you. They are only obligated to meet their quota of giving out tickets for going 6 miles/hr. over the speed limit.

    yeah exactly, thats my problem, did you hear about the guy who shot and killed people trying to rob him and got brought up on charges? i'm not sure what happened to him but just to know that he's standing trial is a goddamn problem.

    that's typical of our demented
    system of "justice."
    the only way you seem to be able to get
    away with that type of self defense,is to
    defend your business.and it helps to have
    the proper license and registration for
    the weapon used.like this guy.

    This is one reason for the 2d Amendment. I once had to hold off 6 potential home invaders at my home in rural Maine. It took the state troopers 1 hour to arrive.

    My guess is they rulled that way for the very reasons you listed. No matter how good or bad the police may be you can still become a victim, and it would seam that without this ruling the police and citys,states would get sued by every victim for every crime.
