SAN ANTONIO (Reuters) - A grand jury has declined to bring charges against a Texas father who said he beat to death a man who was attempting to sexually assault his 5-year-old daughter, officials said on Tuesday.

The father, whose name has not been released because he has not been charged with a crime, told police he heard his daughter's screams and ran to a secluded area where he found her under attack by Jesus Flores, 47, who worked for the family.


The father, 23, admitted to Lavaca County Sheriff Micah Harmon and a Texas Ranger investigating the case that he beat Flores to death to protect his child during the incident earlier this month, authorities said.


The case received national attention and focused interest on exactly how far a person could go to prevent a violent crime from happening to a child.


"The Texas Rangers and the Lavaca County Sheriff completed an extensive investigation into the death of Jesus Flores, and the evidence showed that the use of deadly force was justified," District Attorney Heather McMinn said on Tuesday.


"The five year old had injuries consistent with what her father witnessed."


In the dramatic call to 9-1-1 the father made, he frantically tells the dispatcher, "I need an ambulance! This guy was raping my daughter, and I beat him up, and I don't know what to do!"

    I was kind of surprised that it was even a possibility that he could be charged with something, because he was obviously acting in defense of another that could not protect herself. No parent would have behaved differently.

    I'm sure I would've beat on him to render him unconscious so he couldn't leave the scene before the police arrived - I'm not sure how easily I could've stopped myself past that point.

    I am so glad he killed him. He needed killing and it saved the courts and families further pain and suffering. This will take a great told on this family as it is. Only an idiot would believe the father was out or did not use necessary force.

    This wasn't an "after the fact" event, but the father caught the man raping his five year old daughter. Others also saw the man doing this. Frankly the fact that the 911 call shows how upset and how he tried to seek help demonstrates that this was a good man protecting his little girl from a pervert. I hope the girl and father can heal. They are all going to need counseling. No father, especially a young father, expects to go to town, especially a small town, and have this happen. I bet that he was taking his daughter and they were probably going to go get ice cream or just a trip to town is a big event for some country kids.

    Now you understand why Texas is being flooded by people moving in, we make common sense here. In California the guy would be in jail and the police would have been sued not responding.
    Just think if the pervert was black or Hispanic, it would have been another Obama campaign prop.

    Same for the state of IL. . . Earlier this year an 80 year old man shot a 19 year old kid (up around Chicago) who broke into his home, and they arrested them both, because the old man had a felony weapons violation. The charges were later dropped against the old man, but I thought that was ridiculous!

    I am totally shocked. If they permit a man to defend his own child, the next thing you know they will permit him to defend his own wife. They may even go so far as to permit him to defend himself. President Obama has to quit stalling and confiscate all of our weapons immeditely so that we can be protected from our own savage instincts. The Government will protect us from all of the criminals, so go pick up all of the weapons of law abiding citizens starting tomorrow!

    The man's actions were totally justified and he removed a piece or crap from the population. If this had happened in New York or Kalifornia we would probably be reading a much different outcome.

    Look I am a Mom and had I found a man raping my 5 year old I would have lost it and beat him until someone pulled me off of him. I can't even imagine the pain this family is going through but this father deserves a medal. In Texas we take care of our families so he did what he had to do and if the law had charged him then Texans would have raised the money to help him beat this charge. Luckily the DA understood she could never have gotten any jury in this state to convice him.

    Thankfully some people used some sense for a change. This case could have been tied up in court forever. During that time, another innocent could have been raped or worse.

    but as in other cases here he needs to be charged and win in court - sorry guys but you can't say his "use of force" was OK with out a trial when so many others are getting run into the poor house to prove their innocence ....
