A 16-year-old Texas girl won a court victory Monday following a settlement with her parents that will allow her to carry her unborn child to term, rather than have an abortion as her parents had wished.

According to CNN, the minor, identified in Harris County Family Court documents only as R.E.K., sued her parents to stop them from forcing her to terminate her pregnancy, which is currently at 10 weeks. The teen's parents are divorced and she currently lives with her mother.

As part of the settlement filed Monday, the parents agreed as well not to use “physical or psychological coercion” toward the girl in an effort to force her to have an abortion. They also agreed to allow her to marry Evan Madison, the child’s father, who is also 16. Madison was not named in court documents, but has done media interviews in conjunction with the case.

The teen mother was represented by the Texas Center for Defense of Life, whose president called the settlement “a tremendous victory.”

“Our victory today stands for the principle that ‘choice’ goes both ways. Under Roe v. Wade and post-Roe cases, a teenage girl has the absolute legal right to choose life, even over the strong objections, pressure and punishments of her parents,” said center president Greg Terra, who also served as one of the girl’s attorneys.

“We are extremely happy with the judge’s decision today and we are very proud of our teenage client for being strong enough to stand against her parents to save her unborn child’s life.
The settlement also covers a variety of other issues and stipulates how payments for transportation, insurance and other matters will be handled. In addition, both parties agree not to file any lawsuits alleging slander, libel or defamation.

It's good to see that there are teenagers out there that take responsibility for their actions instead of just tossing aside something they created

Why exactly? Should women not have the choice to do with their body as they wish?

They have always had a "Choice" ---To spread their legs without birth control or not. Rape is a different issue in my opinion. 99% of all abortions are due to irresponsible sexual behaior

And? She can still decide on whether she wants to carry the fetus or not? Just because it isn't in the case of rape doesn't mean she HAS to keep it. She wants to get rid of it, her choice, she wants to keep it, good for her.

This teen has the morality to raise her baby when some irresponsible women would terminate the pregnancy to have no responsibilities.

My daughter got pregnant when she was 16, but I support her in what ever decision she made. She wanted to have her baby and still finish school and that is what she did.I was a daycare mother at the time so I took care of the baby while she finished high school. The she got a job and when she felt to could handle herself and baby she found her own apt. But I still was there for her.
As for the father, he was a azz. Didn't even show up at the hospital when his son was born. But he did show up 2 days later and then left again. Big deal.

I'm not actually going to rave and share like some crazy Twitterite, but forcing someone to have an abortion is unspeakably disgusting, and it took a lot of courage for this girl to do what she did.

if she wants it, she can keep it, if not, abort it, it's her body that the baby is in, if only for 9 months

Great. Now there is another child that everybody else has to pay for. How is a 16 year old girl going to pay for her child without forcing the expense upon either her parents or taxpayers? Does anybody know what birth control is? Its been around for a long time and is available in many states to teens without parental permission.

So what constitutes value for birthing? Poor mommies = kill it. Rich mommies=pay every cent available to save it.

This story is SICK!! just what the world needs...another wackjob from Texas. 16 year old girls should not be allowed to have babies and it's shameful that this is being trumpeted as some sort of good thing.
If you can't vote until your 18 then you shouldn't be able to have a baby either, especially if your from a State like Texas.

She must have wanted to get pregnant or was too ignorant to use contraception. The baby should be given up for adoption to parents who want it & can afford to take care of it.

I didn't know anyone could be forced to have an abortion, even a minor. Why would this go to court? Guess I need to do some research. Choice should definitely go both ways.

Its unfortunate the article is not more specific about the details of the case, In another article I read it states exactly what the terms were which are and clearly shows the parents or at least the mother was off her rocker. (note: the parents are divorced)

The mother pulled the girl out of school, forced her to work 2 part time jobs, took the girl's car away from her and threatened to slip an abortion pill into her drinks or food.

The other details of the settlement..

The parents pay for half of pregnancy related medical bills until she weds the father or the baby is born whichever comes first.
The father is more than willing to marry the girl and take on full responsibility
The transportation is the girl's car which her parents took away from her in an effort to force her into the abortion.

They are BOTH 16th & ignorant kids. The father is probably not able to support them. Both should pay the medical bills,NOT their parents.
  • lucky suejkw 2013/02/22 13:18:19

The teen is already covered by her parents insurance, since her parents are divorced its probably required she be provided insurance by court order which is common in divorces. If they have insurance its very likely they will have very few if any medical bills to actually pay that they didnt already have. The teen is only covered until she has the baby, so the parents are not required to pay for the babies medical bills.

As for ignorant, whats ignorant is adults assuming that the teen getting an abortion is best for her. Teens are fully capable of working full time jobs and providing for themselves as well or even better than some adults. The biggest problem she faces is prejudice from ignorant adults who assume that every pregnant teen will fail in life.

She may have planned on getting pregnant for some unknown reason or is too ignorant or too lazy to use contraception. The baby should be given up for adoption to parents who will take care of it.She'll be living on welfare.
  • lucky suejkw 2013/02/22 18:29:39

You dont know anything about the girl, she is just as likely to have gotten pregnant over one single slip up. You also do not know if she will take care of the baby or not and its extremely prejudice to automatically assume she will not.
  • suejkw lucky 2013/02/22 18:35:41
    suejkw
Intelligence should tell ANYONE to use contraception EVERY TIME one has sex.One CAN get pregnant even after ONE time of unprotected sex. Many teens are too lazy or ignorant to know that.
  • lucky suejkw 2013/02/22 18:48:36

Teens are not adults, they are not even capable of rationalizing in the same way, their immaturity stops them from clearly seeing the future consequences of their actions especially if that action is a one time thing. The human brain does not even mature until around the age of 25.

Most teens are not ignorant, they may be immature, irresponsible and often incapable of adult rationalization and also stubborn as heck but they are not ignorant. You may be right about many of them being lazy though.
  • suejkw lucky 2013/02/23 18:30:17

MOST teens KNOW about contraception. It's called laziness to use it & ignorant to think that one time having sex will not cause pregnancy.

You clearly do not understand the meaning of "rationalize" nor "maturity"
