Taxes Are The New Death Panels: Exposing The Latest Lie About Obamacare

After the Supreme Court that the Right Wing thought they owned betrayed them yesterday and actually followed the Constitution in upholding the validity of the Patient Protection and Affordable Care Act, conservative heads across the nation began quickly to explode. The three years they've wasted trying to deny as many Americans access to affordable quality health care as possible have failed, and their chances of denying President Obama the second term he has already more than earned shrank to near invisibility. So what's the well dressed conservative to do? Why lie about it, of course. That's what they do best. So now the new talking point of the day is "massive tax increases on everyone". This one is as bereft of any actual reality as the nonexistent "death panels" or the fantasy "government takeover of health care", but a complete lack of credibility never stopped them before, and probably won't now.

Republicans are responding to the Supreme Court’s ruling upholding the individual mandate by constructing a new “death panels”-like lie. The law, they argue, imposes a burdensome tax on millions of middle class families who will have to pay a penalty for not purchasing health care coverage by 2014. The line originates in the majority’s decision, which found that Congress has the authority to require individuals to buy coverage under its taxing power, but it doesn’t mean what the Republicans are suggesting.

The truth is that the penalty for not buying insurance — $695 or 2.5 percent of household income — is well in line with other policies that are designed to encourage and promote a particular kind of economic behavior. On Friday morning, NBC’s Chuck Todd compared the penalty to a speeding ticket and asked House Majority Leader Eric Cantor (R-VA) to distinguish between the two taxes. Cantor could not:

TODD: On the tax front quickly, is a speeding ticket a tax? By that same definition? You can avoid paying this tax if you get insurance. [...]

CANTOR: First of all, let me — I can’t respond to whether the speeding ticket would be considered a tax or not under the states’ authority any states’ authority. What I can tell you is the court came down on this issue decided that it was a tax to coerce some type of behavior.

In the case of health care, the law is offering an incentive for younger and healthier Americans to purchase health insurance coverage before they fall ill and pass on the costs of their treatments on to the government and other premium payers. Widespread take-up of coverage could cut government expenditures on uncompensated care in half. As Mitt Romney explained in 2006, “I don’t think the free market ever envisioned an idea that people would be able to do something and make other people pay for it.” And after successful implementation of reform in Massachusetts, few are.

On the federal level, the Congressional Budget Office is projecting that 30 million Americans will enroll in insurance as a result of the law, millions more will receive a tax cut to help them afford coverage, and of the remaining uninsured, “the majority of them will not be subject to the penalty“:

21 million nonelderly residents will be uninsured in 2016, but the majority of them will not be subject to the penalty. Unauthorized immigrants, for example, are exempted from the mandate to obtain health insurance. Others will be subject to the mandate but exempted from the penalty—for example, because they will have income low enough that they are not required to file an income tax return, because they are members of Indian tribes, or because the premium they would have to pay would exceed a specified share of their income (initially 8 percent in 2014 and indexed over time). CBO and JCT estimate that between 13 million and 14 million of the uninsured in 2016 will qualify for one or more of those exemptions. Of the remaining 7 million to 8 million uninsured, some individuals will be granted exemptions from the penalty because of hardship, and others will be exempted from the mandate on the basis of their religious beliefs. After accounting for all of those factors, CBO and JCT estimate that about 4 million people will pay a penalty because they will be uninsured in 2016 (a figure that includes uninsured dependents who have the penalty paid on their behalf).

Real world experience suggests that Americans are more likely to purchase insurance than pay the penalty for going without coverage. For instance, in Massachusetts, the only state with an insurance mandate, less than 1 percent of the state’s residents paid the penalty in 2009. Surveys of the uninsured have also found that an overwhelming majority — 76 percent of the uninsured — would rather comply with the individual mandate in the Affordable Care Act and purchase insurance than pay the far less onerous penalty for forgoing it. Experts believe that “health insurance mandates differ from some other requirements, such as the requirement to pay taxes” because “enrollees individually receive a tangible good–health insurance—that they value.”

    "Section 3403 of the Patient Protection and Affordable Care Act (PPACA) established the Independent Payment Advisory Board (IPAB), responsible to reduce the per capita rate of growth in Medicare spending. IPAB is a panel of 15 independent, unelected bureaucrats with unilateral authority, whose decisions are freed from judicial and administrative review. Congress cannot delegate away it's legislative responsibilities under the Constitution. The decisions of IPAB will most certainly cut payments to physicians under Medicare, limit patient access and quality to medical care."

    Do you think it is only just the new tax that is upsetting people of this country, forget the party affiliation?? It is being told by Big Brother Government that you HAVE TO BUY something you may nor want or think you need at a certain age, It is also the fact Obama lied about not putting a tax on the middle income, well now it is on all the people, It is having to pay for more and more illegals. Itis stealing from ther programs to pay for this piece of crap, and lets not forget how much debt it is putting on the future generation, It is about the mandates of what is in the bill to the medical health world, all businesses small and large. Now to really important issues what it will do to your personal health needs, with people making decision for you, not caring about your wants or needs, The elderly will die sooner as well as the very sick no matter their age,

    Roberts was not only a traitor to all the American people, but he and the other judges that voted for this horrible plan put a death sentence on many Americans right off the bat and they didn't care about your party affiliation.

    Thanks for the informative post. After the SC ruling yesterday, it was somewhat difficult to find logical fact filled comments on healthcare amidst all the ranting and raving from the cons.
    Have to wonder what the emergency rooms in hospitals looked like yesterday flooded with the anxiety attacks and heads exploding...lol...

    I supported Hillary Clinton because this country desperately needs health
    care reform. I suggest it is you who doesn't know much about Health care
    reform. The Affordable Care Act will not decrease cost, which was the
    most urgent need in health care, nor will it increase quality or access........in
    fact it will decrease both quality and access.

    It is not the responsibility of the Government to provide "social safety nets". There is such a thing as personal responsibility.     Why do you think Corporate Insurance companies are not crying foul over ObamaInsurance?

    Maybe because, the people are being fecked with one of the largest taxes in history and they are not.

    Maybe because, they are sitting back pretty saying thank you you socialist igit if they don't buy insurance you are going to force them feck the Constitution Barack you just gave us 30million new possible customers

    Or is it maybe because in those thousands of pages that no one cared to read except for some on the right of aisle there is nothing telling insurance companies how much they can or can not charge.

    I think, these companies are as much igits as the left is, because in the long run if it stands there will be only one insurance payer in America, the Socialist Insurance Co of America.

    So in the future if you are not happy with their services you might as well go to another country to look for their competition or grab your heels, accept it comes, without Vaseline, because there will be no competition for your business in America you can run to for better services.

    Wouldn't you like it if your cell phone provider was the same way?
