Supreme Court INVALIDATES health care law? Say what?

Nick Purpura, the author of the linked article, filed the most comprehensive anti-Obamacare lawsuit that anyone ever filed, in any court (Purpura v Sibelius, 11-7275). In this piece, he of course excoriates John Roberts, as did the conservative dissenters (Kennedy, Scalia, Alito, and Thomas JJ, jointly!), for rewriting the law to save it. (And in the process giving the Congress an unlimited taxing power that sets at naught every protection against the arbitrary deprivation of property without due process of law. The only thing the government cannot arbitrarily do to you is execute you or confine you.)

Have a look at the Purpura case. It lists nineteen separate violations of the Constitution and monumental inconsistencies with existing law.

The big point that Purpura makes in this piece is: John Roberts said that this is a tax. OK. But this tax originated in the Senate. Article I, Section 7, Clause 1 of the Constitution reads:

All bills for raising revenue shall originate in the House of Representatives.

So what really happened here? Well: after Scott Brown replaced Ted Kennedy, the House simply took an unrelated bill, stripped it of its contents and short title, put in the Senate language (even the "In the Senate of the United States" heading), and then "deemed it passed" in the vote on the House Rule. Classic bait-and-switch.

But Judge Roger Vinson of the US District Court for the Northern District of Florida has already said that the bill originated in the Senate. What about that?

That finding stands and is not controverted. So Mr. Purpura says, and I agree with him, that his case deserves a reargument. And more broadly speaking, Mr. Chief Justice Roberts just invalidated ObamaCare when he sought to save it. Otherwise he just declared the Constitution unconstitutional.

    As much as I've hated seeing 0bama, the Senate, and the House beat the Constitution like a whipped dog, I hate it even more seeing the Supreme Court treating it this way. Despite 0bama's appointments to the SC and Judge Ginsburg, I have always previously had great respect for the SC.

    Now I have very little respect for any of them.

    Uh huh . . . But according to all wise pundits on FOX "NEWS," the ruling is supposed to be the best thing that could ever happen to Republicans, because it will "galvanize America" into voting out Obama and most Democrats.

    And of course when that happens, all the Repugs have to do is rescind the act.

    But if it's the best thing that could happen to Republicans, then why are they so p*ssed?

    It would help if right wingers first pulled their heads out of butts. The law was ruled Constitutional. If you want to nitpick and hang your hat on one or two sentences rejected on a document that runs over 2,000 pages go ahead... and look stupid.

    How about taking an interest in your country, it's constitution, and it's Supreme Court? There isn't a requirement to be a scholar, and come to think of it, scholars told us the law wasn't a tax and that the commerce clause applied. You also might consider this is a FORUM, a place where issues are discussed. If you don't have the ability to discuss an issue, maybe you should just read and not type ;-)

    Problem with that is this, if the 9 people sitting as SCOTUS and are all Constitutional lawyers/scholars, how is there a split vote? Shouldn't it be unanimous?

    Not really. It is rare to get any unanimous supreme court ruling, which is actually a good thing. You don't want the supremes to just be a rubber stamp. The reality is many of the issues that reach the Supreme Court could be decided either way based on the language within the law they're considering.

    That's stupid, either it's constitutional or it is not. Do you really believe that the founding fathers wanted us to vote on all of their work depending on which side of the fence we are on? If this were the case then we should just have the POTUS make all of the decisions because that's what's happened here anyhow.

    The government is just like baseball, for years it was corrupt and nobody did anything about it because the players were doing things that had never been done before but they were all doing it illegally and behind closed doors. But finally the people wanted no more of it and now they are all under the microscope of rules and are punished if caught. This is what's happening to our government now, the people are tired of what's been going on and are about to go back to the way our founding fathers wanted it to be. No loopholes, just plain English.

    and the justice roberts ( if cleaver enough ,,he can confuse the brightest with conjecture ) and will in essence invalidate the whole thing & pass it as a tax ..but not a tax ..and no penalties ..but is enforceable ,,,but how ?

    Any person of the progressive/socialist/communist beliefs in America is at war with this country and its people.
    The kind of a person that has those type beliefs is at war with the very concept of liberty, personal rights, democracy and divine destiny.
    The differences between the two sides is akin to the differences that led to the civil war. Both sides were Americans pitted against Americans. To be sure, I am NOT saying this war will be waged the same or that slavery is the centerpiece.
    But there is a war going on for the direction of this country and the left is, in my mind and of those of plenty of others, the side wanting to keep slavery alive.

    You do realize that in the last decade we have just experienced the greatest depression since the 30's, right?

    You do realize that there are people, PARENTS out there that are willing to check their pride (and political ideology) at the door in order to be able to feed their children, right?

    And most importantly, you do realize that an increase in food stamps usage pales in comparison (not even remotely in the same universe) to the 400 years that people kept human beings as chattel and sold them as property in this country, right!

    Try living in North Korea for a year. There's all kinds of things the government does I don't like. I'm sure everyone agrees with that. That doesn't mean I get to pick and choose which laws I'll follow and which to disregard. Damn, everytime a major decision goes against the looney right you fools have a hissy fit, claim the country is going in the crapper and other nutty stuff. Justice Roberts did his job. Good for him. Now if we could only get Congress to do its job instead of the endless bickering and back stabbing.
