Should Victims Receive Compensation for 'Surprise STDs'?

A 49-year-old Oregon woman found a little bit of respite this week when the court awarded her a whopping $900,000 as compensation for contracting herpes from a 69-year-old man on their fourth date. According to the L.A. Times, the jury decided the woman was only "25% responsible" for contracting the STD because the man failed to tell her that he had it before they had sex.

Randall Vogt, attorney for the plaintiff, explained, "He was 69, my client was a very attractive 49. My argument to the jury was he just wanted to sink his hooks into her." There were also suggestions of battery ("aggressive consummation"), which made it impossible for her to put a condom on him, and she was able to give evidence that she had not had the STD prior to the encounter. They met on eHarmony. Do you think it's fair to grant the unknowning recipient of an STD legal compensation?

    Not in this case.
    1. She should have refused to have sex, if he wouldn't wear a condom... not his fault.
    2. She should have asked for some sort of proof that he was clean... my most recent ex and I went and got tested together, before we slept together.

If he refused to wear a condom and INSISTED he was clean, then yeah, I could see her receiving compensation.

It's a local AIDS prevention and support clinic, non-profit organisation that offers free testing, free condoms, and even free needles (we have a problem with prostitution and IV drug above in our city centre).

She should also be sure he isn't sleeping with others, because it can be transmitted that way by a wanderer.

    What's brilliant?

The idea that guys who sleep around on a woman are at a greater risk of being exposed to a disease and passing it on to her? That's just statistics.

Screw statistics. Yea, sure was me mocking that he would tell her he was sleeping around.

    Brilliant!!!

Simple observation would show that. Keep your eyes open and really look at the other person. If a woman's trying to have sex with me within four dates, she's a tramp, and can hit the road. If she's had more than five sex partners, she can hit the road.

Hence the reason she's an idiot. 49 year old idiot at that.

    Brilliant!!

She's pretty much a tramp, in my opinion, and it's her own fault she caught something.

So a woman is a tramp because she has sex after four dates. What does that make men who want to have sex on the first date. You should join Raiders and Popoloski's He man Women haters club. You will fit right in with these misogynists.

    Tramps.

I wouldn't do that. And it's just as wrong to be promiscuous when you're a man as it is for a woman.

I don't hate women, that's ridiculous. I just want women that have respect for themselves.

Although I would tend to say "yes" if it was done maliciously, in the case above, "no". Give me a break, he's nearly 70 and 20 years older than her. She gave it up on the 4th date. This was clearly a case of a women going after a rich old guy and she got more than she bargained for. Luckily I don't know anything about herpes, but I think you have to have an outbreak for it to be transmittable. So the old guy probably didn't know he was in that state and a they didn't use a condom because she probably can't have kids anymore. She rolled the dice and lost.

Just so you know herpes can be transmitted even if you are not having an outbreak. I know this because I am a nurse not because I have herpes :-)

Because she trusted someone she shouldn't have, doesn't make him any less responsible for knowingly transmitting his virus to her. It's a classic case of blaming the victim.

I can agree with that, but all these litigious reactions seeking monetary compensation for exhibiting bad judgement are ridiculous. In my opinion this man should be criminally prosecuted to the nth degree. Lawyers and suing people for money has gotten out of hand in this country and is one of the things essentially ruining it. It's caused a lot of things to be ridiculously overly regulated and created a lot rifts and breaks in honesty and ethics.

It is all the nursing homes now. Man it is like all these old people are 16 again try to get in everyone's pants.

I had a family member at one. They passed away and had a funereal service there. Some old lady came up to me and said how attractive she is and that as a person gets older they don't lose their ummm mojo. She said she may have grey hair on her head but it ain't everywhere and she winked at me. Ohhh geeeesh.

Then some old dude with a oxygen tube in his nose wheezed over at me and said "See that girl back there (she musta been 110) I think she wants to bang me." I just smiled and thought man, I gotta get outta here these old people are whacked.

Then I go up to get a cookie. The attractive young woman from the home whacks my hand with metal tongs. Don't every touch the cookie tray because you may spread germs.

Old people don't act like normal human beings when they have to take a blue pill to get it up. That's not at all normal. If you need to take a pill, you should probably just dispense with it altogether.

Normal people want to have sex. How they get it up is no concern of anyone, and old people aren't the only ones who take a pill.

Oh, right, what nature intended for them to do--nothing.

If you really want to do the most natural thing, get off the computer, leave the city, and go live in a forest somewhere. As long as you live in a house, and use the internet and other various forms of technology, you have no right to point out what is and isn't natural, nor do you have the right to berate someone for doing something you deem not natural.

They aren't acting like normal people. All they want to do is bang their neighbor. They are more horny than I was at 16 - 25.

Nursing homes are more akin to chicken ranches than nursing homes.

Wanting to have sex is normal. Wanting to have a lot of it is no less normal.
