Should Victims Receive Compensation for 'Surprise STDs'?

A 49-year-old Oregon woman found a little bit of respite this week when the court awarded her a whopping $900,000 as compensation for contracting herpes from a 69-year-old man on their fourth date. According to the L.A. Times, the jury decided the woman was only "25% responsible" for contracting the STD because the man failed to tell her that he had it before they had sex.

Randall Vogt, attorney for the plaintiff, explained, "He was 69, my client was a very attractive 49. My argument to the jury was he just wanted to sink his hooks into her." There were also suggestions of battery ("aggressive consummation"), which made it impossible for her to put a condom on him, and she was able to give evidence that she had not had the STD prior to the encounter. They met on eHarmony. Do you think it's fair to grant the unknowning recipient of an STD legal compensation?

    If you have an STD, and you know it. Then you should not engage in sex until you are sure the STD is gone. If it an STD like Herpes then you should inform your partner before having sex that you have the STD. If you don't and the person gets the STD, then you are liable for causing that person, personal and emotional injury.

    The only winners would be the trial lawyers. In the case of rape, one should be able to file a civil suit. I don't know about "25% responsible", I always consider myself 100% responsible for my health and well being.

    Living has its risks, so does having sex. Litigating copulation is going too far.

    The attempt to artificially create a fool-proof padded world where the government embeds its head in every nook and cranny of our lives is not desirable.

    If people want to live in sterile laboratory environments, they can buy themselves a plastic bubble to live in.

    This has nothing to do with government intrusion into our lives. Fact of the matter is, he knowingly transmitted a disease without her consent. That makes it assault. The fact that she put herself in a situation, vulnerable to assault doesn't make him innocent. He needs to be held accountable for his crime.

    You like to use the word Government a lot. You make it sound like the Justice Department got involved and awarded this woman $900K. She did exercise her rights under the laws of the State of Oregon to take a person to court and sue for damages. I guessing you don't much like freedom, fascist.

    Anyone can take anyone to court, that's just the way our system works. But to take someone to court for their own idiotic behavior is someone just trying to take advantage of the system and not taking accountability for ones own actions. BTW, the court can award any amount they want to, now the real challenge is to see the man pay. What a waste of taxpayers money for the ignorance of a woman that was horny.

    Do you think if she knew this guy had herpes she would have had sex with him? I think not. He did not inform her he had an incurable STD before engaging in sex. He with held that information from her, so he would not be denied sex. If he had AIDS he would probably be indited for attempted murder, since AIDS is a fatal STD. I am amazed how this is lost on you. You're about as bright as Raiders.

    She DID NOT try to protect herself. She had sex with a man she didn't know. It's that simple and she 's an idiot 100%.

    Let's use your drunk driver scenario BUT it needs to be changed a bit because your scenario isn't quite correct. Yep, there's a drunk driver that gets in a wreck and kills someone but that person is riding in the car with the drunk. She chose to ride with the drunk without knowing he was actually drunk because he doesn't appear drunk. She doesn't know the man well but she chose to ride with a stranger. Now had the drunk killed someone in another car that would be equal to rape.

    Try this analogy: I hand you a gun. I also do not tell you wether or not that gun is loaded. Would you just put that gun to your head and pull the trigger? Or would you check to make sure? And even if you weren't sure how to check that gun, would you pull the trigger or leave the gun alone?

    I never said she deserves what she got, that's not how I think or operate. But she did what she did without thinking about the potential problems that could come out of it and now she's wanting to blame someone else for her stupidity.

    BTW, I love women and girls. I have a beautiful wife and an unbelievably great young daughter that I wouldn't trade for the World. What you see is just a poor excuse because you know you are WRONG.

    If it can be proven that the "giver" knew that they were infected and withheld that knowledge form the "receiver." Even moreso when it is permanent and uncurable.

    And the issue with the condom isn't really relevant; condoms are not effective against herpes.
