Should Victims Receive Compensation for 'Surprise STDs'?

A 49-year-old Oregon woman found a little bit of respite this week when the court awarded her a whopping $900,000 as compensation for contracting herpes from a 69-year-old man on their fourth date. According to the L.A. Times, the jury decided the woman was only "25% responsible" for contracting the STD because the man failed to tell her that he had it before they had sex.

Randall Vogt, attorney for the plaintiff, explained, "He was 69, my client was a very attractive 49. My argument to the jury was he just wanted to sink his hooks into her." There were also suggestions of battery ("aggressive consummation"), which made it impossible for her to put a condom on him, and she was able to give evidence that she had not had the STD prior to the encounter. They met on eHarmony. Do you think it's fair to grant the unknowning recipient of an STD legal compensation?

    No. Simply too much room for abuse. The letter of the law would break the spirit of the law, so to speak. Practice safe sex or/with single partners, at all times and this problem won't occur.

    As others have mentioned, rape (victim) would be the only time a person should be rewarded if the perp can be determined.

    If the person who gave them the STD knew they had it and didn't disclose, then it seems fair that the victim would be only 25% responsible.

    In cases of rape, victim is 0% responsible.

    If a rape victim gives their assailant an STD, then the victim should be held 0% responsible and get hero status.

    If someone has a STD and knows they are spreading it around then yes they should have to pay for at least the Drs. and Clinic bills and some compensation for the distress it causes especially Herpes or Aids.

    If you get a disease from someone and you were unaware, you should get compensation. It's pretty simple.

    but its not being paid -.- its being compensated for contracting an std from somebody that didnt tell you they had it. although i must admit 900000 big ones is a little o.t.t. but if people just used condoms more this problem will be eliminated. simple.

    Not unless there were egregious lies or such. For example, if a man claims he got tested for something, and the test was negative, and it turns out he actually knew he was infected, but lied about it. In that case it's fraud and misrepresentation.

    To everyone answering yes, have you ever had a cold sore? Then you have herpes and should be informing each person before ypu kiss them or perform oral sex on them bc oral herpes can spread to the genitals. Comparing herpes to aids is like comparing chicken pox to cancer. Herpes in 80% of people shows no symptoms , did the defendant know he had it?? How could this gold digging whore prove she didn't have it before him? If she had a recent test she could have slept with 15 guys in between that test and the defendant. This decision is absurd. No one but a rape victim (or a spouse who was cheated on) should ever receive compensation for an std.

    Hell yes, I agree that they should be able to sue male or female. You know you have it you give it to some one then yes you are responsible. but why did they put the site they met on what does that have to do with it???

    and it is noted people can catch a std with a condom on, so even if one was on, lesions on the skin on the sac lower or higher, inner thigh area. Blisters there burst liquid etc. Can still pass to another person. So people really need to start thinking.

    It is called "personal responsibility" folks. Regardless if the guy was forthcoming or not, she has the responsibility to keep herself safe...either with condom use or abstinence.

    She can't gave kids??? Herpes does not affect child birth in any way unless she has an outbreak during delivery in which a c section us done. Every other std DOES affect pregnancy. Did her partner know he had it?? Only 10-20% of ppl with herpes know. Stop blaming him. SHE had sex without knowing what he had. Be glad it wasn't aids.

    Ya he knew otherwise I wouldn't be so upset about it.. And as far as kids her doctor said that herpes complicates pregnancy and it's a hit or miss if the child has it too

    Herpes does not complicate pregnancy. The child is 100% protected in utero until birth. If and only if the mother had an outbreak will the child be delivered c section , and the child will not have herpes unless she has an outbreak during delivery and doesn't have a c section. 99% of babies born to hsv2 positive women are not infected. Look it up

    Skank? I'm talking about my friend. She's clearly a skank since she's had sex with 4 ppl and won't be having sex with another till somehow she finds someone to accept her for who she is. It's not only about pregnancy it's about finding a mate too. The person in the case above doesn't even have to worry about kids. She's in her 40's not in her teens

    my sister's friend got genital herpes from a guy and she is 19. he knew he had it too but since he doesn't believe in condoms he didn't wear one...such a sad, disgusting thing

    My bf and I both think she should've gotten more than that, what a douche giving surprise diseases, seriously I would've gotten a sweeter vengeance, as in more money, all these people that said she shouldn't get payed probably have herpes!
