As long as that teacher/student relationship exists, then the two can not be in bed together. Once he/she graduates though, all's fair.
Their employers can certainly implement such a statute, if they so choose. However, that would be no more than a violation of a civil contract, and thus it should result in whatever disciplinary act the contract entails, not criminal prosecution.

Why Student-Teacher Relationships Are Never OK
Allow me to state this explicitly: teachers who are unable to set boundaries with students have no place in the classroom. I don't care if he or she never touched, or even intended to touch a student. I don't care if she was asking for it. I don't care if he initiated it. The teacher has the responsibility as a figure of authority to end it before it begins, and to never propagate it.
Once the "of age" student has graduated then the teacher is released from all ethical obligations and can do what they want.
Besides, just to avoid legal and job security situations, it is better for the teacher to abstain. Why lose a career and do jail time for a good time. All good things come to those that wait.
I recently learned that children as young as 14 can be on SH. However, I was still stunned just to read just a few of these posts. :--)
