You did not provide any good answers. I don't believe that anybody deserves to get the death penalty as I do not believe that governments have the right to kill people except in self defense.
In that case I sure hope you're not voting for Obama this year. He ordered the assassinations of at least five American citizens (one was only 16 years old). All were killed without any charges, trials, juries, right to face their accusers, Miranda rights or any other Constitutional rights that are guaranteed to all American citizens. How do you feel about THAT?
I do believe that everybody deserves a trial unless we are being attacked by them. The American citizens we killed were not in the process of attacking us so if we were going to bring them to justice we had a responsibility to capture them and hold some kind of trial (civilian or military).

Even Ron Paul said he should be. The 16 year old boy was a photographer documenting the massive drone strikes ordered by Obama which have killed hundreds, perhaps thousands of innocent civilians. That was his only crime. When he was murdered, 17 of his friend died with him while they ate dinner.
I'm also curious about this "self defense" thing. Are you saying you would have wanted him killed while he was attacking people in the movie theater but not now that he's killed 12 people and ruined dozens of other lives?
If there was an armed person in that theater I would be fine with the killing of James Holmes as it is in self defense of self and other and there was no alternative way of stopping him at that point in time.
I don't know about prosecuted for murder, but impeached yes. If we are at war I would not want our leaders making bad choices preventing our best defense in order to prevent their own prosecution. Obama and others believe that if we kill enough of them we will be safe from terrorists.

All of this is quite difficult as you cannot just say you can kill any US citizen but you also cannot say every US citizen must receive a trial. There are situations that should prevent both of those from occurring.
I know he killed and injured people. However, the government should only kill in self defense. If the police got there and he was still shooting, then of course they should kill him.

I am only for killing people if it is self defense. This is not self defense as he can't do harm.
