Should it be considered a crime when a home owner kills an intruder?

    No. The Castle Doctrine should be enacted in all 50 states. The criminal element would think twice about breaking into a home if they "just don't know". I have plenty to bring to the buffet - I could serve up a little .9mm, .45, .50, .40 and a little 12ga for dessert. Unfortunately in MN, I have to be in "proximate danger" before executing lethal force. A lot can happen to me and my family while I wait for the danger to become "proximate".

    No, it should not. However, unless it's absolutely unavoidable, I doubt any well balanced person would aim to kill. A good crowbar to the kneecaps is much more civil.

    if the victim does it randmly then they should be charged and if the victim shows signs of injury from the suspect then they shouldnt be charged

    I think it depends. If the intruder has a weapon then it's fine, but if the intruder is unarmed, then the owner should try to incapacitate him rather than kill him.

    Thanks. I'm aware that this is idealistic thinking, the kind that rarely is possible to do in real life, but I'd prefer to try for life than go for the kill.

    No, he means good luck with that lawsuit. In today's day and age the criminal has more rights then you do. They can and do sue homeowners, for things such as cutting their hand while breaking into a house, and jackass judges rule in their favor. I know a guy whose friend is serving 20-life for shooting and killing an intruder as he was entering through a window. He shot the guy and the guy fell back out of the window. The homeowner was charged with murder, b/c the intruder magically ceases to be an intruder once he's outside the house. That's why I like Texas, you cross my property line, I can kill you, end of story, no questions asked. In the rest of socialist land, they better be in your house, and you better kill em. If not, and you shoot to wound, they'll sue your ass, more trouble then its worth.

    Defending my family and killing someone are not equal. If there is away to both defend them and not take a life, I'd rather take that route than killing someone who is unarmed. It isn't stupidity to value human life.

    How is it stupid when you can protect your loved ones and valuables without killing someone? Did you noticed that I originally made the condition if the intruder was unarmed? Meaning that if he did have a weapon and was therefor a threat that I wouldn't hesitate to do anything necessary to protect my family. However, if the intruder is unarmed and therefor less threatening, I would try to incapacitate him without killing him, allowing the police to handle the rest because it is their job to do so.

    I'm sure you do a fine job of protecting your family from you throne of bodies, but let me protect mine my own way. I gave my ideal situation, knowing that it most likely wouldn't happen that way in real life. The fact that you can't accept that and the fact that you keep pestering me about this shows your own insecurity to protect your family. Why do you need to tear my idea down just to justify your feelings?

    Yes in either case, you're in my house, you're trespassing, your fault. Well officer, he kicked the front door down and I killed him, didn't know if he had a weapon or not. Or how about the case, many years ago. A dad leaves for work, kids are all alone until mom returns home, intruders break in. Armed with a 12in screwdriver and a box cutter. Eldest son runs to dad's room, grabs the handgun and shoots the intruder through the door, as the younger kids are locked in a bathroom calling 911. Perp didn't have a gun, but he could have killed them just as easily.

    you don't have enough time to figure that out. If there is an intruder, you shoot and you aim center of mass - if the intruder dies, he dies.
