Should Gay Cop File a Discrimination Complaint Against His Department?

TMZ reports that a West Hollywood police officer will be filing a discrimination complaint against his department after they denied his written request to march in a gay pride parade in uniform.

The case has even attracted the attention of Gloria Allred.

Gloria Allred is repping the California officer, who made a written request to march in uniform with other gay law enforcement officers and citizens. Allred says the Department responded in writing that the march would be a "discredit" to the cop shop.

The officer will appear alongside Allred in a press conference set to be held around 11 a.m. on Tuesday to reveal their intentions, TMZ reports.

    You can't go to a church and preach wearing a police or military uniform. You shouldn't be allowed to march in a gay pride parade in uniform either. If he wanted to march, he could have done so in his civvies.

    Tyranny of ideology rides again. If this cop were representing the police department, then a uniform would be appropriate. He is marching for his own beliefs and persuation and not the department and thus has no business wearing the police uniform. One truism that many gay rights' people seem oblivious of concerns their own expectations of special treatment and nonconformity to all rules except their own. Goria Allred knows how to make a buck and she will make plenty off the taxpayers of West Hollywood.

    The bottom line, this cop wants to wear his uniform to legitimize his personal preferences. It's a lie and a sham that he wants to present to the people of his community. I strongly suspect this guy shouldn't even be a cop, especially if he lets his personal opinions win out over the laws he's sworn to enforce.

    Any person that workd for public civil service has the right to appeal anythiing. When a peace officer or fireman is fired it usually is because they were guilty.

    as far as i know this is an across the board restriction. there are very few things that police can wear their uniform to support.

    Homosexuals should probably check first with the Rules & Regs prior to joining an organization that could possibly politically overrule any of their sodomy-type bedroom practices; whether they will be receiving salary/wages, or not . . . I'm sure that most Police Officers will tell you that they would NOT want to fill a duty-assignment of an All Homosexual Police Force, either; if they, themselves, elected to totally avoid those same kind of bedroom practices, consistent with that of Homosexualism . . . per se. As far as Allred goes; I am pretty sure that she will make several huge deposits to her bank account; there is no doubt about that. That woman NEVER enters a Courtroom without the Taxpayers of the United States, forking over large sums of money.

    The issue is not homosexuality. If one member wore a uniform to a rally of this type it would imply to many that the police support it. Now in this case that's not a bad thing, however if they allow this then they can not say no to the cop who wants to wear his uniform to the anti gay parade, or the KKK rally, and its the same with the military. The idea is to be apart from political or other groups, so that they can be seen as a neutral force.

    NIce point. I agree this IS A POLICE ISSUE and should NOT be seen as any outside organizational interference as you pointed out like anti gay parades, KKK rallies, etc. I agree the U. S. Military and the Police Departments usually administer the same type of Oaths. Many of these people think about breaking the Law, one way or the other, the moment that they put their hand down, following the Oath. Someone needs to tell Allred that.

    Nothing against homosexuals, this is simply a legal question, an employer can restrict what you do and say as a representative of them. Wearing a uniform off duty to any event without employer authorization would be a no-no.

    I say this because you should not do rallies or religious or any other thing of that sort in a uniform. Military, police, etc. Go in civilian cloths. That's allowed. To do otherwise may be seen as the entire organization supporting whatever you decide to support. And while this may not be so bad, what about the cop who wants to march in the KKK rally or the military member who wants to get on stage at a anti gay rights protest or someone in uniform at a political rally... Although if they said it would be a discredit to the cops, well that was piss poor wording at its best

    He works for the department and they have their own standards of how they wish their insignia to be appear. Following those rules seems like a basic premise to remain in their employment, just like any other job.

    This is difficult. If the police department had just told him that he wasn't allowed to join the parade full stop then I would definitely be saying yes. But in this case it doesn't sound like discrimination, it just sounds like the police department wouldn't let him wear his police uniform to the parade. This is understandable. However, the department made a mistake by saying that to allow him to join the parade in uniform would "discredit" the department. I'm going to hope that they didn't actually mean discredit and just meant that they don't want their department associated with any specific political views.

    No he wanted to wear his uniform at the rally. To many that would imply his organization supports whatever he does. While this time it may not be so bad, what about a cop who want's to support oh lets say the KKK and go to rallies in uniform. If you allow one you should allow both, and the police, and military for that matter do not allow you to do this in your uniform because they do not want to be associated with any organizations/political groups. They are always welcome to go in their civilian cloths.

    What a mess this one is. The officer make a request to take time off to particapate in a parade in uniform as a reasonable show of support for the homosexual community and they end up with a nasty black eye of bad publicity.

    They could have made this so much easier and made a formal show of support for the homosexual communtiy by actively showing a non-prejudiced support.

    Instead their written response showed the same lack of support for homosexuals that is blatant discriminatory by useing the term "discredit" in a derogitory manner towards the homosexual community.

    Sad that they just don't get it. Discrimination, prejudice and hate have to stop. Go get 'em Allfred.

    An officer in uniform is considered on duty and an on duty officer is not supposed to promote their own personal agenda. They represent the law in physical form. Plus I'm sick of all the butthurt people.... you live in America quit bitching. We have worse problems dontcha think?

    I would prefer an undecided response as there is very little information in the linked article. I don't know what the precedent for such things are. It says he wanted to march with other officers. Were there officers in other precincts that were allowed to march in uniform? Was the decision based on a precinct policy, and what were the reasons for the policy? Are officers allowed to attend other social events in uniform?
    Discrimination is differential treatment. I can't tell from the article if this occurred.

    Yes definetly! This cop should not put up with this type of Discrimination.Where is the support from the L.A.P.D. Where is there LOYALTY? I didnt know that cops turned there backs on the fellow BROTHER? I take it that the L.A.P.D. has No Loyalty for there own,even if there GAY.

    The subject here is whether he can be “in uniform” while marching, not if he can march in the parade or not.

    We are not authorized to wear our Uniform unless we are “on duty”, or an authorized event like an Officers Funeral. Even when you see Law Enforcement Officers marching in a National Holiday parade, those Officers are on duty in a “comp-time” status.

    No one is saying that the Officer can not march in the parade. If he and his fellow Officers wish to show their pride as serving as Law Enforcement Officers, they can simply have “Tee-Shirts” made up with that message on it, and can march together with a banner with their message, and department Logos on it.

    I should have read further.. The person in question is a Corrections Officer (non P.O.S.T. Certified), but in reading another article on this, see that there are several Departments in CA that make exception for their Law Enforcement Officers to march in the Gay Pride Parade in Uniform.

    And a happy Gay Pride Month to you, and I'll pass along your greetings to the Gay Law Enforcement Officers I know and work with.

    I do not think he was discriminated against because, they didn't allow other officers to go and turn him down. He wasn't singled out for scorn or anything like that. He wasn't hurt because they wouldn't allow the use of city uniforms and equipment to be used. They just used poor judgement in denying the request. They should have OKed the request IF it was on his off time. It really wouldn't have hurt the department.
    I don't like this gay / lesbian perverted group of people but, it is their choice to follow their perverted life style. It is their constitutional right to pursue happiness, if that life style makes them happy, OK. It is not for me to like but to be able to tolerate the life of another. Why, because the situation is now a big mess. They allow officers to wear uniforms in other events. USUALLY when there are many personnel involved in the event, not just one.
    They should have granted the request, he wouldn't have gone running to his promoters and got so much adverse publicity and hyped up the event even more. Big mistake, they knew he is gay and should allow him to live his way, right or wrong, as long as he upholds his oath to protect and serve his city to the best of his ability. Has nothing to do with sexual preference to serve people and uphold laws. I even salute him for serving.

A man should be in control of and know what is right and wrong and be a man. I have never seen another man I was sexually attracted to. The thought of it just makes me want to hurl. It is meant for sexual attraction to be between a man and a woman. That is what God intended. I am a Christian,( possibly not the best example), but, I believe the accounts the Bible makes about creation and how God made all things. In Genesis it is written that God placed Adam and Eve together in life and that he caused Adam to be attracted to Eve and that he blessed them and told them to go and multiply and fill the earth with children. The bond was between a man and a woman. God hates sexual perversion. Be it homosexual, lesbian, bi, or any other sexual perversion, including premarital sex. It is sin. God hates sin, he loves the sinner and Jesus is the only way to receive forgiveness of sin. That is the Christian belief. Believe it or not. Your choice. Even when the Jews brought a woman to Jesus who was caught in the act of adultery, Jesus didn't condemn her. He asked if there were any of the men who were with out sin, if so, cast the first stone. None accused her then, Jesus forgave her and simply said, "Go and sin no more."

    Sounds like there are bigots on both sides to be honest. Except homosexuals have more of an excuse - they're trying to fight for rights they should already have. I think that would turn many a person into a bit of a bigot.
