Should Courts Scrap the Affordable Health Care Act?

For the last two days, the Supreme Court has been poring over the 2010 Affordable Health Care Act to determine whether or not the individual mandate, which would require U.S. citizens to purchase health care, should stand. Going into the debate, supporters had high hopes. Now it seems unlikely the mandate will survive. At this point, the judges need to find a "limiting principle," or clear limit to Congress's power in requiring Americans to to have health insurance, or it might fall flat.

However, some believe striking the entire bill dead would do more harm than good. Justice Ruth Bader Ginsburg said, "There are so many things in the act. Why make Congress redo that? Why should we stop and start from scratch?" Of course, there's the issue of who will go through the 2,700-page bill and decide which provisions can stay, and Rep. Michele Bachmann warns, "The individual mandate would be the funding stream that makes all of the rest of the act work." Do you think the courts should scrap the individual mandate and try to make it work, kill the entire thing and start from scratch, or just let it stand? You can read more information on this complex act here.

Get the government out of healthcare all together. I don't want anyone between me and my doctor! This unconstitutional law - if upheld - will be the end of freedom as we know it. We have been on this slippery slope for 50 years or more and are about to go over the cliff. It will not be healthcare or affordable. What a misuse of those two words.

Like Sweden? where they ban cell phones, bury power lines and forbid GMO foods?, I think you are correct... but the quality of care is not the issue in the USA, it is the establishment and fortification of industry and financial interests that sponsored this bill that will create hardship for the people they claim to assist.

Ban cell phones? Sweden has the most cell phones per capita than any other country in the world and the fastest mobile network. Bury power lines, what's wrong with that? And GMO has a lot of potential problems that the government of many European countries are banning to protect the people.

Typical republican who would rather see corporations' welfare being catered to than the people's.

A good portion of the people opposing it don't think it goes far enough. The majority supported it and are still basically supporting it.

WRONG.. As high as 86% of the American people opposed it ever being passed and two thirds of Americans TODAY want it REPEALED or overturned by the Supreme Court..

If the Left were even close to being right over how popular this bill is.. They'd have PUSHED for a Constitutional Amendment.. IF they has done this with Hillarycare,, Socialized Healthcare would be part of the COnstitution TODAY..

It became unpopular when republicans got into the game and ruined it. The majority of people supported the original health care bill, the universal health care version. It's when republicans screwed it up that it became unpopular.

How did the Republicans screw it up?? Not a SINGLE Republican voted FOR it.. NONE.. The Democrats had absolurtly NO reason to change the Bill in ANY way because of ANYTHINHG Having to do with Republicans..

They crafted the bill without Republicans.., Proposed the bill without the Republicans,, Made whatever changes they were forced to make BY THEIR CONSTITUENCY,, NOT because of ANY Republican and passed the bill without a SINGLE Republican vote..

The American People,, by 85% or better,, HATED this bill from the beginning and STILL hate it by TWO THIRDS today and it's probably the singlemost reason why the Republicans made greater gains in the elections of 2010 then at ANY time since 1938.....

That is just inaccuratre. Polls are showing that the Bill is wildly unpopular. It was passed by the Jackass party with no bipartisan support, with no time to read it and no time to discuss it. Your claim that "a good portion of the people who oppose it don't think it goes far enough" is ridiculous on it's face. Where did you get that factoid? Been reading the reading the wall in the men's bathroom again? William

It would be safe to say that a good portion of the LEFT that didn't support it opposed it because it ended up NOT having "SIngle Payer" as was PROMISED and as was originally intended.. it should ALSO be remembered that it ended up being the DEMOCRATS that removed single payer prior to passage after hearing from their constituency.. It was NOT the Republicans in COngress that convince them to do this.. It was the people who elected them into office and MOST of those Democrats replaced in the elections of 2010 were those who IGNORED those who elected them..

No time to read it? It was posted on Obama's website before he was elected president.

Assumption? It's common fact that a good majority of Americans don't think the health care reform went far enough.

Affordable Health Care is the Oxymoron of what Obamacare really is. Let's force Americans to do one more thing, and make people who can afford pay for the ones who can't. I do not mind anyone asking us to donate more money for Health Care, but mandating it is unlawful. We are not a Socialist Dictatorship that must be told what we can do with our money, and more importantly, fund things that go against our moral conscience!

The reasons why health care is so expensive is because of government intervention and frivilous lawsuits. Doctors have to pay so much in malpractice insurance that the costs are falling back on us. Get the government OUT of healthcare and stop those stupid, unnecessary lawsuits and healthcare costs will drop.

Just the same, when the government is right, do not war against it. Personally, I am no threat to any being with my flesh except in the use of it in the supplication of my God against them which latter is a serious harm to them but is absolutely legal and moral right.
We who dissent our governments for abuses and other issues have a right, a duty to urge war against them and rally people to oppose them wholeheartedly. We have no duty to them to say it is not legal to seek their life for crimes we set that value over and seek so.
Be American, demand these leaders serve us and stop their illegal acts with the force of the people and overt action in masses. I tell you, these days with the evil the US does, it should execute every leader after they serve their term to recompense the evil they do, it is a shameful government we have these days. I do not hold loyalty to it in any format and pray constantly evil against it. I do pray God protect and preserve the people who he makes upright and well.

Yes you are missing something. How many people died before Obamacare because of hospitals turning away people with a medical emergency. Can you name one? Name it by name so that the truth of it can be checked out. All the examples Obama pointed before this Bill was passed turned out to be out and out lies. Obama lied to us about his own Mother in order to get this thing passed. Under Obamacare Death Panels will decide who gets or does not get life saving medical procedures. Obama and the Jackass Party straight out denied that such a panel existed. And now thanks to the warmth and kindness of this same jackass party people most certainly will die. Do you get your facts off the wall of the men's restroom again. William
