Should Alabama Man Be Allowed to Keep Late Wife Buried in His Front Yard?

A controversy is brewing in Stevenson, Alabama over a husband's front yard grave for his late wife. According to the Associated Press, James Davis is fighting for what he believes is his right to maintain his late wife's grave, which has been on his property since 2009. The local government however, believes this could set an unhealthy precedent for the community.

"We're not talking about a homestead, we're not talking about someone who is out in the country on 40 acres of land," said Stevenson city attorney Parker Edmiston. "Mr. Davis lives in downtown Stevenson." One can imagine having a neighbor with a front lawn graveyard, no matter how sentimental the reason, would freak out some folks.

In response to the city's request, the "Let Patsy Rest in Peace" campaign has been created to let Mr. Davis keep his late wife's remains buried in the front yard. It may seem odd to some, but Davis has said it was his wife's wish to be buried on the property. Stevenson officials are probably worried about the home's resale value should it become vacated, but Davis claims if they get their wish and remove the grave, it will be when he's joined his wife.

I looked it up, there are just over 2000 people living in this town......I bet they are mostly related.....Make him have a provision in his will to have the remains exhumed and moved at the time of his death.....in other words, leave the guy alone.

Yes, i think the guys deceased wife should be able to remain. If there wasnt an issue about his deceased wife being buried there in the first place..... why hassle the guy now. Let them both be buried there, or, move them both when he passes.QUESTION: Should Alabama Man Be Allowed to Keep Late Wife Buried in His Front Yard?

Would I do this? No. Is it a tad creepy? Yes. BUT.

It's his yard. He pays for it. I don't see the issue.

Sure! I believe that we should put undertakers out of business. Certify the death, dig a hole and be done with it. They sell you a coffin with a comfortable matress in it. Really???They play on your emotions and cost you thousands. Save the money for the family and keep your loved one close and remembered.

I agree, he owns his property but he won't live there forever. The next owners have to have the gruesome task of removing the grave.....and to where, and at what expense? Chances are that this guy will request to be buried beside his wife. What if everyone did that on their property!!! What a creepy new house to own.....with dead bodies in the yard and probably tombstones to boot. Everyone would be doing it to be free of funeral homes and cemetery expenses. In Canada, we aren't even allowed to bury a dead pet in our yards. It's against by-laws. Children would be having nightmares with the human remains of dead strangers in the yards they play in.

I see nothing wrong with it.
I seen pictures of the grave and it is all nice and neat and full of flowers that when fully grown no one have a clue that it is a grave.
We buried my Aunt in our back yard. It was he final wish we have a head stone and all.. Oh did I fail to mention that we had her cremated and buried with he cats in our back yard and I feel so safe in knowing my aunt is watching over me....

I would advise a good healthy marathon showing of Roger Corman horror flicks to build up a little spine in anybody who's timid about seeing graveyards. People had rights to their land long before the city administration of Stevenson, Alabama came along.

Clearly he loves his departed wife and just look at how well, and lovingly, he takes care of that site. I hope this home goes to relatives who will continue to care for it--this cabin looks quite old, in very good shape.

As usual the nanny state is in full force. If she's buried the standard 6 feet deep then it's not going to pose any health problems for anybody. She will just decompose and return to the earth. Nobody will smell anything or be subjected to her corpse in any way, as long as it's not a shallow grave which I assume it's not.

Unless there are city ordinances prohibiting this then nobody should have a problem with it. Also, lets put this into perspective and not get hung up that this grave in in "downtown" Stevenson, AL. Stevenson is a tiny town of less than 2000 people and about 5 sq. miles. It's in the country and not some big metropolitan area. Many years ago family cemeteries were common on private land within town limits. Small towns in modern times share many aspects of towns 100 years ago. This needs to be kept in perspective.

If there aren't any previously established ordinances or state laws, & as long as she's in some sort of box, not rotting into the water-table, there isn't any reason why she should be dug up. It's his land, his home & his wife. He's abiding by her wishes. The house is probably going to go to someone in the family after he dies & if they want to remove the body, they can... or the purchaser, should it be sold after he dies. Who cares what the resale value is?? He's not going to sell & when he's dead, it won't matter anyway. It's unlikely that the neighbors have a problem with it. It seems more likely that there are just some noisy busy-bodies trying to stir up trouble & get some sort of attention. Let them be. He obviously loved his wife very much.

Either your comment is incredibly dramatic or deeply sad. But I don't know what you mean.
Maybe you are one of America's brightest & a poet, or maybe you just can't spell.

I don't know what you meant, and it makes me sad that I can't trust people's writing abilities.

When I say love you ALWAYS will love that person, when I hear someone say they "loved" their mother it makes me feel as if you no longer love them as the ed on a word is past tense.

Just because someone died that's close to you doesn't mean you should ever stop loving them.

To me it's an insult to them as person and their memory.

I learned that after I lost my mother at the age of 18 years old.

    I will ALWAYS love her.
