Should a U.S. Supreme Court Justice have empathy as a a character trait?

President Obama stated that he would like to nominate a Supreme Court Justice who has empathy. Do you agree with this?

HE/She can have all the empathy they want but...they better not legislate from the bench. Thats the trouble with most judges, they make laws by how they feel that day. They should interpret the law and thats it, not make up new laws.

For a start, humans should have empathy full stop. It shouldn't be a trait for a job, it should be a trait for life so this worries me that people actually have to ask for this characteristic to be employed...
