SCOTUS Upholds Individual Mandate!!!!

CBS News is reporting that in a five to four decision authored by Chief Justice John Roberts the Supreme Court has upheld the right of Congress to impose a requirement that all Americans have health insurance or pay a penalty under the Congress' taxing powers. Details are still coming in. It appears that the Court has also struck down the requirement that States expand their Medicaid coverage.

    I see. So now you have no problem with a President ignoring the normal process, ignoring bills lawfully passed by Congress and usurping their role by acting independently of Congress? Does that mean you support President Obama's immigration initiative too?

    They worked around making everyone buy insurance by calling it a tax which puts it in the purview of Congress. Nothing more than wordsmithing and sidestepped the unconstitutionality of the whole issue. This is not going to save King Obama when the voting begins. There are so many other things that he has done that only the Welfare scammers and illegals benefit from. He has forgotten that those of us who are legally in the U.S., want to work for our money, and do not want to live in a Nanny State, have a vote as well. If there are enough of us, Obummer will be going back to Chicago to his thug world. I just wish we could take all the benefits he will enjoy after he screwed everything up in our nation.

    In reality, the law is constitutional because the Supreme Court said so; it's the final arbiter of what the constitution means.

    That is unfortunately true however, it can be overturned. I will agree that as it stands it is constitutional simply based on the vote. However, even Stephanopolis feels it is a tax and certainly he is not a conservative. Just smart.

    Sure. I understand how the system works. Prohibition was constitutional too and that was changed. Trust me Sir. my degree was in Political Science. George asked a question and got a very condescending answer from King Obama. They (The Liberals) Have levied a new Tax upon us the peasants.

    I have no idea what you do for a living but I assure you I am not among the wealthy. I am in education and a part owner in a small business. I am the guy Obama claims to be helping and yet I see the big picture...that this is just one step closer to the Gov telling us what we can and can not do. Trust me when I say that I hate hypotheticals but Do you really think the Founding Fathers would look at how we interperet certain parts of the constitution and think we have any clue? Sorry but if you do...you are the ignorant one. Frankly, I am not sure they would actually think income tax is lawful!

    I get it; you're one of those Americans who frequently votes for Repubdungbaggers and against your own economic interests. The final arbiter regarding the meaning of the constitution rests with the Supreme Court.

    As for the founding fathers, they weren't conservatives. They were without question the liberals of their era. By the way, colonial conservatives were Tories; many of them left the U.S. for Canada and they opposed independence.

    Without doubt...but the definitions were very different back then. Obviously they were Liberally minded compared to the staus quo of Mother England. However, being conservative now means being a strict consitutionalist which means we adhere to what the founding fathers intended...not the bastardization Obama and his party want for their own intentions.

    John Adams spoke to Slavery as another generations fight and that they had to first fight for Freedon from England. If abolishment were pushed at the start...The southern states would have never joined the fight. What you are argueing is very different. Yes we have the ability to change to constitution but what you fail to accept is that the supreme court did in fact say it was against the commerce clause. They simply gave an out so to speak by which the Gov could do what they wanted....Via a Tax.

    I think it was great that it was upheld. It was a victory for the American people. But we eventually need to rid that relic of private health insurance, and get a single payer system. I didn't agree with Roberts that it was unconstitutional under the commerce clause, because we alreadfy have federal mandates that were found constitutional. Some examples, the draft, registration for the draft, and Reagan's mandate that hospitals E R must treat all patients whether they have health insurance or not. So I don't understand why Roberts and the 4 disenters said Obama Care was unconstitutional under the commerce clause. But Roberts saved it with the tax clause. The only ones that will pay a tax will be people that don't buy insurance.

    They were afraid to acknowledge that laws like this are constitutional under the commerce clause because that might lead to corporations actually having to start behaving themselves and paying their fair share of taxes. By basing the ruling on the taxing clause, Roberts avoided setting a precedent that would hurt his corporate benefactors too badly.

    Wrong...what many pundants...Liberal and Conservative alike belive is that Roberts voted the way he did to demonstrate the hipocracy of Obama stateing that "It is not a tax!" Actually, if this is true, and I am not saying I 100% agree it would speak very poorly of Roberts that he is so politically motovated.

    The fight is not over, this is only the 5 round, this is going to be a 12 round fight, we all want not for profit health insurance, this is the first step in that process. Now progressives, liberals, democrats, independents, and some thinking conservatives must push even further and make this a success and then we will have a single payer system.

    Remember this is round 5 in a 12 round fight.
