SCOTUS Upholds Individual Mandate!!!!

CBS News is reporting that in a five to four decision authored by Chief Justice John Roberts the Supreme Court has upheld the right of Congress to impose a requirement that all Americans have health insurance or pay a penalty under the Congress' taxing powers. Details are still coming in. It appears that the Court has also struck down the requirement that States expand their Medicaid coverage.

    They didn't DECIDE that the law WAS Constitutional.. They MADE the Law Constitutional.. The President and the COngress went through GREAT lengths to make the point that Obamacare had NOTHING to DO with Taxes.. What the COurt did today was REDEFINE the definition of "Tax".. Roberts,, in making a point that he was trying to avoid the APPEARANCE of Judicial Activism has ,, in FACT,, DEMOSTARTED Judical Activism to the extreme degree..

    No, they recognized that the law was Constitutional based on both the language of the Constitution and precedents going all the way back to George Washington when he signed the Second Militia Act in 1793. The Government's briefs did indeed suggest that the law could be upheld under Congress' taxing power.

    And this is the opposite of judicial activism. Judicial activism involves creating "rights" that clearly do not exist in the constitution - like "corporations are people", or completely ignoring sections of the Constitution that do clearly apply - like "a well regulated militia". Here we see very clearly a law that was securely based in the Constitution, supported by ample precedent, and clearly enacted as part of Congress' own responsibility to "promote the general welfare". Striking it down would have been another example of the unbridled activism of this Court. My hunch is that John Roberts is starting to worry about his legacy as the leader of the most corrupt and activist Supreme Court in American history and may belatedly be trying to clean up his act.

    The acronym is RINO as in (R)epublican (I)n (N)ame (O)nly and there WAS that EXPRESSED concern when he was nominated.. It BEGINS to look like those concerns have NOW been validated..

    ONE thing that is clear though.. ALL of the moaning and groaning claims by the Left that THIS is a Conservative Court can NOW be laid to rest once and for all....

    And I believe that Obama might as well drop out of the race RIGHT now.. The American Public has ALWAYS been against Obamacare.. Granted the numbers,, once as high as 85% at the time Congress passed it,, has dropped to somewhere around 60% recently because of all the people who Obama put out of work but NOW that it turns out to even MORE of something that Obama SWORE that it was not,, a TAX,, it will ONLY serve to ENERGIZE the people who want to SEE it REPEALED..

    Wrong. The majority of republicans are for the provisions in the law. You do realize that the whole idea of an individual mandate came from the Heritage Foundation, don't you?

    And in fact, most of the Republicans who oppose this law oppose it solely because President Obama got it done. They actually support most of the provisions in the law when they are asked about it without reference to President Obama.

    –Reuters/Ipsos found that 80 percent of self-identified Republicans support the idea of healthcare exchanges — pooling health insurance and distributing it among recipients to get lower group rates.

    –Around 52 percent of Republicans like the idea of forcing corporations to offer health insurance plans to employees.

    –The same percentage of Republicans support allowing young people to stay on their parents’ insurance until age 26.

    –Nearly 60 percent of Republicans support that idea of government subsidies to help middle and working class families pay for health insurance.

    –The pre-existing conditions language in the law? A massive 78 percent of registered we-hate-Obamacare Republicans support that part of the law.

    In other words, Republicans — more so than the rest of the population — hate the law, but love everything in the law.

    By the way, independent swing voters? They support the above provisions by nearly unanimous margins — in the 70 and 80 percentile range.

    So, I guess what really happened hasn't sunk in yet?

    Give it a few days and it will. This just re-opened the discussion that 0bozo and Dem's who voted for this, wanted to go away. Now we're back to talking about what is actually in the bill and exposing the largest tax increase on ALL Americans in history.

    And what do you say to the millions who were in a great group plan they liked but lost it when their employer decided to pay the fine instead? Now they don't get the discounts associated with a group plan and are forced to pay another fine themselves or get 0bozoed.

    "If you like your doctor.... you can keep them.... if you like your insurance .... you can keep it."

    LIE ... LIE .... LIE .... The people no longer have control over those choices, which is the purpose of 0bozoTax. Force everyone into the goobermint run, socialist death-care system.

    And yes if you like your insurance you can keep it and if you like your doctor you can keep him/her, nothing in this Bill says you cant?

    Have you even read the Bill? You honestly sound as if you have not, i tell you what i will do.

    In August i will be in Europe for a friends wedding, it is no problem for me to come over to Germany with a copy of it so you can read it (if you have not), and then you can point out those death panels, chip implant provisions and the part you are talking about, okay?

    Again i see no sense in continuing to talk to you, you believe what was spoon fed to you and have chosen not to know the truth, so there for wallow in your ignorance while the rest of us try to make what was upheld better.

    Better yet why dont you go a try to find the solutions to the p[problems you raised in any republican plan, i bet you found it.

    I think its a symptom of drinking too much. His tendency to cry seems to correlate with his skin color, which I suspect is from the pigments in the merlot.



    For awhile as Speaker, his skin color got more normal, and he cried less. Under the stress of his current situation, he's probably drinking more. I think he needs help.
