SCOTUS Upholds Individual Mandate!!!!

ProudProgressive 2012/06/28 14:17:45
CBS News is reporting that in a five to four decision authored by Chief Justice John Roberts the Supreme Court has upheld the right of Congress to impose a requirement that all Americans have health insurance or pay a penalty under the Congress' taxing powers. Details are still coming in. It appears that the Court has also struck down the requirement that States expand their Medicaid coverage.

Here is a link to the full opinion of the Court:

Really?? That's your way of explaining this new middle class tax....
Oh no, I said there wasn't a tax, your job is to show me where theres a new middle class tax. I dont believe it and I'm asking you to provide information and the knowledge you have, that I apparently do not. So I can look into it myself... this really isnt that hard!

    Not everyone, true.
You may be surprised I am not totally against a health care overhaul but I do not like it being paid for by a tax or penalty. .
My big problem with the Dem's and Obama is they have a philosophy that they(The government) know what is good for us---they want to think and make decisions for us. More Government--less freedom

hmm, yea I don't see it! Our current system isnt working. When something doesn't work we try to improve it. It has nothing to do with them knowing whats good for us. How do you have a problem with the Dems and Obama when it was republican plan? Personally, I have no interest in paying for people who choose not to take personal responsibilty and obtain insurance.

After reading through some of the key portions of their opinions, it seems that the court handed conservatives a huge gift and started to nail the coffin shut on 0bozo.

They were all in agreement that the mandate was unConstitutional in relation to WH attorney's main argument that it was allowed under the Commerce Clause.
That is what Conservatives and many Liberals have been saying for months.... 70%.

Whether Roberts meant to or not, by siding with the Liberals, he exposed 0bozo's repetitive lie about it not being a TAX, and put it in writing.
As Pelosi said... [we'd find out what's in the bill] That conversation has been quite silent and wasn't poised to get much discussion, especially if the mandate had been rejected, as it should have.

However, by this ruling, 0bozoTax has been placed on the front burner and Americans will FINALLY be paying attention to all those things 0bozo and Dem's who voted for this monstrosity, didn't want to talk about.

No, you wont be able to keep your Doctor or your coverage because employers will gladly pay the fine compared to what the cost is to provide medical insurance as they have for decades. Where does that leave the employee? Being forced into a govt. sanctioned plan, with less coverage and less quality than they had, or be faced with...

No, you wont be able to keep your Doctor or your coverage because employers will gladly pay the fine compared to what the cost is to provide medical insurance as they have for decades. Where does that leave the employee? Being forced into a govt. sanctioned plan, with less coverage and less quality than they had, or be faced with fines of their own, garnishment of wages and possible prosecution by the IRS.

It would cost employers an extra $2 per hour, per employee (not boosting any wages) which will result in lay-offs and stymie any future job growth. Doctors will simply stop taking Medicaid & Medicare patients which some already have, limiting where one can go for treatment & services.

$500 Billion gets sliced out of Medicare which will result in decreased services and leave their fate in the hands of the govt. and put a price tag on their lives.

The court also upheld states rights and ruled the Feds cannot force states to participate in the increased Medicaid program but cannot penalize them by cutting funding. So where will all that Medicaid $$$$ come from? Cutting other programs and agencies within the Federal to pay for their expansion of the welfare state.

Bottom line, there's well over a year before the mandate would become effective and plenty of time to de-fund 0bozoTax, repeal the entire bill and replace it with a sensible solution that actually does allow people to keep their doctor, their insurance plan, lower costs, improve the quality and availability of care.

This ruling has also, all but guaranteed that taxes in general, will NOT return to the Clinton levels on Jan. 1. 2013. There's no way America will buy the two largest tax increases in history piggy-backing on top of one another.

LOL keep trying. The President didn't lie, of course. Roberts did pull his usual politics over the Constitution crap in striking down the commerce clause argument, which just about every Constitutional scholar agrees does authorize the law, but he knew that striking down the law would likely result in his impeachment. The fact that Roberts' interpretation differed from the President's doesn't make either of them liars. And of course, the latest Right Wing lie about a "middle class tax increase" is already wearing too thin to last.

Yes, you will be able to keep your doctor.
No, a "government sanctioned plan" does not provide less coverage and less quality.
No, it will not cost employees $2 an hour.
No, it will not be repealed.
Yes, the Bush tax giveaways to billionaires will end in December.

Not only did 0bozo lie in the taped interview with Stephanopolis.... he repeated the lie numerous times over the years. Robert's interpretation added wording that wasn't included anywhere in the bill, but he is justified in doing so while writing his opinion.

ALL of the Justices agreed that the bill was unConstitutional when applied against the Commerce Clause when they went into conference after oral arguments were heard.

No, the "keep your doctor keep your policy' is 100% bullsh!t as employees have no control over the employer's decision to cancel all coverage packages.

0bozocare doesn't even come close to what policy holders already had, which 85% of Americans were happy with before this fiasco began.

I said it will cost EMPLOYERS on average of $2 per employee more in taxes to pay for the other aspects ..... such as increased Medicaid etc.

It WILL be systematically de-funded, repealed and replaced in 2013.

Good luck with reinstating the Clinton tax rates. That will be such a no-brainer by December as the economy continues to siip into the abyss and unemployment rises steadily between now & then. NOBODY will be hiring until 2013 as a result of the decision yesterday.

It is amazing that people who think waste their time with Thomas Sowell. I can't recall him being right about anything, and he's certainly wrong here. The BEST and most cost efficient means of supplying health care coverage is a single payer government plan such as almost every other civilized country in the world already has. The WORST way is to let private for-profit corporations supply coverage when and if they want to at whatever price they want to charge.

Actually lowering the cost of insurance would be accomplished by such things as making it harder for lawyers to win frivolous lawsuits against insurance companies.

The Romney Plan in Massachusetts is 50% funded by sources other than Massachusetts taxpayers. If Obama can find some source other than US residents and businesses to pay for Obamacare, he will, indeed, have rebutted his conservative critics. Until and unless that occurs, however, the arguments of BHO and his apologists will continue to consist of such verbal sleights of hand as "the diversion of $500 million dollars of future Medicare reimbursement to pay for expenses attributable to the PPACA is not a reduction in Medicare funding to pay for PPACA because no recipient's benefits are being reduced in conjunction with the reallocation ... Medicare costs will continue to increase ... they will just increase more slowly ...".

Of course it's constitutional. Your own man John Roberts said so. It's a shame he had to sink to an activist position in denying the clear applicability of the Commerce Clause, but ultimately he was too ashamed of his own chicanery to strike the law down.

Ohhh, the pain of again losing a battle before the Supreme Court. That makes three in as many weeks the RWNJs have lost. Still, they don't grasp the idea that their agenda of destruction of the U. S. Government isn't popular, even among those that were hand picked by Wall Street to have a lifetime job of service to Big Money and regressive policies.

Ideologues can rarely be separated from their brainwash, so the current crop will continue to make asses of themselves and pile "issues" on Romney's shoulders until he sinks like a rock in the Great Salt Lake, notwithstanding the magic underwear. Society prevails, it is moving on without them, as it did when Barry Goldwater, Ross Perot, and McCain/Palin were carrying the banners to the rear of the parade.

Isn't this fun, watching a boat with oars on just one side go round and round in circles?
