School Fined $15,000 for Selling Soda: Acceptable or Outrageous?

The federal government is reportedly suing Davis High School in Salt Lake City, Utah for accidentally selling soda to kids during lunch time -- a violation of federal law. The violation is costing the school $0.75 per student (that's about $15,000 total) and forcing it to make budget cuts elsewhere to pay for the offence. Remarkably, some people are upset.

Principal Dee Burton told KUTV, "The rule is vague and open to interpretation. For example, the way the rule reads -- you can buy before lunch starts a carbonated beverage, buy school lunch, sit down in the cafeteria, eat the school lunch and not be in violation ... You can sell Snickers and Milkyway bars because they have nuts and they're nutritious. You can't sell licorice, but you can sell ice-cream ... The misconception is if we don't let kids buy candy and pop, we drive them to the cafeteria, it doesn't drive them to the cafeteria it drives them off campus." Does it sound fair to you?

    Why stop with a fine. They should start executing faculty members...the learning environment is A LOT better if it's based more on fear and less on education.

    I don't think forcing kids to eat proper one meal a day will affect weight by that much because the government doesn't have say over the other 2, which I'm glad they don't I hate government interference

    If we could get them to call it carbon dioxide syrup poison, the better off society will be.

    What's the matter with selling drinks that taste good but aren't anywhere near as bad for you, like orange, grape and pomegranate juice, or banana protein smoothies (Naked Juice), unsweetened tea, etc?

    What a farce. I can't think of any high schools that don't have vending machines somewhere on campus. What's to stop the kids from buy soda from one of those? I remember when I was in 9th grade, the school actually brought in a couple of soda fountains, and the soda was included in the the lunch, if you wanted. You could get white or chocolate milk, or a soda. It was great!

    They should be allowed to sell it. If it's for "health regulations", they'll just drink it everywhere else. There's no point in trying to stop it there.

    First, Davis HS is NOT in SLC; that's about 35 miles south in a different county.
    Normally, I would seek refuge in the Tenth Amendment; except for one thing: Somebody "kissed the ring" of the Federal agencies, probably to get money. Eat the bait, get the HOOK! My solution would be to cut all the ties, fund everything locally, and then be able to tell the DC noodle noses to BUT OUT! Hey, Senator Hatch, how did you let this happen? You're supposed to be Mr. Conservative.

    If this floats your boat, join the Air Force. They will weigh you once a year unless you look too heavy; then you will participate in the Weight Management Program. They also measure your waist and if it exceeds 34 inches, you lose points. Your future depends on this thing, including the character of your discharge. Back when I was on duty, it was called the Fat Boy program and it killed a lot of careers. Performance and capability didn't matter.

    Im in the army and we have the same program. I started at 150 lbs and they were going to discharge me unless I made it to 130

    The law itself is ridiculous. The federal government shouldn't dictate what kids can and cannot buy during their lunch time or at any time, especially when it's not food or drinks from the cafeteria. I understand the obesity problem, but fining the schools isn't going to make it go away. Schools should not be punished for parents not teaching their children healthier eating habits.

    want to end obesity? outlaw pop, or soda, or any sweetened lab concoction, diet or not. that category alone keeps america and now the world, fat.
    drink plain water and eat whole foods that are not out of a colorful can or box and the weight problem will disappear.

    The problem is you think the solution to ending obesity is to take away personal freedom of choice. Taking away the beverages and sugary things won't do any good if they didn't stop eating them because they recognize it's bad for them and want to do things to keep themselves healthy. It just ends up in resentment and just like with abolition there would suddenly become a blackmarket for those items. In fact, I think that's the stupidest idea I've heard in a good while.

    pop is the single most destructive product, surpassing tobacco as a killer.
    i'm not advocating outlawing pop, but if it were taken off the market, the world would slim down and obesity related diseases would stop.
