Rape Victim Arrested And Denied Contraception – Will Be Allowed To Sue

A Tampa woman whom we only know as R.W., was raped. She was treated by the rape crisis center, who gave her two emergency contraception pills, one to be taken immediately and one to be taken 12 hours later. When she reported the rape to the police, they uncovered an arrest warrant on R.W. for failure to pay restitution and failure to appear. After she was arrested, a Hillsborough County guard confiscated her second pill, claiming it was against her religious beliefs.

R.W. says she requested her second pill the next morning, but jail employee Michele Spinelli refused. “Spinelli told the Plaintiff that she would not give R.W. the pill because it was against Spinelli’s religious beliefs,” the first amended complaint states.

Although R.W. did not get pregnant, she sued Spinelli and Hillsborough County Sheriff David Gee for gender discrimination and violations of the right to privacy and the right to equal protection under the 14th Amendment.

The Sheriff’s office essentially contended that Spinelli was acting as an individual, and she was not the “final policy maker,” meaning that the government office wouldn’t be accountable.

U.S. District Judge Elizabeth Kovachevich disagreed. She found for R.W., claiming that Spinelli was the final policy maker since she was the only person on duty at the time and she hadn’t been given a directive, one way or another, by Sheriff Gee. The conclusion is that R.W. will be able to sue the Hillsborough County Sheriff’s office.

While it is tough to draw correlations between court decisions regarding government agencies and those effecting private corporations (like pharmacies), this decision does bode well for the women who have been denied access to contraception, simply because the person standing behind a pharmacy counter doesn’t share her beliefs.

    i would like to sue hillsborugh couty court house because the court house took my chilldern away from and gave my kids to there abusive father i have been trying to get help but i dont have much money for a laywer and the court house

    WTF! That is ridiculous and that guard needs to be fired. What the hell is wrong with people. It's not her business what another woman wants to do, especially in this case.

    While in the military, I spent a lot of time in Texas. I do like the Austin area and the Hill Country. I never liked Houston that much.

    I had a friend who spent 2 months (July/August) in Houston a couple of years ago while his wife was getting radiation treatments at MD Anderson. He said he couldn't understand why ANYONE ever settled there in the first place. They've scheduled their follow-ups for spring and fall lol.

    If the majority of SH wasn't filled with right wing extremists/racists/sexists, letting those offensive/stupid/worthless comments stand would be good because it would show the rest of SH just how extremists conservatives are these days. However, since SH is, in and of itself, a very conservative-dominated website, the powers that be don't seem to care how much hatred and stupidity is spewed by their fellow conservatives.

    Over the past few days, I've done some research on this site at various computer related websites; trust me, the reviews aren't good and, more often than not, they refer to the very obvious conservative racism at SH.

    I doubt she will win either the gender discrimination or the right to equal protection lawsuit, but she should win the privacy law suit against Spinelli, and possible the county, but I doubt, unless the Sheriff was in someway involved, that she could win there, especially if it isn't a part of their policies. Would be interesting to see how this turns out.
