Paul Hoffmeister of independent investment research firm Brettonwoods Research predicts that the Supreme Court will decide that Obama's signature legislation the Affordable Care Act violates the Constitutional.
A Supreme Court rejection of the entire ObamaCare legislation would be ultimately be a positive for stocks, particularly the real estate segment which is plagued with a looming 3.8% capital gains tax on real estate transactions beginning in 2013 to help finance the plan, Hoffmeister said.What the upcoming Supreme Court decision on Obamacare means for the markets and taxes.

    The mandate will be struck down. Hopefully, the lack severability protection will kill the rest. At least, a substantial portion of the funding dies. In the best case, we get todefine a system that is truly affordable without death panels.

    I know it's rare a decision by the current supreme court to use common sense. But this time I'm sure they will and dismiss Obamacare.

    First of all it is NOT AFFORDABLE if you work for a living or own a home. Hopefully the Supreme Court will be smart enough to know that any government mandate is illegal.

    Military service has been justified as part of the Constitutional duty for the federal government to protect the country from foreign enemies.

    There is no requirement or authority for the federal government to provide health care.

    We'll be finding out in a few days. If by chance they rule that it is not legal he might as well look for the other oar because he'll be up the creek without a paddle. I predict it goes down by a 5-4 vote. Not too much genius in that decision.

    They won't uphold the law because it is unconstitutional to force Americans to purchase anything, including health care. Those who can't afford it now, won't be any more able to afford it if the law is passed, and then all hell breaks loose. Then the fines and whatever slaps on the wrist come down, will largely be ignored, and it won't be any different than it is now. People can not be forced to be responsible for themselves if they have the inbred affectation that the government should take care of them and give them whatever they want.

    It is simple logic. If the Supreme Court selected GW Bush for President, it is clear the Republican Party holds control power of the Supreme Court Bench, having made more Republican Judge Appointments. Clearly they will support Republican Objectives, which means dumping Owe Bama Care.

    Let's split some hairs here. The SCOTUS is heard arguments on the citizen mandate portion of the Affordable Health Care Act. I believe the court will rule the "Manadate" unconstitutional. Without the mandate in place the rest of the act falls apart because forced participation has been take away. The rest of the act is not before the court.

    The main argument presented to the court had to do with the individual mandate. There are many parts of the Health Care Act that are good legislation and I do not see the High Court ruling against the whole thing. The individual mandate will be struck down and that is the backbone of this law and without it the major portion will be hard to implement. Sunshine, just had to throw in a dart!

    The lack of a severability clause gives the SC the power and probably the obligation to, if they strike down the mandate, void the entire law.
    Including the new taxes and death panels.

    The law is 'severable,' meaning if one portion of it fails a court test the rest of the law still stands. Though the supreme court may strike down a single provision of the law, it is really doubtful that the entire law will be struck down.
