Prison for man who got $1.5M in ATM glitch, Fair or Foul? Shouldn't the bank also be held responsible?

Although court workers calculated a permissible sentencing range of
37-46 months in prison, the U.S. Attorney's Office recommended 15
months, partly because the problem was caused by the bank. Bank of
America wouldn't comment.

    Fair. He knew that money wasn't his. There was some sort of problem or glitch in the banks system. Mistakes happen, so I don't believe the bank should be held responsible in any way. He should have returned the money.

    Just because you leave the door open doesn't mean anyone can come in and steal everything you have. This is no different than bank robbery. What is the sentence for that?

    If he went to the ATM to take out $500 and it pumped out $1.5 M......I would be a bit more inclined to say that the bank should accept a tiny part of the blame. To me it would STILL be a matter of personal responsibility.

    But according to the story he made MULTIPLE withdrawals over a period of 2 weeks. Since he was an alcoholic retired autoworker, we can only assume that many of these withdrawals were WAY more than his total balance in the account. So time and time again he withdrew money that he KNEW wasn't his. This puts all the blame squarely on him.

    When he received $1.5 million that wasn't his, he had a choice; either return it or run off to some other country.

    He was stupid and now he's paying for it. Stupidity can be a crime.

    I can go on about how BOA used to find ways to screw their customers (they probably still do but they haven't tried to put the screws to me in years after several class-action lawsuits) but whenever they've had an ATM glitch that worked in their favor against me, they did their best to give me restitution while they resolved the error. In this case, Mr. Page should have realized this and stopped the spending before the banks caught on to it. I know it's a hopeless situation in Detroit (believe me) but you can't blame the bank for something he did willingly.

    Not every banker is a thief. Isn't it OK to make an honest buck for enabling people to borrow, to walk around without untold amounts of cash in their pockets, and to give people some return on their money invested in your business?
    Besides, theft is wrong, no matter who it's taken from.

    I didn't say the average teller was a thief. But the ones who call the shots ARE. And they are the only ones who care about what was stolen.

    Banking is a business. It's no different than a grocer, a plumber, or a dentist. It's like anything else. If you rent a car, you use the car, take it back and pay for it's use. It's no different than money.
    The thing is you too can invest in a bank and get part of that profit. That's not theivery is it?

    When you create 'money' out of thin air and charge people for it, that's theft. Actually it's called fraud. ONLY Congress is supposed to have that power. It's not something they can delegate. ESPECIALLY to a private bank!

    FDIC is a government guarantee to pay any losses over 250k. That means the government steals money from every taxpaying individual to cover the theft. Hardly a moral solution.

    oops. Thanks for the correction. Stealing from a bank is still theft. Since the theft is paid by depositors and taxpayers, the fact that the bank itself is a thief bears no relevance.

    He didn't ASK for this money, the ATM gave it to him.
    Personally, I'd have had my lawyer argue that this, in my view, was God answering a prayer.

    How can you say that? The story clearly states that he WITHDREW money over and over again. Isn't that ASKING for money that he obviously knew wasn't his?

    Technically that's the same thing that happens when you walk into a bank and give the teller a note saying "hand over all the money in your drawer".

    B) As far as I know, I've never seen an ATM that would LET you withdraw more than $300
