Off duty cop hits 4 year old then shoots her dad, should he be charged?

Moments after his motorcycle struck a 4-year-old girl, an off-duty Chicago Police officer shot and killed the girl’s irate father after he allegedly attacked the officer, the Chicago Sun Times reports.

Fraternal Order of Police Spokesman Pat Camden identified the officer as a 43-year-old veteran of the Chicago Police. The officer was headed home on Saturday evening when the horrifying incident occurred.

As he was driving home, the officer says he saw a child unexpectedly run into the street. In order not to strike the girl directly, the cop jumped off his motorcycle, pulling it down on its side on the pavement. However, the motorcycle skidded and flipped, hitting the 4-year-old girl and her 18-year-old cousin, John Passley.

As the officer attempted to provide aide to the girl, her father, identified as Christopher Middleton, 26, came running out of a nearby restaurant and aggressively approached the officer and began shouting, officials said. The cop argues that he identified himself as a police officer but Middleton still hit him in the face and knocked him to the ground before striking him repeatedly.

    But that shouldn't stop the police "shooting team" from investigating. The key question is: could that officer have defended himself short of firing his gun?

    Actually he was. Broken shoulder and broken leg. Along with bruises and such from the beatdown.

    So was he just supposed to take it if he did have a broken shoulder and leg and the two were still beating him? It was an accident and the cop was trying to help the little girl which was the right response. The father, instead of helping his daughter took this as an opportunity to beat on someone. Whose instincts were more noble?

    It was caused by the bike. He was attempting to render aid to a virtually unharmed little girl while suffering broken bones himself. Then the father rather than attempt to render aid to his daughter decides to beat an officer with broken bones two on one kicking him repeatedly in the head.

    Too many people leave very young kids to their own devices. I've seen it too often. There was a case last year where a seven year old was out on a street at ten at night and hit and killed by a cop speeding to a silent alarm. Why was that kid out?

    First of all, the bike was on the ground already. He did NOT run over the kid. Secondly, with all the injuries he had, he was getting beaten by the father. What was he supposed to do, lay there and take it?
    Third, why was the girl in the street? Isn't the parent supposed to look after the child, especially a 4 year old?

    There needs to be an investigation then after that it should be up to the DA if charges should be filed. If that police officer acted in self defense then no charges should be filed if they can prove that he did not have to use deadly force then of course charges should and will be filed.

    Try to keep an open mind. Why was a 4 year old in the street. He injured himself to avoid hitting her. She got off with only bruises and scrapes. He got a broken leg and broken shoulder.

    Should read the linked article. The little girl only had brusies and scrapes and did not die. The father and the 18 year old cousin had him on the ground kicking him in the head.

    So. If I was riding a cycle and lost control, that is what he did, and then shot someone I would be charged. The charges may be dropped but I would have been charged until the investigation was over.m I rode for years and the cops story does not wash. The first rule in driving backed up by the law is to have control of your vehicle at all time. Second in a city and state when gun control is such a big issue the police should show even more restraint. You can not use deadly force unless in indisputable fear for your life.

    As for the article I don't trust or pay attention to internet blogs. Show me a real article from a legitimate source and I probably still won't change my opinion that he should have been charged and pending an investigation by outside forces. In Philly there is a civilian review board for this when police are involved. And they are not as corrupt and Chicago cops or politicians

    no posting partial information from a blog and not a reliable source is silly if you want to be taken seriously. BTW why should the cop be treated different than anyone else? You never address that. He lost control of his bike and his ability to deal with the situation.

    Reason has nothing to do with it when someone hurts my baby I would of kicked the crap out of him and if a cousin would proably would of help too ! Since it is not my daughter and he killed her father Why should he get a pass !!!!! And in Chicago with their idoit mayor what his Chicago that won't let Chic/fil/a put in his town--- but murder has increased what is he going to allow?????????

    But I would of been with my grandson I am over protective and I would rather be dead than have him hurt he is everything to me !!!!!! I have only 2 and they are my reason for living. My son is 42 but the other side of the story but he proably took a beating before killing someone.

    An investigation absolutely, but why a federal investigation? Based on a thorough investigation should tell whether he should be charged or not. There are too many unknowns so far to make any kind of a judgement call.

    If the child ran into the street, the driver (any driver) who wasn't speeding and makes an attempt to avoid the child, but is unable should not be charged. If the parent attacks them, they have a right to defend themselves.

    Primary fault: The dad who didn't keep the child out of the street in the first place & the dad who attacked a police officer. Exception only if the officer was driving recklessly while not on call.

    Did all of you read the story..? My mind could change if the rider proves to be drunk or antagonized the 2 that attacked him, but right now IMHO the girl ran into the road and there was nothing the rider could do. I haven't made ANY PART of my permanent mind up on this, we will just have to wait and see what truth comes out.

    I know parents who's child ran into the street and got hit by a car. They were tremendously upset but knew that the driver was not at fault. The kid got the punishment for disobeying in the first place. I don't see the justification in attacking the cop, at least not with the skimpy details.
