Marine Sgt. Given Less Than Honorable Discharge For Anti-Obama Remarks. Fair or Foul?

USMC Sgt. Gary Stein will receive an other than honorable discharge for undermining the chain of command.

The Marines acted after saying Stein stated March 1 on a Facebook page used by Marine meteorologists, "Screw Obama and I will not follow all orders from him."

Stein later clarified that statement, saying he would not follow unlawful orders.

Brig. Gen. Daniel Yoo, the commanding general of the Marine Corps Recruit Depot San Diego, said in a brief statement Wednesday that evidence supported an administrative board's recommendation to discharge Stein.

Tom Umberg, a former Army colonel and military prosecutor, said Stein persisted even after being warned.
"The Marine Corps gave him the opportunity to think about his actions, yet Sgt. Stein continued to undermine the chain of command," said Umberg, who was not involved in Stein's case. "I think his purpose was to leave the Marine Corps in a dramatic fashion in order to begin a career in talk radio or what have you."
Umberg believes the decision to discharge Stein will have limited impact because the vast majority of Marines would never consider such postings.
"I think 99 percent of the soldiers and Marines currently on duty understand the duties of supporting the chain of command and understand their rights of free speech are limited," he said. "To that 1 percent who don't know their rights to free speech are limited once they take the oath, this is a loud and clear message."

    Not all of us, but most of us learn as we go through life, there are times we need to keep quite even though we would like to give our opinion. Sometimes, some of us learn this lesson the hard way as Sgt. Stein has.

    They don't have to follow illegal orders, which is pretty much what he said. They're trying to limit all of our rights to free speech, while their side can say anything.

    You know all of the law suits questioning 0bama's eligibility have been dismissed for LACK of STANDING, and if you don't know what lack of standing means, I suggest you look it up. I never understood how a citizen of this country had no
    standing in these cases, and if a citizen doesn't, doesn't who does?

    I thought the case brought by Col. Lakin would have standing because his whole
    honorable military career was on the line (which to me seemed to mean he had standing). His whole career was flushed and he ended up in Leavenworth
    because he questioned whether or not 0bama was eligible to be Comander-in-Chief
    and if not the laws were illegal. HE SURELY HAD STANDING because his
    military career depended upon the findings. He was sold up the river and never had a chance for a fair trial. 0bama doesn't care who he destroys to keep his secret secret.

    That is why I wonder about "lack of standing".......... we know as citizens
    we don't have standing, but I don't know who would have. I wish some legal eagle would post the answer to that!

    No one is trying to limit your right to free speech, but if you enlist in the United States Military you agree to abide by a code of conduct which Sgt. Stein violated. He has every right to call the President "the enemy" once he is a civilian.

    And no, a soldier is not required to follow an illegal order. Sgt. Stein never claimed he was given an illegal order. Furthermore, it is not for a field soldier to determine whether an order is legal or illegal. He is not an attorney and when you're on a battlefield you don't exactly have time to run to the nearest law library to look it up. Besides which, if he had a problem with any actual order his ONLY course of action was to report to his direct superior officer, not to Facebook.

    They are capable of rational thought on their own, they aren't a Borg society, his only wrongdoing was making it public. Illegal orders are pretty obvious to people that know what their jobs are.

    Well, at least you admit there was wrongdoing. I've never suggested that soldiers aren't entitled to their own opinions, but I think we actually agree that there are legitimate limitations on how those opinions are expressed.

    As for determining whether an order is "illegal", I agree there are some pretty clear cut situations. For instance, when Allan West ordered the men under him to torture an innocent civilian, that was clearly an illegal order and any of those men would have been justified in ignoring the order. But there are other situations where it's not as clear cut - if the CO says "blow up that building over there" it could put our troops' lives in danger if the soldier said "wait, let me first go inside and see if there are civilians in there". In the time it takes him to check, he and his fellows could be killed. And there is CERTAINLY no justification for people like former Lt.Col.Terry Lakin, who decided that any order he received was illegal because he didn't believe the President was born in Honolulu.

    He hasn't told them that and he won't. This President not only understands the Constitution, but respects it. As for what paranoid nutjobs believe, that's their problem. My favorite is Wayne LaPierre, the NRA's resident nutjob in chief, who said "the fact that President Obama has done nothing to try to take everyone's guns away is evidence that President Obama wants to take everyone's guns away." And we're still waiting to see the secret FEMA concentration camps.

    I have absolutely no love or respect for our current president, as I fundamentally disagree with most everything he has done. That said, having served in the military as both an officer and an enlisted person, and having read the account of this mans actions here, I am in full agreement with Corps decision to discharge this man with a less than honorable discharge. He was given every opportunity to adjust his displayed attitude towards the commander in chief, and respect the chain of command. That he didn't doesn't make him heroic, it makes him look like nothing more than a petulant child.

    I served in the USAF . during basic training we were taught that while serving on active duty in uniform we were to avoid political activity,demonstrations, protest etc etc that could possibly detract from the uniform or the branch of the service.

    Under military law, unless the direct order is an illegal order, every soldier is required to obey the orders givin by their commanders. If this Marine said that he believed the orders to be illegal, that would be different. But, he openly stated that he would not follow orders from his Commander in Chief.
