Marine Sgt. Given Less Than Honorable Discharge For Anti-Obama Remarks. Fair or Foul?

USMC Sgt. Gary Stein will receive an other than honorable discharge for undermining the chain of command.

The Marines acted after saying Stein stated March 1 on a Facebook page used by Marine meteorologists, "Screw Obama and I will not follow all orders from him."

Stein later clarified that statement, saying he would not follow unlawful orders.

Brig. Gen. Daniel Yoo, the commanding general of the Marine Corps Recruit Depot San Diego, said in a brief statement Wednesday that evidence supported an administrative board's recommendation to discharge Stein.

Tom Umberg, a former Army colonel and military prosecutor, said Stein persisted even after being warned.
"The Marine Corps gave him the opportunity to think about his actions, yet Sgt. Stein continued to undermine the chain of command," said Umberg, who was not involved in Stein's case. "I think his purpose was to leave the Marine Corps in a dramatic fashion in order to begin a career in talk radio or what have you."
Umberg believes the decision to discharge Stein will have limited impact because the vast majority of Marines would never consider such postings.
"I think 99 percent of the soldiers and Marines currently on duty understand the duties of supporting the chain of command and understand their rights of free speech are limited," he said. "To that 1 percent who don't know their rights to free speech are limited once they take the oath, this is a loud and clear message."

    He wasn't discharged for anti-Obama remarks.

    He was discharged for disobeying orders.

    The policy since the Civil War is not to have Military personnal to be political. A few years ago a couple of service members were tossed from th Military for wearing their Uniforms to a Gay parade. The Sarge should have know the rules he was a NON COM

    Its hard for me to decide on this issue. One hand he was expressing his right to free speech in his off time. Its not like he made those statements while on duty. On the other hand he did disrespect the highest link in our chain of command, The Commander and Chief (even though i dont like it I still have to respect the position). But a lot of amnesty has been given to the left side of this with DADT. Before its repeal, people in the armed forces violated direct orders and policy and appeared in uniform at gay parades, marches, protest and rallies and were granted amnesty. Even allowed to reenlist after being discharged by court martial. They were granted this under the right of "freedom of expression" now a marine has been kicked out because of the same thing.

    One cannot criticize his employer, no matter how despicable he/she may deem that employer and not expect to be fired. Unfortunately, the former Sgt. Stein will have a blot on his record that will follow him for the rest of his life. The short-term punishment is fair. The long-term punishment is not.

    I don't care what a person says on Facebook, but I know for a fact that people have indeed lost their jobs over stupid things they've said while on Facebook. This idiot failed to follow the orders of a direct superior officer. He was treated justly (and very leniently, if you ask me) under military law.

    These young marines are still human and can see what is happening in the Country they love and have promised to protect...It is just as frustrating to them as to us, maybe even more..Seems we Americans are held at a higher standard then the rest of the world..

    I unfortunately had to put down Fair in this case since it is in their code of ethics....not that Barry follows the constitution at all or anything resembling ethics. I feel for the guy....he only put something on his Facebook page. I do understand though...the military can't be partisan.

    The good thing is he is out. who wants to be in the military now ? you will be thrown around by Barry's liberal causes and now that he has an "atrocities czar" they'll be whipping boys for his whims. Barry doesn't appreciate his military.

    I understand what the UCMJ says but if that Marine makes a statement on Facebook and does not declare that He is a Marine, then He is making a statement on his own and not that of a Official Marine statement.

    Obama hates the Military anyway and i know the Secret Service don't much like him either. If I was active Military now, I would feel the same and say the same things too about Obama but use a different name.

    Ahhhhhhhhhhh but now that I am Retired Navy, I can call Obama a Scum Bag and be glad that He was Never, My Commander In chief.
