Man Gets 18 Years in Prison for Hacking Neighbor's WiFi: Fair or Foul?

It used to be you would go to war with your neighbor over whose responsibility it was to mow that thin patch of grass between your houses, or come to blows over that pair of hedge clippers that was "borrowed" and never returned to your shed.

Matt and Bethany Kostolnik wish their neighbor had only been pilfering their garden tools. Instead, Minnesota prosecutors handed down an 18-year prison sentence on Barry Ardolf, their 46-year-old neighbor, who officials said unleashed a reign of cyber-terror on the couple that turned their lives into a living hell.

Described as a "depraved criminal" by prosecutors, Ardolf was found guilty of repeatedly hacking into the Kostolnik's WiFi network in 2009 in an attempt to frame them for child pornography, sexual harassment and for sending threatening e-mails to a number of politicians, including Vice President Joe Biden.

Apparently Ardolf unleashed his cyber war to get revenge on his neighbors after they told police that he'd kissed their 4-year-old son on the lips.

“Barry Ardolf has demonstrated by his conduct that he is a dangerous man. When he became angry at his neighbors, he vented his anger in a bizarre and calculated campaign of terror against them," said prosecutor Timothy Rank. “And he did not wage this campaign in the light of day, but rather used his computer hacking skills to strike at his victims while hiding in the shadows.

Ardolf's attorney called the sentence a lengthy one for a first offender with no criminal record, who must also forfeit his house and computer equipment. An investigation found that Ardolf, the father of two children, had also hijacked other neighbor's WiFi and terrorized them as well.

The defendant turned down a two-year plea deal last year in the Biden e-mail charges and then authorities added a raft of other charges, including identity theft and two child porn allegations, which carry lifetime sex-offender registration requirements. He pleaded guilty to all the charges last year.

Was 18 years too much for the WiFi hijacker?

    neighbors told police that he'd kissed their 4-year-old son on the lips, why wasn't he arrested for lewd conduct with a child ? was he falsely accused by his neighbors so he decided to retaliate? hard to judge without knowing all the facts .

    The question should not be, "Was [18 years] too much for the WiFi hijacker?," but rather "Is [18 years imprisonment, 20 years supervised release, forfeiture to the Government of his (and his children's) paid-for home, worth several hundreds of thousands of dollars, and being characterized --but not charged or convicted-- as pedophile by the Government, and labeled outright as a pedophile by posters on this forum, and harassment or death in prison as a result of that label] too much for the WiFi hijacker?"

    He didn't get 18 years for WiFi theft, he got 18 years for trying to frame his neighbors and terrorizing them. He should be off the streets.

    Apart from hacking into neighbours WiFi and terrorising them, this man stole identities and admitted having child pronography. NO, 18 years was not long enough!!!!!!!

    Simple hacking alone should be punished, but it doesn't warrant an 18 year sentence. However, his malice intent does. He tried to frame them for child porn and other defaming things, so yes, he deserves his punishment.

    Ardolf downloaded Wi-Fi hacking software and spent two weeks cracking the Kostolnik’s WEP encryption. Then he used their own Wi-Fi network to create a fake MySpace page for the husband, where he posted a picture of a pubescent girl having sex with two young boys. Under the “about me” section, he wrote:"

    You don't need to be a hacker to crack WEP. It is notoriously unsecure.

    The article goes on to highlight how the guy sent emails from the genuine Yahoo account of the husband despite the Secret Service finding the "hackers" Comcast account on the headers.

    18 years is excessive. Should he get prison time? Sure. But 18 years is the equivalent of charging someone grand larceny life for stealing a TV. The lawyer next-door accused the guy of sexual assault of his four year old, so the guy commits more crime in response? If you're a murder, you don't go around holding bloody knives. If you're a pedophile, you don't go around spreading child porn.

    You are looking for his actions to make sense... CLearly unbalanced, vindictive, and dangerous he did this to other neighbors as well, thinking he could get people in trouble, reputations ruined, get them investigated by the Secret Service, etc. And he did this to more than one set of neighbors. Just because he did it on a computer doesn't make it less dangerous. If he stole from them, stole identities, had child porn, tried to get people arrested for child porn, and terrorized and assaulted numerous neighbors in person (not on-line) he'd be locked up as a danger. Same thing here.

    Your only argument is harassment and child porn--and the latter isn't even for personal gratification but for, oddly enough, revenge for being accused of being a pedophile.

    He didn't steal anyones identity, he didn't steal from them, and there wasn't any assault. His "danger" is non-existent. People are just afraid because someone was smart enough to read a book, and his neighbors weren't smart enough to lock their virtual doors.

    It was assault. He tried to get them arrested, ruin reputations, and possibly have them jailed. It was an attack, plain and simple, and a planned out one. Premeditated. You can spin it all you want, or try to pretend and attack with a computer isn't as bad as an attack with a knife, but he intentionally and knowingly attacked a family and should be punished for that. "His 'danger' is non-existent"? lol, lol He had a planned attack to get people arrested , fined, and possibly imprisoned, have them lose reputations and jobs, etc. You may not think someone out trying to do that to others as being not being dangerous, but it just isn't so.

    I'm sorry you don't see it, but am thankful the vast majority of others do.

    Speaking of ruining reputations, this neighbor and his wife filed chargers of pedophilia--which went no where. You see, like rape, child abuse is one of those things that don't leave you alone. An allegation is enough to ruin your reputation.

    So, according to your obviously flawed logic, the lawyer should go to jail for libel.

    I am one who really hates bullying and this will set a precedent for many people who are prone to cyber bullying. However he is also guilty of fraud and by trying to frame the couple with child pornography as well as trying to frame them for harassment. Think if he had succeeded with his plot the couple would have done much more time than 18 years.

    Hmm. Ok. So if you had a three year old child. And you caught me; caught me mind you, kissing your child on the lips, and then decided to destroy your entire life via the tool of wifi, you would say, 1 year is all I deserve? And if so, then when I get out, I might not want to just kiss your child. Now I have revenge on my mind (as I did before hence the internet terrorism), and I may even decide now to steal all of your money, ruin your identity, and do unspeakable things to your child. This is how a pedophile with a penchant for vengence might act.

    Now, what do you think? Still just a year?
