Man Fined for Not Having Health Insurance, Files Suit

Michael Merlina was fed up, frustrated and seemingly out of options when he walked into Middlesex Superior Court last week and plunked down $275 for court fees.

With help from a few clerks, Merlina became his own lawyer and filed a lawsuit against the Massachusetts Health Insurance Connector Authority.

The 29-year-old North Reading glazier is fighting the $2,000 state fine for not having health insurance. In 2009, the first year penalties were in place, Merlina paid a $400 fine for him his wife.

This time, he balked.

“It makes no sense to me,” Merlina told The Pulse. “I’m a hard-working, tax-paying guy who can’t afford $800 a month for health insurance, or the $2,000 penalty for not having it, and nobody seems to get this.”

Here in Massachusetts, which requires all residents to have health insurance, some working stiffs like Merlina fall through the cracks.

He’s not one of the 184,000 Massachusetts residents poor enough to qualify for the state’s mostly free health care. Nor is he lucky enough to work for a company that provides insurance.

Merlina installs windows and shower doors at his family’s glass business, which doesn’t offer health insurance to its seven employees. His grandparents and aunts have their health insurance through spouses, but that’s not an option for Merlina, whose wife has been out of work for six months.

“She’s looking, but there’s just not a lot out there,” he said.

He called the Connector when mandatory health insurance went in effect - looking for help finding an affordable plan.

Merlina said the best plan, for two people in their late 20s, would have cost him $800 a month, out of his reach.

Take it all the way to the Supreme Court. I'm sure there's alot of lawyers out there waiting to help you out. We need to get this settled right now, before more Americans are hit with big fines. Liberals are trying to take every dollar they can from the American people. It's called the biggest transfer of wealth in world history, Distribution of our Wealth, by the Communist Party, USA, headed by BO and company.

    When government grows too onerous and dictates individual actions, it is time to replace that government with one that serves at the behest of the individual and his collective fellow citizens. Right there is the crux of it . Most people who have no health insurance cannot afford it otherwise they would have it. To fine people for not having it is so non productive. All it does it put hard working people out on the street or makes them want to join a union. HHMM that may be the driving force in this what do you think.

    I've not heard, when does Government-mandated insurance go into effect, or are we all suppose to already have it? My husband is semi-retired & barely makes any money at his business, and I do contract work, which offers no health insurance. Since me and my husband are older and have pre-existing, and that will require us to take out high risk insurance, it has been estimated that our insurance will take half my salary.

    people in Mass. need to start not getting health insurance and requesting trial by jury. Then, if the jury has any brains, they will find people not-guilty under the fact that these laws are nothing but BS

    I hope he wins his lawsuit, and should move to one of those states that are currently fighting the goverment about getting mandatory insurance.

    Wouldn't that be hilarious! But, no class actions suits! That only makes the lawyers rich! We want to all file separately and clog the judicial system up like a pot of hot grease in the disposal! LMAO.

    Fortunately I have Medicare,Tricare & VA medical so,as far as I know, I'll never have to forced to buy health insurance. If I ever am I'll refuse & accept jail. Since I own nothing of value & am low income what else are they gonna as the can't confiscate anything from me,LOL.

    But jail I could not deal with... I am in between that age and no job and with my Cowboy being sick I am not sure what will become of me...time will tell.

    I know, the reason, I join SH was because of this and it happens that it was the same day, July 22, 2009, we found out about his cancer. I have been fighting ever since!

    My dad suffers from that and is bad as well, thanks dear friend, I am headed home to see the oncologist as he is much worse and can't even dress himself, he is very weak. leaving this am. Prayers for you and God bless you.

    I would fight that too. why should i let the government tell me i need health insurance when i cant even afford it! and to get in trouble for it is ridiculous.

    i plan on doing just that. how can the people for him complain about gov. controling us to much when he is the one trying to control us the most. its his way or we go to jail, isnt this America still?
