He's charged with an unusual crime. A man arrested for a DUI on a horse.
It's a crime that sheriff's deputies in Jessamine County say was a first for them, but the man who's charged in the case says he just as shocked as authorities.

Foul

If a cop did nothing and he fell, he would sue and would win. Sad but true
I dont see a DUI charge, maybe public Intoxication....
"Driving under the influence" is NOT the same as "riding under the influence." Get him for public intoxication, not a "moving violation."
Right, the horse was the designated driver.
If he was riding on the road, then I would have said fair.
Sounds like the Kentucky law is pretty clear. Kentucky law (KRS 189.520) prohibits the operation of a non-motorized vehicle (a vehicle that is not a motor vehicle) while under the influence of intoxicants or substance which may impair a person’s driving ability. That includes, those who are riding horses, bicycles, skateboards, etc.
KRS 189
back at the beginning, in Definitions, a Vehicle is defined as being operated on or across a roadway or highway. He was riding it on a trail, not a roadway.
Same cop knew he had opted not to drive, and that was why he was on foot... talk about foul.
