South Dakota police may have discovered the real issue behind the nation's increasing number of lawn mower-related injuries.
The Associate Press reports that police also wrote him up for littering after he threw his empty beer can in a ditch.
The Daily Republic newspaper reports that 51-year-old Guy Hornedeagle was arrested last week on state Highway 46 after filling up with gas at a service station and allegedly buying a beer.

Judge Peter Hill 2011/06/13 23:15:03Just plain silly+4Sounds silly on the surface but if he was on a public highway then DUI laws should apply. Buying a beer and carrying it in a motor vehicle is not a crime if the can is closed (Not true of an 18 wheeler), but if he threw the empty in a ditch, then he was drinking while driving.





















Bought a beer?? You don't get drunk on one beer. If he was on the road with an unlicensed vehicle while drinking beer I guess he should be pulled over.
Some states include the operation of any vehicle, hence boat drivers and bike riders get busted too.
Don't drink and drive, anything, at any time. It's illegal and you will get arrested.
If I'm driving down the road and a butthead sucking on a Budweiser drives his mower into my lane and I hit him...am I at fault? What are the legal challenges going to be?

This guy was on a motorized vehicle, albeit an illegal one.... Still motorized and the DUI was justified if his BAC was at or above the legal limit. Which I assume it was since he was arrested. If the cop did not take his BAC or it was lower then the legal limit he can fight it in court and win.
one more thing...I'm all for safety, and would never drink while on a lawn mower to begin with, but as long as he stayed on his own property, who are we to tell him he can't have a beer while doing yard work (again, on his own property)...
