The First Amendment of America's Constitution protects religious institutions from government violating their religious doctrine. America also has anti-discrimination laws. What happens when the two values (religious tolerance and non-discrimination) collide? An open society like America creates lots of unexpected situations and creates a lot of room for disagreement -- both within reasonable logic and understanding of the laws.

NEW YORK (AP) — A New York hospital worker and her spouse have filed a lawsuit saying spousal health benefits were denied to the same-sex couple.
The lawsuit filed Tuesday in federal court in Manhattan sought past and future health care benefits and a declaration that the Westchester County couple is entitled to the benefits.
The lawsuit's plaintiffs remained anonymous. Defendants included Empire Blue Cross Blue Shield and St. Joseph's Medical Center. Neither immediately responded to messages for comment. The lawsuit says one of the women works at St. Vincent's Westchester, a division of St. Joseph's. The women's attorney, Randolph McLaughlin, said the lawsuit was unique because it challenges the federal Defense of Marriage Act to obtain health care benefits.
A spokeswoman for Empire says the hospital cannot comment on pending litigation."
The SOLE characteristic that sets them apart, attraction to the same sex, is being used as the basis to fabricate a NEW legal classification which makes it EXTRA.
HOM OSEXUALS are born MAN or WOMAN. Men and Women have NATURAL tendencied TOWARDS each other, opposite sex, as genetic programming will demonstrate.
HOM OSEXUALS act against that programming and want society to validate their ABNORMALITY.
You can pass ALL the laws you want to, that alone will not make the majority accept what a vocal minority is trying to imnpose onto society. A deviant behavior which remains so, despite unthinking and ignorant people trying to pass off the abnormal as normal.

The Catholic institution is protected by the First Amendment to deny whatever they want to anyone they want. Is it wrong? Yes, but they do have legal protection.
Meanwhile this did take place in New York, where gays and lesbians can get married and are recognized by the state, so that does prove to be a small issue in this case. Either way, I don't really care what the outcome is.

Here is more Catholic love: I used to do research for HIV drugs in the 80's. We worked with Mercy hospital. Many of the very ill and dying patients were woman of child-bearing age and needed the experimental drugs the most. The mercy was clearly evident when they disallowed any woman of child-bearing age to enter the study. As if a dying 24 y/o woman who weighed 80lb. would actually conceive let alone engage in intercourse.

Then what's the big deal about just treating patients? Since last I checked that's what HOSPITALS do. If they want to give them a hard time about being gay....do it in church.

Homosexuals can be Catholics. Many people seek to work in a Catholic environment because they prefer the atmosphere, so she has an acceptable reason to work at a Catholic hospital.
My closing statement was trying to say that a lesbian couple shouldn't be treated differently than a straight couple, be it because of religious reasons or because they cannot legally be married in the location they live at, and it's disgusting that some people-- including the Catholic Church-- do. It shouldn't have the right to deny benefits because IT SHOULDN'T HAVE A PROBLEM WITH THIS.

The individuals who voluntarily joined the hospital knowing full well it was a catholic institution new full well that these policies are spelled out in that organizations structure. I would argue they violated any truth in reporting act on their hire and deliberately (and probably with malice afore thought) mislead the human resourcse department of that hospital. No doubt they were asked to sign a covenance stating they fully understood the policies and procedures of the hospital and agreed with the by signing a document stating such.
In a larger sense, we should ask what is their agenda as the willingly mislead, misrepresented,, and made false statements regarding their agreement to an organization. Can the Catholic church countersue the tow lesbians for attempting them to force through judicial fiat beliefs and teachings contrary to their established beliefs? if so, where will that end and what slippery sloap does that take us down as a republic? An individual is suing a Catholic facility, attempting to use the force of law to compel the hospital (and all Catholic employers for that matter) to violate their religious beliefs.
A) Back off, and allow those men who want to marry men, marry men.
B) Allow those women who want to marry women, marry women.
C) Allow those folks who want to abort their babies, abort their babies.
D) In three generations, there will be NO Democrats.

Since this particular hospital that you are claiming do wrong by you is a "church" owned hospital and you ask the me, a "state" official to rule on it, wouldn’t this court be in disagreement of the claim "separation of church and state" if the state, represented by me, the judge, tried to tell the church represented by this hospital, what they can and cannot do?
There are other, none catholic hospitals in the area, aren't there?
You lady are going to get a bill from this court for the costs of the hearing and if you are unable to pay the fees your legal representative is liable to square off the charges or this court will write a request to the bar association to revoke your representative license to practice law in our state.
That would be my ruling in this case. Plain and simple. If you from Tennessee and travel to New York, make sure that you do not have Tennessee approved concealed carry on you because you might get arrested for that in New York.
Religious liberty is guaranteed in the Constitution. The Constitution says absolutely nothing about marriage, "gay" or otherwise.
"Gay marriage" advocates always make the whiny argument that "gay marriage" doesn't affect anyone else's life. This case in New York is just the latest example of the fallacy of that whiny argument.
