Lawmakers Declare Sex Illegal in Florida: Time to Move Out of the State?

This might be one of the best headlines we've seen in a while.

A variety of news sources, from Gawker to The Huffington Post, are reporting that sex has accidentally been banned in Florida in an attempt to outlaw bestiality.

It's only sort of true.

An act relating to sexual activities involving animals; creating s. 828.126, F.S.; providing definitions; prohibiting knowing sexual conduct or sexual contact with an animal; prohibiting specified related activities; providing penalties; providing that the act does not apply to certain husbandry, conformation judging, and veterinary practices; providing an effective date.

Most reports end there, but the Miami Times jumped in to to explain that "animal" has been pre-defined in Chapter 828 of Florida law.

In this chapter, and in every law of the state relating to or in any way affecting animals, the word "animal" shall be held to include every living dumb creature[.]

Obviously the law, which goes into effect in October, would never be enforced as such, but we're not sure this explanation makes things any better.

Presuming that they mean "dumb" as "incapable of human speech", does that mean mute people are considered non-human under Florida law? And does it mean parrots can be considered human?

    "..."animal" shall be held to include every living DUMB creature". So every living creature that cannot speak as a human can. (I'm assuming that mutes are just generally not included in this because they are still a part of the human race.) Doesn't seem like they've outlawed sex to me......

    Quite obvious that the law is to stop sex with non-human animals. Was it so slow a news day that this is actually rates as a question?

    At least Florida is outlawing it. Only 15 states have felony laws against bestiality and 12 have misdemeanor laws. Maybe someone can check the wording in those--it may be illegal to have sex there too. the other 21 states either don't care or think it's too widespread a problem to try to deal with.
