We live in a fundamentally different country from that which existed only days ago. The government now requires that every American purchase health insurance. The Constitution has been attacked, interpreted in a way beyond its original intent. Therefore, we must change it.

Ignoring the will of the majority of the American people, the discouraging experiences of countries with socialized medicine, and the already staggering amount of entitlement debt, President Barack Obama and the congressional Democrats "reformed" health care. Once a nation under a Constitution that restricted government intrusion, we now want government to provide for our "needs" by calling them "rights."

We now ask government to prop up failing businesses, make student loans, guarantee mortgages, build and maintain public housing, financially support state education from preschool though graduate school, fund private research, provide disaster relief and aid, pay "volunteers" and on and on.

Many in our nation happily submit to this bargain. They consider the Big Three entitlements -- Social Security, Medicare and Medicaid -- "rights," their absence unimaginable in a modern "caring" society. It is out of the question to expect people, families and communities to plan for retirement. It is beyond reason to expect medical care, like any other commodity, to follow the laws of supply and demand -- for prices and choices to allocate resources and for competition to drive down prices and improve quality. It is simply too much to expect the compassion, morality and spirituality of humankind to aid those unable to care for themselves.

We ignore history's numerous examples of how good intentions produce bad results. Almost 50 years ago, another "transformative" president used government to launch a War on Poverty. But for many welfare recipients and their families, poverty became "structural." People became dependent on government. After the government finally placed some restrictions on welfare, dependency declined. Much to the surprise of those who denounced welfare reform as cruel, people changed their behavior.

We ignore the experience of price controls. Government can dictate prices, but cannot dictate costs. Price controls result in rationing, drive producers out of business and cause lower quality and less innovation. America, because its citizens enjoyed greater economic freedom, built a superior health care system -- which ObamaCare now threatens to dismantle.

Communism collapsed under the romantic but bankrupt notion of "from each according to his abilities, to each according to his needs." Taking from the productive and giving to the unproductive does damage to the incentive of both parties. European countries -- "social justice" democracies -- produce comparatively few private-sector jobs. Europe suffers from high taxes, choking union agreements that make it virtually impossible to fire unproductive or unneeded workers, and government policies that mandate paid vacations and other job-killing benefits.

Into this statist abyss we willingly jump.

Former Democratic presidential candidate George McGovern left the Senate after 18 years and bought a small business. It went under. He wrote: "(I) wish I had known more firsthand about the concerns and problems of American businesspeople while I was a U.S. senator and later a presidential nominee. ... Legislators and government regulators must more carefully consider the economic and management burdens we have been imposing on U.S. businesses. ... Many businesses ... simply can't pass such costs on to their customers and remain competitive or profitable."

President Obama, like many members of Congress, has little experience in or understanding of the private free-market economy. Obama never started a business, ran one or struggled to meet a payroll. He shows little respect for the hard, long hours people put in to build successful businesses that compete to provide goods and services to customers and that hire people. He believes that unequal outcomes are unjust and that government exists to right this wrong by "spreading the wealth."

If this means telling doctors how to practice, so what? If this means that people will be less likely to improve themselves through education and training in order to get "good" jobs with benefits, so what? If this means we make employers less likely to hire for fear of fines should they fail to offer health insurance, so what? And if the "wealthy" invest less and create fewer jobs because of higher taxes and expensive regulations, so what?

Now what? As many as 39 state legislatures have taken or will take action to block the mandate. Thirteen state attorneys general immediately filed suit, arguing, among other things, that ObamaCare's insurance mandate violates the Constitution's commerce clause. Expect more states to sue. Unfortunately, the Supreme Court broadly interprets the commerce clause -- wildly beyond the intent of the Founders -- to allow just about anything.

So, the Constitution must be changed. It must be amended to make what was once clear absolutely, positively, unavoidably clear. Two-thirds of the states can call for a constitutional convention, where an amendment can be proposed to prohibit the forced purchase of health insurance. Three-fourths of the states could then ratify it.

Implausible? So was ObamaCare.

    It starts out sounding great.....you can keep your current plan until you leave your current job (though prepare for a surchage if it is a "cadillac" plan according to the government), no pre-existing condition denial, no lifetime maximum, and other goodies designed to lull people into seeing a need to keep reading the rest of it.

    This bill is chock full of awards, grants and contracts and other "free" money to be given
    to promote and ensure diversity in the type of future healthcare workers in America and also
    to repay their student loans while in school. Grants and contracts will also be given to entities
    who will educate and train these "disadvantaged" future healthcare workers who
    can only get their tuition paid for IF they agree to work in disadvantaged areas...and the bill
    expressly names the US/Mexican border among other areas such as Indian reservations.

    The bill doesn't address tort reform, it reduces payment to doctors for Medicaid and Medicare patients, cuts coverage for Medicare seniors and will cause premiums to raise significantly for those of us who continue to buy our own coverage.
    And so far the government cannot force doctors into seeing Medicare and Medicaid patients so who will take them? Clinics with foreign doctors...

    And so far the government cannot force doctors into seeing Medicare and Medicaid patients so who will take them? Clinics with foreign doctors and a likely substandard level of care who rush patients in and out as quickly as possible.
    The IRS will have to add thousands more employees to handle the investigations into those who do not get medical coverage but can only do so if these cheats file taxes and get a W-2. So everyone working under the table will not have to pay anything. The bill only says that illegals can not get the Federal tax credits, not that they can't get the reduced health insurance premiums (or even the government subsidized plans).

    It's all about semantics and how things are phrased. The text of the bill is often vague and the language is mind numbing. This, of course on purpose to get most people to quit reading it. I suggest if you do read it, to start from the end and read forward.

    I suspect most of the money saving tactics in this bill will go into the pockets of businessmen who are already adept at taking government money. For most of us in the middle class, this will result in higher Federal income taxes, "surcharges" not labeled taxes, higher insurance premiums and of course health care much worse than what we now experience. It will soon become harder to find a good doctor and get the quality care that we have even now.

    I, in no way, see how any of the things in this bill makes health care better or less expensive for the majority of the American people. This whole thing is just like the global warming scam. A lot of smoke and mirrors to get another way to milk American taxpayers out of their money under the guise of "helping people who cannot afford healthcare on their own".

    Why didn't they just address tort reform to help doctors with malpractice insurance costs, why didn't they just limit the % of profit the insurance companies can make, why don't they let us get our prescriptions filled in Canada where drugs are much much cheaper than here?

    Why did Congress exempt themselves and all federal employees from this "reform" if it is so wonderful?

    I agree with Elder. He's right, though it's nearly impossible to change the constitution these days.

    It sounds good, but then I am not a constitutional lawyer. It needs to make sense to the common guys like me, so we can decide whether we like it or not! It is a little complex, but not like the Health care boondoggle. . .

    I'm not a constitutional lawyer either, though I did take a course in Constitutional Law in law school.. However, if you look at Prof. Barnett's site, federalismamendment.com, he gives a complete explanation of the reasoning behind each of the amendments he proposes in his "Bill of Federalism," unlike the 2,700-page healthcare bill, it is short and concise. The reason there are a number of amendments rather than just one is that, I believe, you are restricted to covering one subject in each amendment. Thus he has an amendment repealing the Sixteenth Amendement (income tax) with a five-year phase-in, and he has an amendment creating term limits for the House and Senate.

    Congress needs to get back in touch with America and we the people. Our founders had no idea there would be "professional politicians" with 2 established political parties battling over their own ideologies rather than representing us as they were elected to. Term limits are needed to limit corruption from special interests crawling into bed with "senior" members in congress. And there should be hell to pay if there isn't a balanced budget. We shouldn't need an amendment requiring a balanced budget, it should be their job.

    That is exactly why a movement like the one proposed by Prof. Barnett is needed! If it gains momentum it will shake Washington to its very foundations.

    "Term limits are needed to limit corruption from special interests crawling into bed with "senior" members in congress." Amen to that, and they are also needed to ensure that each of us is equally represented in congress - when a district keeps sending the same dolts (e.g. Nancy Pelosi and Barney Frank) to congress, they accrue enormous power, far out of proportion to other representatives.

    At the present time with with a government totally filled with people Of Dubious Character at best. I do not believe that this is the proper time to (for lack of a better term) Unlock the front doo to our Constitution. You all do realize that by openning the Constitution for amendment change, or Add On that these Moral less people, specially Smirky, and the rest of thr Demorats can basicly amend the Constitution with anything they like. With the legal bodies of most of our States being as corrupt as those on Capital Hill. An honest attempt on the part of the people the amend the document in order to regain control of our government, could turn into the Nightmares of Nightmares, and by the time it is over they could very well take every freedom, and Right the Constitution protects for us. I just believe that we need to give this possibility some very serious thought before going off half cocked.
    If enough people come together to demand the Amending of the Constitution, than there should be enough people who are now involved in the saving of our way of life. We have two very important elections coming up in not so long of a time. If those same concerned people will stay of the same mind while we get through these elections we can change the entire face of our government, and...

    If what I have said here causes you pause for thought, and you start to believe as I do, that this is possible. You must remember one important FACT. Regardless of what party those on the Hill right now are in. The only difference between any of them is their Sex, and Clothing Size. We have to rid our government of every last one of them as soon as they can be elected out of Office. We can not accept any candidate that party leadership, and the Media try to shove down our throats. Whatever it takes we must put our own trusted candidates in the running.

    I understand the problems with an "open" Constitutional Convention, but Prof. Barnett, a professor of Constitutional Law at the prestigious Georgetown University, has drafted the resolution for the states to convene a Constitutional Convention for the purpose of ratifying the specific set of amendments ("articles") in his "Bill of Federalism":

    "Resolved: First, that Congress shall call a convention, consisting of delegates from the several States selected by procedures established by their respective legislatures, for the purpose of proposing the following articles be added as separate amendments to the Constitution of the United States, each of which shall be valid to all intents and purposes as part of the Constitution when separately ratified by the legislatures of three-fourths of the several States; . . ."

    I can't comment on whether or not this would be effective in closing the convention to those who would propose to change the Constitution in another direction, but apparently Prof. Barnett feels that it would.

    I understand your concern with an "open" constitutional convention, which is the reason Prof. Barnett has drafted the resolution for the states to call for a convention for the purpose of ratifying his specific amendments ("articles"):

    "Resolved: First, that Congress shall call a convention, consisting of delegates from the several States selected by procedures established by their respective legislatures, for the purpose of proposing the following articles be added as separate amendments to the Constitution of the United States, each of which shall be valid to all intents and purposes as part of the Constitution when separately ratified by the legislatures of three-fourths of the several States; . . ."

    I am an attorney and have studied Constitutional Law but don't consider myself an expert. However, Prof. Barnett is a professor of Constitutional Law at the prestigious Georgetown University and I trust that he is correct in his opinion that the convention petitioned for by the states could be limited to considering the specific articles he proposes. On the other hand, if the states are approaching the required number necessary to call the convention (2/3 of the states, or 33), congress might be forced to put the amendments before the states itself, in order to prevent an open convention.

    Although I want to be able to somehow enforce the limits the constitution has set on the federal government, I am a bit leery about another ammendment--especially at this time. While the progressives have such a choke hold on government it just seems to me that we should concentrate of rooting them out. Then and only then should we consider an ammendent to the constitution to prevent such a thing from ever happening again.

    They will never give up, they never do. Each Democratic president appoints more liberal judges and justices who see the Constitution as a living document and who feel free to "interpret" it according to their liberal biases. When a Republican president nominates a new justice, do you know what the Democratic senators ask him? They don't ask him or her if they will follow the Constitution, they ask if they will follow "precedence!" They are worried that conservative, originalist justices will overturn the inroads that liberals have made over the year in expanding the federal government's power beyond what was intended. The only way to return the Constitution to its original meaning is with amendments like those suggested by Prof. Barnett, which would also create term limits.

    True about Republican justice nominees. I wil have to think about the rest, Ken. We still have too many blue states and blue people, even blue pockets in red states. Look at the squabbles that have broken out internally in state governments over whether to join in challenges to the current health care reform.

    Constitutional ammendments are not to be taken lightly, nor are they easy. Remember the nuttiness surrounding the failed equal rights ammendment push back in the '80's?
