Justice Scalia: Obama’s Immigration Stance ‘Boggles the Mind’

Justice Antonin Scalia took President Barack Obama to task in a scathing 22-page dissent to Monday’s Supreme Court decision striking down the majority of Arizona’s anti-illegal immigration law, calling Obama’s failure to enforce parts of the Immigration Act “mind boggling.”

“The president said at a news conference that the new program is ‘the right thing to do’ in light of Congress’s failure to pass the administration’s proposed revision of the Immigration Act,” Scalia wrote in his dissent. “Perhaps it is, though Arizona may not think so. But to say, as the Court does, that Arizona contradicts federal law by enforcing applications of the Immigration Act that the President declines to enforce boggles the mind.”

Scalia argued that the entire Arizona immigration law should have been upheld because the state is “entitled” to craft its own immigration policy.

The majority of the justices ruled Monday that Arizona’s law is unconstitutional with the exception of the provision that allows police officers to ask about an individual’s immigration status if they are pulled over during a traffic stop.

    If the federal government won't enforce the laws they are charged by Congress and previous administrations to do, it can only lead one to assume they are either incompetent, or hiding the fact they are complicit in the illegal transport of illegal drugs and participating in white slavery.
    With that said, that would lead one to think this administration is committing high crimes, an impeachable offense. Since no one in the Senate has the fortitude to pursue this, we can only hope it is because they only want this administration to disappear without having the cost and battle of a trial.

    I fully agree with what the Justice had to say. I have written Congress asking them to make E-verify the law of the land and give every business a certain amount of time to check ea and every employee and before they hire someone. I also want it to be the law that they mush inform the person of their status just in case E-verify makes a mistake. The system is nearly perfect but not perfect. The people that run it say they are ready for use.

    It has never made sense to me that a state cannot enforce federal law within its borders, which is exactly what the majority on the Supreme Court has ruled. Apparently the basis is essentially that the naturalization laws cannot be enforced by a state because the President handles foreign policy. Why enforcing the Naturalization law assigned to Congress as one of its powers is considered primarily a foreign policy prerogative of the President is mind-boggling. But, it is consistent with the ever-growing expansion of the powers of the President and the federal government, and the ever-decreasing powers of the state government's in anything even remotely touching upon federal powers.

    How very sad. Within three hours Obama undermined the one piece of this law that the Justices upheld. He took away the Homeland security data base for crimminal background checks, and he set up a hotline for anyone claiming to have been racial profiled. I guess all the drugs the mule traffic gangs are bringing over are fine, the Mexican drug gangs transporting them with machine guns is fine, the areas on our side of the border that are too dangerous for Americans to go are fine, and the people coming across the border from terrorist countries and organizations are fine

    At what point does Az get to protect itself? When is the federal government going to protect border states from the invasion coming across our border? There are ranchers and small towns close to the border that are living in fear, and isn't that what our federal government is supposed to protect us from?

    Now Arizonia is left defenseless. Obama not only stepped all over them in this lawsuit, but is vindictively cutting thier throat in victory. Our president and Holder are so full of themselves, and why not, not even the Supreme Court would stand up to them on behalf of Americans
