Is It OK to Seize Unused Gift Cards After Two Years? (New Jersey Plans to)

Most retailers these days don't have expiration dates on their gift cards, a blessing to consumers who are slow to spend their credit. But soon New Jersey residents won't have that luxury. A law passed in 2010 will go into effect this year and allow the state's Department of Treasury to take the money from gift cards, travelers' checks, and money orders that haven't been used up within two years of purchase. American Express has already pulled gift card sales from the state.

According to NJ.com, the state projected it could have seized $79 million in revenue in 2011 from the law, but they needed to collect buyer ZIP codes to enforce the law, and that lead to lawsuits and a suspension of ZIP code collection. Treasury spokesman Andy Pratt said, "We're working with industry groups to determine the best way to have merchants collect ZIP codes. We're not requiring it until we come up with a policy that is uniform and as least onerous as possible." Does this gift card idea sound like a good way to generate revenue -- or a just a slimy way for the government to take some cash?

    And this is the exact problem with government that I have been arguing "the state projected it could have seized $79 million in revenue" please note the word "seized" which means to take by force

    ONLY IF those terms are either stated on the card, in the cards terms of service or agreement. AND/OR, if its governed by the laws of that state. Because, for one.. "we don't discuss other peoples' finances" and two what form of $$ is on the card? Assests, promises, deals, trades, bonds, part of some deficit? WHO KNOWS? But its Not Cash.!

    this just in...how long can person hold gift $$ before they have to report it as income...hmmm..that probably didnt make sense, just lost my train of thought. sorry....ok got it. those gift cards probably have to be liqiudated before anyone in the original deal gets paid. Like savings bonds. Makes sense to me. But I did just make all that up., fyi. 1234

    NO, and gift certificates should never have expiration dates either....after all, they are just like cash, no matter how they were originally paid for.....it doesn't make any sense....and the argument that some retailers use, that prices have gone up,,,,doesn't wash either, so what, the consumer pays the difference in the item and the tax asoiciated
    anyway, so it should not matter to the retailer when it is used.....

    Many businesses will start to follow AmEx. This is a ridiculous theft of consumer funds. I hope all businesses bathe sale of gift cards. The change in the zip code collection process will cost issuers millions and their governor wants to be President or. Vice President that sounds like some real conservative values there. Way to go Chris Christie

    Just because a person doesn't need to use the card immediately doesn't give the state the authority to claim it as theirs! They steal enough from our paychecks they don't need to steal this as well!

    How about this, rather than STEALING the money pass a law requiring the return of the money to the owner, or the purchaser, or their next of kin. 79 million would do wonders to the micro economy and you would have to steal, graft and bribe to get what would be left after the lawsuits back into the economy!

    HELL NO!!!! The gift card is the same as cash, the retailer received the cash without selling any merchandise so how is it going to be legal to take away the means of obtaining the merchandise??? Sounds to me like gift card giving will cease and desist and people will go back to the good old green stuff. Then retailers will take the hit because they are no longer going to be able to collect money WITHOUT the sell of goods. SMDH!!!
