Is everyone clear that The Supreme Court ruling gives each state the option not to implement Obamacare?

william raggett 2012/07/01 14:20:24
People seem to be confused here. It is not nationally mandated that every state has to implement Obamacare. Every state has the option to opt out and can not be penalized for doing so

State Officials that choose to NOT implement the Affordable Health Care Act will have to explain to THEIR citizens why they cannot receive the following:

Simplified, the bill does a few big things:

Prevents insurance companies from denying customers for pre-existing conditions.
Allows young adults to stay on their parent's insurance until age 26.
Limits age-rating, or charging premiums several times higher for older customers.
Eliminates lifetime insurance caps and restricts annual limits.
Restricts how much insurance companies can spend on non-medical costs (overhead).
Mandates that everyone acquire health insurance by 2014 or face a tax, offering subsidies or Medicaid for those who can't afford it.

Here's what's important: According to the Census Bureau, 49.9 million Americans didn't have health insurance in 2009. Part of that is due to the weak economy; most of those without health insurance have a very low or nonexistent income. But a lot is due to soaring costs that have put insurance out of reach for the gainfully employed. According to the Kaiser Family Foundation, 69% of businesses offered workers health insurance in 2000. By 2009, that number had dropped to 60%. It's almost certainly lower today. Our health-care system doesn't work for far too many Americans, which explains why the the provisions above a pretty poplular.

Each state can opt out of the Medicaid expansion, but not the rest of the bill, as I understand it.

I don't think anyone is clear on any part of Obamacare. We failed to read the bill before we passed it.

Because the people screaming and whining about it obviously aren't smart enough to research what they're ranting about. not very surprising both sides have loads of idiots who like to scream for attention.

Until 2014.... that is the partial truth. Other aspects of the entire plan weren't ruled on by the court and more challenges will arise.

The states are supposed to have their 'exchanges' up and running by then but many Governors have already said they will do absolutely nothing before the 2012 election and possibly beyond.

The forced Medicaid expansion was thrown out by the court and specifically said that the Federal govt. may NOT penalize states by withholding any current Medicaid funds because they choose to opt out of the plan.

The State part is whether they elect to expand Medicaid for low income people. The mandate is the part the Supreme ruling threw out, making it an option for a State to participate (without penalty).

No, it is not clear to most of us. I understand that all Americans must purchase or have government approved HC or be fined through the IRS. We are still trying to figure this out, so if you have more information it will be appreciated. Thanks.

What the Supreme court ruled was that each state is sovereign and can choose rather or not to implement Obamacare and the Feds can not take any federal funding from them if they choose not to. It also ruled that it is unconstitutional to force anyone to buy something they don't want so the goverment can not impose a penalty for not having health insurance. So each state that decides to implement Obamacare will also implement a tax on those who don't have health insurance since they can't impose a penalty but can legally impose a tax

Then why are all the libs celebrating as if they won a big Supreme Court decision? Liberals right now on "This Week" are so happy that EVERYONE will be covered by this massive tax. Obamacare cuts medicare and raises taxes on the middle class. Another Obama lie.

They're on a campaign to fool the public just as they have since the first draft of HR 3200 rolled of the presses. They have to keep the misinformation flowing until November and suppress any facts about what the law really does.

The pre-existing condition provision is only for children right now and the adult part doesn't kick in until 2014, as well as insurance companies canceling policies on those who become sick.

The meat & potatoes of this stretch out until 2017 before implementation and the libs are disparately trying to make people believe the entire thing survived and is already in effect.

I honestly don't know that answer. I didn't see it as any great victory from what I read. The tax will effect the middle class mostly that is true but only those not insured but on the other hand Obamacare forces buisnesses to provide health insurance so in effect less individuals will be taxed and more people will have health insurance.
