If someone unknowingly cashed a Fake cashiers check what would happen if they gave them the money?

    This is a popular scam actually, and almost happened to me. Common on Craigslist. These scammers reply for a service you offer, always overseas so you can't meet face to face. They will take time for details and will patiently drag the discourse out over months. They say them or a relative will be coming over to get said service while they're here and that they'll pay in advance. They send you a fake cashier's check for about $1000-2000 more than what you charged, asking to forward the remainder back to them, offering some sophisticated story why it needs to be done this way.
    When you cash the fake one, you're now sending very real money to them. A few days later the bank comes back saying it was a fake and now you on the hook for all of it.

    I would presume the bank at which the check was cashed could sue the recipient civilly to try and get back the money if he refused to return it.
