SCOTUS ruled that the mandate could survive as a tax, but Obama still insists (even after the ruling) that the mandate is NOT a tax, therefore if I were the States, I would challenge Obama to prove that it is not a tax, then ignore the mandate because it does not fit the definition of the ruling.

We can turn this lemon into lemonade by proving Obama and the liberals in Congress lied every step of the way in passing Obamacare.

Since the libs originated the bill in the Senate, citing the “commerce clause” for justification, logically the mandate does not satisfy the exception in the ruling, stating it being valid as a tax.

Have to say,,,,,,,initially, everyone thought he rode us down the rapids on a raft....but maybe there is more to this....Now that it is a tax....maybe that negates the ruling.....as they weren't
ruling on a TAX......and Roberts changed the rules..... Dunno....Just know for sure it has
motivated us...in a big way....... and that is a good thing. Great comment...thanks.

I have often wondered about the constitutionality of the health care mess because of the obscure rule some representative came up with to avoid the constitutional procedure. There was no input allowed from the Republicans so it is not actually representative of we, the people.

It is up to the electorate to smarten up and get rid of the current regime and get a group of leaders that can repeal the tax and let the healthcare mess rot on the vine. If people quit looking for the free lunch and face reality this sorry mess can be put behind us with the sweep of a pen.

Nope, it can only be invalid if 1. it is applied and a person pays it; 2. It is challenged in the court system, 3. it goes to the SC and is declared unconstitutional. It could be challenged as a direct tax or questioning whether Congress can tax people for not doing something or whether Congress can tax behavior.

scuse me the Constitution says that Tax Proposals HAVE TO BE MADE IN THE HOUSE....(shall I tell you chapter and verse). No Court Challenges It is on paper and the ink has dried.

House bill had it as a tax - Senate bill, theoretically and so stated by Reid, was an enhancement/amended /change of House bill (as with all bills) - this is where verbiage was changed to a "penalty", voted on and passed back to the House. And the rest is history.

Does not matter what we think, this is what it is.
