Harvard Prof. Alan Dershowitz: Zimmerman Arrest Affidavit ‘Irresponsible And Unethical’

Dershowitz called the affidavit justifying Zimmerman’s arrest “not only thin, it’s irresponsible.” He went on to criticize the decision to charge Zimmerman for second degree murder by special prosecutor Angela Cory as being politically motivated.

“You’ve seen the affidavit of probable cause. What do you make of it,” Smerconish asked. “It won’t suffice,” Dershowitz replied without hesitation.

“Most affidavits of probable cause are very thin. This is so thin that it won’t make it past a judge on a second degree murder charge,” Dershowitz said. “There’s simply nothing in there that would justify second degree murder.”

Dershowitz said that the elements that would constitute that crime are non-existent in the affidavit. “It’s not only thin, it’s irresponsible,” said Dershowitz.

Dershowitz went on to strongly criticize Cory’s decision to move forward with the case against Zimmerman. “I think what you have here is an elected public official who made a campaign speech last night for reelection when she gave her presentation and overcharged. This case will not – if the evidence is no stronger than what appears in the probable cause affidavit – this case will result in an acquittal.”

Smerconish identified the total lack of any mention of the supposed fight that occurred between Martin and Zimmerman prior to Martin being shot. He said he was disappointed that he did not see any mention of that conflict that led to Martin’s murder.

“But it’s worse than that,” said Dershowitz. “It’s irresponsible and unethical in not including material that favors the defendant.”

“This affidavit does not even make it to probable cause,” Dershowitz concluded. “everything in the affidavit is completely consistent with a defense of self-defense. Everything.”

    I would not doubt one bit that the prosecutor overcharged Zimmerman knowing it would more than likely be thrown out. She gets her bogus campaign points and then the lynch mob will be threatening and or rioting in the streets and Holder will rides in and go after him with some kind of trumped up civil rights charge.

    That's what I was thinking while I was watching. But there were some good ol' boys involved and they appeared legitimate.

    You never know what money will buy.

    These people got the still up and running, I can't swear I saw them produce white lightning though, I lost interest and moved on.

    FINALLY , a Harvard educated judge with CAJONES !
    I think that the arrest on 2nd. Degree Murder charges was about TWO things . One was to prevent Race Riots in Florida ( because of Race-Baiters and the M.S.M. ) - AND - for Zimmermans own protection ( NOTE* that Zimmerman DID NOT request bail ) . His life and the lives of his family are on the line here .

    Exactly, Zimmerman has cooperated with the cops and the judicial authorities all the way. He even maintained contact with the cops and local DA while not in contact with his former (worthless) attorneys.

    What Prof. Dershowitz is saying is not that Zimmerman should not have been charged, but that Prosecutor Corey did not prepare the charges correctly, that she omitted or does not have data that would make her case.

    He claimed the probable cause affidavit wouldn't 'make it past a judge', which I noted above, it already did. The affidavit may be paper-thin for second-degree murder but it was enough for this judge to send it to an arraignment. I do agree that it will be difficult to prove the second-degree murder occurred.

    Her news conference sounded just like a campaign speech and nothing more and I believe even a man slaughter charge would end in acquittal, self defense will undoubtedly be the final outcome of this trial.

So because he is now teaching law at Harvard that makes him less smart than when he was a flag-carrying democrat and radical of the '60s? Or he is less smart now because he doesn't think the evidence supports that charging of second degree murder? Smart when he's agreeing and leading the way on the leftist stuff and stupid when he's agreeing or leading the way on the right or has a difference of opinion with what the left thinks? Stated one more way - he's smart when he agrees with what I think and dumb when he doesn't?

    I totally concur after reading the affidavit. Cory could hardly contain her delight in being in the spotlight when announcing the charges. Her posturing and smiling was sickening and it reminded me of a pep speech by a Chitown pollie.

    This case reminds me of how Islam uses threats of terrorist acts to control
    behaviour and public opininion. Or even more basic, the brat throwing a temper tantrum

    With this action the State of Florida has accomplished three things:

    1) They have avoided a race war promoted by the Obama administration.
    2) They fed red meat to the blood thirsty radical left with the 2nd Degree Murder Charge.
    3) They have given Zimmerman a get out of jail free card with the 2nd Degree Murder Charge.

    Pretty good strategy I think, State of Florida my hat is off to you...

    State of Florida did not cause this tragedy but they have a responsibilty to protect the other citizens of the State from this mob mentality...

    To allow this tragedy to elevate in to a race war would be far more lives gone and many more ruined.
