Gov. Scott Walker Says Arrest the Wisconsin Democrats: Is That Fair?

While Wisconsin Gov. Scott Walker and Republicans continue to move toward ending the bargaining rights of public workers, the state senate GOP has decided on what they need to do to finally pass the bill: arrest Democratic senators.

Democrats are now in the minority of the legislature, but in the state senate, the chamber needs a quorum to have a vote. Republicans are short one legislator, which is why the Democrats have been missing the last two weeks. Republicans have been less than amused, so on Thursday they ordered the "forcible detention" of the 14 missing Democrats, according to the Wisconsin State Journal.

"They have pushed us to the edge of a constitutional crisis," Senate Majority Leader Scott Fitzgerald told the Journal.

But the decision might not be legal. The laws governing the legislature say that the senate can enforce its rules, which includes allowing each house to "compel the attendance of absent members." But, according to the Journal, the state constitution bans the arrest of legislators while in session unless they're suspected of committing felonies, treason or breach of the peace.

"The Republicans have gone around the bend," Democrat Sen. Chris Larson told the Journal. "They've just increased their bullying tactics and are producing an even greater divide in our state."

Believed to be in Illinois, the 14 Democrats were held in contempt for their absence. The resolution dictates that the senate sergeant at arms use force and enlist the help of law enforcement to bring missing members to the capitol. This decision does not include extradition from another state.

    I believe those 14 are in breach of the peace. Their absence along with the actions of protesters breached the peace.

    LOL ! no they do not have the right to protest when they were suppose to be teaching the children..but then again i can see your point, enuff of them were doing such a poor job their not teaching the Wis children was better then them in the class room.

    If they can be arrested, they should be. I didn't know any member of Congress, at the federal or state level could just run away and hide to prevent a bill from being voted on. Isn't there something illegal about this? If something is not done about them doing this. You can expect to see alot more of this sort of behavior whenever a bill comes up that one side or the other does not want to vote on in order to prevent it's passing.

    Now I see votes occuring all the time. They say Yay or Nay and absent. So what does that mean? Sometimes officials don't vote on certain things. If some politicians are not present to vote on things it still goes through to the next step. Seems like it is the same here, Those 14 Democrats opted not to be there for the vote, so therefore they are Absent. The vote should have gone on without them.

    These Democrats begged to be elected to do the business of those that voted for them, but when they were about to lose the debate they ran away. What if police, firemen, and armed forces personel did the same when things weren't going in their favor?

    These Democrats told a WSJ reporter that they would be returning this week, then abruptly changed their minds. How fair is that?

    If they don't want to do their jobs they should RESIGN IMMEDIATELY so someone who WILL DO THE JOB can be put in place. As they also refuse to resign then I say MAKE EVERY ONE OF THOSE FAUX SENATORS DO THE PERP WALK!

    Damn shame that there are no longer stocks in use in America. ;o)

    Fair, but not effective. The voters in WI should recall one of the cowards, establish a quarum and move on with government business. Leave the rest of the cowards to hide out in Illinois. Illinois is used to that type of politician. After all, it is where Obama go started.

    Close to 60% of Wisconsin voters disapprove of Walker, he is probably the one who will be recalled.
    Many people especially oppose Section 44.16.896 of the bill, which has been introduced to please Walker's masters, the notorious Koch brothers.

    That's BS, the voters of Wisconsin voted Walker in on the platform that he was going to get cut spending in his state and they elected him. Now that he is doing it , they have a problem. They must understand that in order to get spending under control he had to start somewhere. The public unions were as good a place as any to start. Lavish benefits and pay are the hallmark difference between private and public sector employees. Private sector employees that are unionized have bargaining power. But they can't ask for more than the company can afford or they will be negotiating themselves out of a job. Public sector employees are bargaining with the very politicians that they helped get into office. So it was in those officials best interest to give whatever the unions asked for in order to stay in office. It was bound to catch up to them eventually. Now is that time when it did. They have been riding the gravy train long enough and it has arrived at it's first and only stop. Taxpayers , whether they are union or not are footing the bill for these benefits and the US is broke at the federal level and state level as well.

    Steps need to be taken and everyone wants them to be taken so long as it affects the other guy and not them.

    I'm sorry and I'm pretty fairminded, but the democrats have been doing much wrong since Obama has become president. They have passed bills that none of us knew about, hidden behind closed doors, willing to pass laws that are immoral, etc, etc...and now are again, not only pretending the constitution doesn't exist, but running from their duties, their jobs the American people are paying then to do. I'd have to say, yes they should be put in Jail for quit a while. If we did these things on a job, we'd be fired. Are they REALLY any better than we are? They are human beings just like the rest of us and they too have to go by laws as the rest of us do. THEY ARE NOT GODS!

    I am not sorry. I am not a Democrat and I am not a GOP either. I believe that, at some secret level, unseen by us, they are all in cahoots together and are just playing the old good cop bad cop routine. What I can't figure out is why nobody cares about the part of this bill that all of this grand standing is designed to cover up. The part that allows them to sell off of state owned infrastructure with no oversight what so ever. Does anybody here know why Governor Walker needs to bypass all normal oversight routinely done in such sales. The way it is written he could sell a billion dollar power plant for one dollar and it would automatically be considered in "the best interest of the state" Oversights are in place for very good reasons!! In our country our whole government was designed by our very wise fore fathers, with checks and balances built in so no one person or group is ever vested with enough power to take over with absolute power. Just because Mr. Walker has been Governor for a little while shouldn't mean that he and he alone can decide what is best for the State. He is not the king. In our form of rule one man should never have that much authority 'cept in extreme cases of emergency, where any delay would cause gross mayhem ore multiple casualties. The way it is worded is like they already know people of the state would not like it and would be powerless to do anything about it.

    I know where you're coming from and know you're right about some things, but right now we're dealing with something that has gone beyond the caring of our American people. In many of Washington's eyes, we the people don't count. Only they count and only they feel they have the right to control our lives with their selfish ideas. Our forfathers would really roll over in their graves if they saw what was going on here. If they were here they would have stopped it quick, without it going as far as it has, but there are people that really don't see what truly is going on. And the sad part is, when they do, there will be no way to stop it. Drastic measures have to be taken, and quickley. We need heros... one's that are willing to close their ears to kick backs, you rub my back and I'll rub yours mentality. George, we're not only fighting as a people against those in Washingtom, but we're in a battle between good and evil. We're also fighting a spiritual war. We need God more than ever. And when He steps in to help us, we need to keep him in, never leave him out again. We also need to keep an eye on our towns and cities, as the muslums too have their ideas and many [ not all ] hate our christians ways and want to change us.

By hating so so much we are pushing God further away, instead of inviting him in. By allowing these crooks and liars to keep us fighting each other, everybody here are contributing to OUR own defeat. Just because some crooked politician says he is a Christian, calls abortion murder and complains about prayer in schools, doesn't make it so. Jesus said that many would come in his name and by the fruit they produce we would know the truth. No good fruit can come from hate. Many good, wonderful, people are on both sides, yet these phony grandstanding, script following, rotten fruit making and Christian pretending snake oil peddling people that we keep voting in office continue to use phony theatrics to keep us fighting each other. They continue to trick us into hating each other and pushing God away, further and further, which allows the hate to grow bigger and bigger.Criticize either side and instead of looking at it objectively, both sides just respond by slinging mud at the other. Both sides have problems, very serious ones, which will never get fixed just by slinging mud at each other. Jesus said to remove the log from your own eye before you comment...

Here both sides have created this budget crisis to allow them to personally profit by "stealing" state assets and selling them for nothing above boards, then later splitting up all the under the table kick backs they receive. Both sides are creating a big show like professional wrestling and we are following right along and doing just what they want. Idiots are easily strayed but I see no idiots here only lots of people completely blinded by their own extreme bias. All should be more open minded and quit trying to make their side look better just by making the other side look bad. We all need to look at our own side and clean it up, which would be plenty to keep us all way too busy to sling mud at each other. Then If we are criticized we should thank each other and then look into it, fix it if it's broken and then answer the other side with whether it was a problem or not because folks we are losing and losing bad right now and will continue to lose no matter which side we follow because in reality they are both the same side with pretend differences to lead us sheep to nowhere.

    Thank you, George. Yep, you're right...we need to let go and let God. He can and will fight our battles for us if we just let him,and you're right again...the hate has to stop. God knows what is going on and He said He will take care of things, we need to just pray about it and do our best. And too, since we can't reads minds, we'll have to pray that those that are elected do what's right and if they don't, that too will be in Gods hands. Thank you so much George for responding back as you have helped me understand something that God has wanted me to see for a long time.     I'm actually not sure if arrest is the solution. (The poll needs an undecided option). Recall and removal from office is a much better answer. But I wouldn't shed any tears if Wisconsin police officers paid these clowns a visit.
