Many children have gay/lesbian parents and should be allowed to speak about it if they so choose. 5th graders are plenty old enough to express how they feel about it...
My ex sister in law and her wife have three adopted children (two sons and a daughter). They know they have two mothers and are VERY well adjusted children. All three are precocious and absolutely wonderful young people (ranging in age from about 5 to 13). They have as much a right to speak freely about their family as anyone else - and they do. They are all socially aware of I'm proud to be their aunt.
Kudos to this young 5th grade boy for having the courage to speak out and shame on the school for banning his speech.

If he is doing it in the middle of a classroom or playground in a random way, then fair, but only if it is causing disruption to learning.
