Representative Steven King (R-IA) said on Friday that he would go to court to enjoin Obama's "DREAM Executive Order" from taking effect. Unless and until Congress
passes anything like the DREAM Act, Obama has no right to put it into
effect by Executive Order. So says
King. He also said he would challenge the President by himself, whether
anyone else in Congress joined him or not. (See stories in WND and Newsmax.)

King’s problem with this Executive Order goes far beyond what it does. No
President, nor any State Governor or other executive, has the power to
do what he pleases without checking with his respective legislature.
King said he would act

before Obama has a chance to do even more damage to the Constitution.

King has done this before. Then-Governor Tom Vilsack signed an
Executive Order in 1999, having to do with hiring discrimination in
State government offices. King sued him, and won. A judge said that
Vilsack exceeded his authority with that order. King will rely on his
experience in suing Obama. His lawyers are looking now into:

Where to sue, and
Whether he has standing.

This is the first time in recent memory that anyone in Congress has
challenged a Presidential Executive Order. Without challenges like this,
Presidents have for decades seemed to make new law with them and get
away with it. Now, at last, a court might decide whether a President may
do that, and how far he may go.

Steve King is one of the most divisive members in Congress, and a smart mouth with his hyperbolic rhetoric. He once said terrorists would be “dancing in the streets” if President Obama won the 2008 election. He claimed that Congress was to blame for a suicidal pilot who crashed his plane into an Internal Revenue Service office in 2010 because lawmakers failed to follow King’s advice to abolish the tax agency. And King, a founding member of the House Tea Party Caucus, once called disgraced former senator Joseph McCarthy (R-Wis.) “a great American hero.” King was the only one of 535 members of Congress in 2009 to vote against a plaque recognizing slaves who helped build the Capitol. King thinks he can do many things he can't.

Facing a long, steep climb back to majority status in the House, Democrats think they finally have an opponent who could beat King — former Iowa first lady Christie Vilsack, whose husband, Tom, served two terms as governor and is now Obama’s agriculture secretary. Kings's district has been changed with more independents and less Republicans than prior.

the use of the XO has been fairly common to skirt constitutional authority.
There are many XO's on the books that need to be repealed including this one. The intent was for "some discretionary powers" Where the gray area exists is "how does one define "discretionary".

Personally I think wholesale amnesty of a million plus individuals is beyond that definition.

Without Congress, a president can't make laws, per se, with which citizens must comply.

The "wholesale amnesty of a million plus individuals," however, is exactly within the power of the president to grant if he so chooses.

Seems to me our ancestors had a bloody war to free themselves and us from rule by decree. Executive orders should only be used for an emergency and valid only until congress has time to act on such emergency. A history of abuse does not justify continued abuse.

Obama campaigned against EO's. He said they "are no way to lead", yet his EO's are the most outrageous that I have seen in my lifetime.

His cap and trade failed, so his EPA "crucifies" our energy industry.
His Dream Act failed so he implemented a program to overturn deportation orders by EO.

I have sent letters to my reps, Gov and SOS to fight against Dear Leaders fiat.
Support Rep King in his lawsuit, perhaps all of the states can get waivers to ignore the order. Force the deportation of those who have already been caught and were waiting deportation, there's a few million more where they came from.

#1 should be to empty our jails of these criminals and charge Mexico (or whatever homeland they hail from) by the day for taking care of their citizens. Illegal aliens are not undocumented, they're documents are all in the motherlands, aka where they send their hard earned cash. So charge each nation with the bills, deduct it from their US financial aid!

While I DO NOT agree with Obama's Executiive order on the dream act, I DO think that the republicans have beenn STONEWALLING everything that he wants to do to help this country. Mitch Miconnell said from day one of Obama taking office that it was the republican party's job to make him "a one-term president"

WHERE is THAT helping this country?

IMHO I tghink that "the dream act" should put AMERICAN CITIZENS FIRST.

While I'm sure this is a colossal waste of time I'm not convinced EOs are a good thing. Bush certainly abused the power but I don't have a problem with this one in particular as congress has again shown it's inability to get anything done.
Not in this republic??
EOs have been used for over 200 years. Good luck with that

Clearly, the President does not like the fact that the Representative Republic he is a "citizen" of has denied him his dictatorial powers. Therefore, he is challenging them to deny him this "right"! I support Represntative King 1000%!

There is already a law preventing the President from setting immigration p[olicy. It is called the Constitution! It is not a liberal trait to go to court to prevent the President from usurping the duties of Congress! It is the proper channel for action against the President!
