Ashley Moser, has suffered a double heartbreaking tragedy, as a result of James Holmes evil shooting spree. One week after losing her 6 year old daughter Veronica in the shooting spree that claimed at least a dozen lives, her family has now confirmed that she lost the baby she was carrying. Ashley Moser was 8 weeks into her pregnancy.

Ashley Moser almost died from her critical injuries to her abdomen and neck and her family had waited to give her the devastating news that her little girl Veronica had died as a result of injuries sustained in the gruesome slaying. The Aurora Medical Center released this statement:

''Ashley Moser is recovering from an additional surgery she had this morning. Tragically, the extreme trauma she sustained also caused a miscarriage."

Should the baby that she was carrying be counted in the death toll?

First, the miscarriage wouldn't have happened otherwise.

Second, the Bible has something to say about two guys fighting, and hurting a pregnant woman in the process and causing a miscarriage.

Being killed and having your death ignored is even worse than just being killed.

I love this question because you end up being a heartless monster no matter what your answer is.

If you choose yes, then you are obviously Pro-Life and thus a heartless, sexist, monster who hates women's rights
If you choose no, then you are obviously Pro-Choice and thus a heartless murderer of children who hates family values.
If I choose "I'm not sure" then it's just not true....

What does one do in this day and age?

and the name calling begins....Where does that leave you? I don't know, unless you are saying that you are not sure. Maybe you are saying that there should be a fourth choice that says "I just don't care". That would be fine, I guess, but then why are you answering this type of question?

But of course unborn babies are not considered babies until the time of their first breath...Which is why people don't think they kill a baby when they have an abortion, which is why legally they can't count it in the death toll since it wasn't a human being in legal terms yet.

Actually 36 states carry penalties for causing miscarriages during the commission of a crime.

While I agree that the child should be considered a victim, and that life is life, Conner's law only applies to federal crimes. It will be interesting to see what he is charged with. If it is prosecuted at the state level Conner's law does not apply. Conner's law only applies to one of 61 listed federal offenses. If he isn't charged with one of those it won't apply.

It fits. This baby was in Utreo Connor law was named Connors law because of Connor Peterson that was killed due to his mother being killed in California. Murder is still murder.

I know what Conner's law is. it only applies to babies in utero that are killed in the commission of certain federal crimes. I didn't look at the link, I am a criminal justice major. I think your link will explain it better than I can. Connor's law apples to miscarriages that are cause during the commission of one of 61 federal offenses. James Holmes has been charged at a state level.

I wish it did apply. The 8 week old baby deserved better.

Murder is a offense that's why it applied to Conner should to this baby too. Conner wasn't a federal baby or on federal grounds or anything federal.

Look I am telling you the law. I'm sorry but Conner's law wont apply here no matter how much we may wish it. Unless this man is charged with a crime that falls under the jurisdiction of the Federal Government.

36 states currently offer babies in the womb legal protection. Colorado is not one of them.

Ok I found it. This is from your link.

The law applies only to certain offenses over which the United States government has jurisdiction, including certain crimes committed on Federal properties, against certain Federal officials and employees, and by members of the military. In addition, it covers certain crimes that are defined by statute as federal offenses wherever they occur, no matter who commits them, such as certain crimes of terrorism.

I'm sure her/his mommy considered her baby to be a child, whether he/she was in or out of the womb. Let's not destroy this woman's life any further, by taking that away from her too.

The fetus died, right? If it didn't 'die', did it disappear?

Of course it should be counted as a death and a particularly cruel one at that.

    Quite frankly ..
YES .. this little angel .. the one she was carrying .. should be considered another DEATH at the hands of this HEINOUS MONSTER ..

HOLMES should face the DEATH PENALTY .. with immediate execution following sentencing for his crimes ..
there's no 'insanity' here .. he well thought-out his plan, documented it, noted it .. gathered his 'implements of death' ... and did what he INTENDED (pre-meditated COLD-BLOODED Monster MURDERER that he is ).

DENY any insanity plea .. no plea bargains .. he should NEVER linger on for decades in prison with everything coddling his MONSTROUS deeds .. Just line him up .. light him up .. and that is that ..

This is a great question. Certainly, there should be some punishment for this miscarriage but I don't think it is a murder. At least, the Bible doesn't appear to define it as such.

    Yes.
And the killer should be put to death, immediately as a danger to society, in the same manner as a rabid animal would be.
Wasting $$ keeping him locked up is pointless, and $$ better used elsewhere--Holmes does not deserve continued existence because of his actions thus far. He's a waste of skin, blood, and bone as well as Human potential and his continued existence lessens us all as a species for tolerating such a monster to live.
His death should be quick and efficient, in the same way you'd throw a candy bar wrapper into the trash can. He doesn't deserve mercy, but people deserve NOT to wast any more $$ on this monster wearing a Human skin.
