SCOTUS Rejects Arizona Voter Suppression Law UPDATED

I don't know if anyone has diari about this, but I couldn't help but noticing this
piece about a U.S. Supreme Court decision that was easily overshadowed
by the actions on President Obama's Affordable Healthcare Act and
Arizona's "Papers Please" law.

In a little-noticed ruling amidst clamor over the healthcare decision, the U.S. Supreme Court on Thursday rejected an Arizona law requiring proof of citizenship to register to vote, holding it was preempted by the National Voting Registration Act (NVRA). The law was adopted as a "model" bill by the American Legislative Exchange Council [ALEC] in 2008.

It may not have received the notice "papers please" and the Affordable
Healthcare Act ruling got, but the significance of this ruling cannot be
overstated.

Arizona Proposition 200 became law in 2004 and required
election officials to reject voter registration forms that did not
include documentation proving citizenship. Critics said that there was
no evidence that illegal immigrants attempted to vote in state or
federal elections and the real intent of the law was to shut down
community voter registration drives.


I realize this diary is brief, but I hope this ruling is just the
beginning of the end of the GOP's un-American efforts to keep those who
oppose them from voting. I hope this sparks similar actions that assures
that ALL eligible Americans are allowed to vote.

On June 28, the Supreme Court dealt the ALEC agenda another
blow by declining to stay a ruling by the Ninth Circuit holding that
Arizona's Proposition 200 (the ALEC Taxpayer and Citizen Protection Act)
was preempted by the NVRA. The NVRA, also known as the "Motor Voter
Act," was designed to make voter registration more simple and unified.
Arizona’s refusal to accept federal voter registration forms without
proof of citizenship, the Ninth Circuit held, imposed additional
restrictions beyond what was called for under the federal law.

Two weeks ago, Arizona asked Justice Kennedy to stay the
decision,which he did temporarily, but on June 28 the full Court vacated
that temporary order (with Justice Alito dissenting). This means the
Ninth Circuit decision stands, and citizens will be able to register in
Arizona without having to provide additional documentation proving their
citizenship.

    Yes and if the SCOTUS see these new laws we will see a major change in the attitude of the Courts towards personal freedoms.

    We have laws. I had to get my voter Registration, and show proof of Citizenship..I was born here, so my birth certificate, and drivers license were O.K. If you are not a U.S. Citizen, why should it be all right to vote in the Election? Go for Citizenship, then vote. If you are not here legally, you have NO right to have your voices heard.

    Daily Kos is not what I would call a valid source for anything. Just the headline was full of loaded words. First, how is it "suppression" to demonstrate that you are the person whose name is on a voter registration roll? Is is also suppression when you cash a check and they ask for ID? Voters have the right to one vote per person,yet many people move and register in several places and may hold several voter registration cards. Is it right that they can vote in every precinct in which they have ever lived? And please don't tell me that doesn't happen because there were several report of snowbird seniors voting in their winter residence in Florida and "at home" via mail in New York. It would help you to read more widely on the issue because as identity theft becomes more prevalent with the failure to enforce the borders, it becomes easier for people to vote using the identities of others as well. Do you really want people who are not citizens here, who don't pay taxes, who don't have a vest interesting in the benefits to the people of this nation to have a say in how we live or who gets to make decisions that impact all of us?

    While the federal government may be able to decide who can register to vote for federal offices, it is a severe violation of federalism for the federal government to dictate to the states who can vote for state and local offices. The anyone can vote basis for the NVRA is clearly bad law and that needs to be replaced. Too many close elections have been decided by the risen dead, non-human animals, the institutionalized, and multi-state voters.

    I'm not confident. Justice Roberts did his job ONE TIME and ruled according to the LAW and the CONSTITUTION, and the rabid right-wing went ape shit. I wouldn't hold my breath expecting them to actually rule according to the LAW & CONSTITUTION again, all the conservative justices on the SCOTUS are hard right ideologues.

    I was taught in elementary school, that you have to be a citizen in order to have the right to vote. A dead man should not be able to vote and neither should someone who is not a legal citizen of this country. That's a no-brainer. I'm all for proving you are who you say you are and having a valid id to prove that before you get to register, as a voter, is part of that.

    Republican legislatures in 11 states since 2010 have attempted to put voter suppression laws on the books. Most notably in Florida, Maine, Arizona, Ohio, and Michigan. This is not a lie or a fake controversy being "stirred up" by liberals.

    All I know is everytime I register to vote and go vote I have to show my ID. And I am ok with it. I see nothing wrong with people having to show your ID when it comes to voting this way illegals wont vote.

    I no longer believe that SCOTUS is the final answer. I think the real answer is "We The People"
    I just went to the DMV to get my new DL and before they would issue me one I had to present my U.S. Passport or birth certificate.
    I had no wait in line like I used to when they had to have a Spanish translator available at all times. There was one but he had to speak English.
    I have been thinking about taking a trip to Mexico and voting in their presidential election.
    There is a bus loading now in Yuma, Arizona.

    It has always been We The People - somehow we became lax and forgot to watch our elected leaders closely. When leaders tell us that the dead and illegals can vote (and make no mistake, that is what democrats are saying) - we need to toss their butts to the curb.

    We took our son to get his DL and had to get, not the hospital BC, but the certified one for the state with the seal on it. I know exactly what you are saying

    I DO know that showing an ID has ALREADY been ruled on and SCOTUS UPHELD the law... only the Southern states are subject to Eric Holder's REIGN OF TERROR our laws must be approved by him. Other states don't have that problem.

    I can understand why liberals are opposed to showing ID to vote, just look at the recall petition in WI. The only way that they could get enough names was to use names of cartoon characters, criminals and dead people. What is amazing is that a liberal court upheld the use of these illegal methods.

    Where I live, I do not have to provide my ID to vote. We have a large population of illegal Latinos.

    We should have a state voter ID, and it should be required to vote.

    Voter suppression? Where is there any voter suppression law? Show me one.

    I have read the amended portions of the AX Proposition 200 related to voting. Explain to me how asking a person registering to vote to shop proof of being a citizen of the US (a requirement to actually vote). Being a citizen to vote is spelled out in the Constitution. So how can ascertaining said status of a person requesting to vote be wrong?

    Eric Holder and the DOJ tried stopping us Floridians from purging our voting rolls of illegal voters. Last Wednesday a Federal Judge over-ruled Mr. Holder, and I've heard nothing else since, so we Floridians are going through with removing illegal voters.

    What I think is funny is that it was mentioned the other day that at a recent Obama fund raiser they were checking I.D.'s VERY closely before letting anybody in. You don't think that the same should be required before being able to vote for the President ? I would consider voting for to be a little bit more important then just seeing them ! I also see where Holder and friends are at it again ! Suing Florida to stop purging their voting records of the deceased ! Why would they do that unless they feel they are about to lose their most loyal voting block !!
